SUBJECT: ADOPT RESOLUTION NO. CC 2023-011, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF PALMDALE MAKING
LEGALLY REQUIRED FINDINGS AND EXTENDING REMOTE
TELECONFERENCE PARTICIPATION FOR MEETINGS OF
THE CITY COUNCIL AND/OR ITS RELATED OR
SUBORDINATE LEGISLATIVE BODIES
ISSUE
Adopt Resolution No. CC 2023-011, a Resolution of the City Council of the City of Palmdale authorizing remote teleconference participat ion for meetings of the City Council and/or its subordinate legislative bodies for an additional 30-day period.
RECOMMENDATION
Staff recommends that the City Council:
1. Approve the resolution to thereby extend, for an additional 30-day period, the authority of the City Council, and all related and/or subordinate legislative bodies, to participate remotely in properly noticed meetings.
BACKGROUND
Since October 1, 2021 AB 36 1 has temporarily amended the Ralph M. Brown Act (California Government Code § 54950 et seq.) to provide more flexibility regarding participation in public meetings from a remote location. In layman’s terms AB 361 allows “zoom” meetings if specified requirements are met.
If the City Council authorizes remote meetings, such initial authorization must expire no later than 30 days from the initial authorization. The City Council is authorized to thereafter extend the authorization if it makes one of various specified findings.
AB 361 requires several procedural safeguards to protect public participation during a remote meeting, key ones of which are summarized as follows:
1. The public must have the ability to address the legislative body directly and must be given information on how to address the legislative body;
2. The public must be provided with either a call-in or internet-based service option;
3. The legislative body must stop the meeting if the call-in or internet-based option fails;
Report to Mayor and City Council
Re: Resolution No. CC 2023-011
January 18, 2023
4. The legislative body cannot require that public comments be submitted in advance (although this option can be provided);
5. Public speakers cannot be required to pre-register for public comment (except as required by an independent call-in or internet platform);
6. Members of the public must be given a reasonable time to register to provide public comment; and
7. Agencies that provide a timed public comment period shall not close the public comment period until that time period has expired.
DISCUSSION
The City Council adopted an initial AB 361 Resolution on June 15, 2022. This resolution has been extended multiple times. The most recent extension is set to expire on January 20, 2023. The question before the City Council is whether to extend this authority for an additional 30-day period. An extension of authority to remotely participate is allowed if (1) the state of emergency continues, and (2) a resolution with required findings has been adopted within the last 30 days.
The proposed resolution would be immediately effective and allow members of legislative bodies to continue to participate remotely for an additional thirty days if the agenda for the meeting has included the legally required participation noticing. The resolution would also allow the City Manager (or designee) to opt to not include such noticing, as there may be instances where it would be impractical, due to staffing considerations, to allow remote participation in meetings.
FISCAL IMPACT
There is no fiscal impact associated with this action.
STRATEGIC PLAN
Goal II: Ensure long-term fiscal health of the City and maintain funding for services.
C. Involve and expand engagement to enhance public oversight and transparency.

FINDINGS
Staff reviewed the City of Palmdale Municipal Code Section 2.08.030 (B) which states board and commission vacancies are volunteer positions. Several of the bylaws reviewed stated no compensation shall be provided to individuals holding the volunteer positions. The current PMC will require updates if the compensation is approved.
In addition, staff surveyed several cities and found that board and commission positions are usually volunteer positions, below is a chart showing the results.
DISCUSSION
The proposed Ordinance sets the compensation for all City boards, commissions and committees at $100 per meeting with no more than two (2) meetings per month compensated. In addition, the Chairs for each board, commission and committee shall be entitled to an additional $50 per meeting. In addition, to avoid any confusion or conflict, City Council Resolution No. 89-74 setting the compensation for Planning Commission members and City Council Resolution No. 95-157 setting the compensation for Mobile

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALMDALE AMENDING PALMDALE MUNICIPAL CODE SECTION 2.08.030

COMMITTEE MEMBERS AND LIMITING SERVICE TO ONE BOARD,
COMMISSION OR COMMITTEE AT A TIME
SECTION 1. Section 2.08.030 of the Palmdale Municipal Code is amended in its entirety to read as follows:
2.08.030 Appointments to boards, commissions, and committees.
Unless otherwise specifically provided in this code or by state law, the City Council shall make all appointments to boards, commissions and committees of the City as follows unless otherwise formed by resolution:
(A) City Council boards, commissions and committees shall consist of a minimum of five members, who shall be nominated by each City Councilmember, subject to approval by the City Council, for appointment. All members shall be voting members of the board, commission, or committee. No member shall be a member of the City Council. It is preferable that a City Councilmember’s appointee reside within the Councilmember’s district; however, it is not required when subject matter expertise is desirable. Members serve at the pleasure of the City Council and may be removed prior to the expiration of their term by a vote of a majority of the members of the City Council. (B) All board and commission vacancies shall be advertised, seeking applicants willing and desiring to be appointed to fill such vacancies. Any person seeking to be so appointed must complete and submit the City application, together with any other information requested by the City Council as appropriate for a specific board or commission. (C) All such applications shall be provided to the City Council for review, who shall, at a regularly scheduled City Council meeting, nominate, from among such applicants, the persons whom the City Councilmembers desire to appoint by making a motion for each such appointment.
(D) If the nomination is approved by a majority vote of the City Council, the nominating City Councilmember may then proceed to appoint the person to the board or commission under consideration.
(E) If the specific nomination by the City Councilmember is not approved by a majority vote of the City Council, the City Council will nominate, by motion, a different candidate until someone is approved by majority vote of the City Council for the position under consideration.
Ordinance No. 1608
(F) All members of boards, commissions and committees serve at the pleasure of the City Council and are subject to removal by a majority vote of the City Council. (G) A board, commission or committee member shall serve on only one board, commission, or committee at a time. If a member is appointed to another board, commission, or committee while serving on another board, commission, or committee, that member shall immediately be deemed to have resigned from the other board, commission, or committee. Notwithstanding the above, a member of the Planning Commission shall also serve on the Public Arts Commission pursuant to Section
15.01.070(B).
(H) All members of boards, commission and committees shall be entitled to compensation in the sum of One Hundred Dollars ($100) for each meeting attended, provided, however, that no member shall be paid such compensation for attendance at more than two such meetings during any one calendar month. The chair of the board, commission or committee shall be entitled to additional compensation of Fifty Dollars ($50) per meeting attended, limited to two meetings per calendar month. Notwithstanding the above, pursuant to Section 3.05.030(D), the Audit Committee shall not be eligible to receive any compensation.
SECTION 2. Severability. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held invalid by a court of competent jurisdiction, such a decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have passed this Ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses, or phrases, be declared invalid.
SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause this Ordinance to be published and posted as required by law.
