enacted on March 27, 2020, to be used to exclusively on eligible activities that prevent and respond to the COVID-19 pandemic.
CDBG-CV funding was allocated to eligible activities including South Antelope Valley Emergency Services (SAVES), Business Public Service, Economic Opportunity Programs, Mortgage Assistance, Rental Assistance and Administration of the grant funding.
In addition, SAVES received an allocation of Community Development Block Grant funds for the 2022-2023 Program Year for operations of the SAVES Program.
DISCUSSION
SAVES has continued to provide increased services to the community since the COVID emergency was initiated. Currently SAVES is providing 1,000 to 1,800 food orders weekly. Due to the high level of service provided by SAVES and increased costs for a period of time longer than anticipated when funding was initially provided, SAVES is requesting an increase of $180,000 funding, increasing funding from $575, 010 to $755,010.
The Emergency Rental Assistance (COVID) Program (ERAP) has an interest list of 344 households. Under ERAP rental assistance of up to a total of $10,000 for up to six consecutive months may be provided to eligible households. Housing Division Staff has requested additional funding of $178,000 increasing CDBG-CV funding from $300,000 to $478,000.
The Mortgage Assistance Program has determined 7 households may be eligible for assistance and have been provided applications. Under this program an eligible household’s payment assistance may be up to a total of $6,000 for up to six consecutive months. Funding of $42,000 is allocated for these applicants. Loans in forbearance are not eligible for assistance due to not being delinquent. The Mortgage Assistance Program CDBG-CV allocation available for reprogramming is $258,000.
The CDBG-CV grant provides 20% of the allocation for Administration of the grant.
Administration funds of $239,600 are currently available. Staff is utilizing Administration funding for processing program applications to maximize the funding available for direct program assistance and determined $100,000 may be reprogrammed for ERAP assistance.
The requested reprogramming of CDBG-CV funds is a non-substantial amendment to the 2019-2020 Action Plan in accordance with the approved Citizen Participation Plan.
Budget transfers are requested for SAVES CDBG-CV to allocate funding for operations accounts. Budget transfers are requested for SAVES to allocate funding for operations accounts. SAVES CDBG approved funding for Program Year 2022-2023 is $217,917 and the current budget is $226,560, requiring a reduction of $10,580.

SUBJECT: ADOPT RESOLUTION NO. CC 2023-023, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF PALMDALE AUTHORIZING THE
EXECUTION OF A SURETY BOND TO MEET THE FINANCIAL
SECURITY REQUIREMENT FOR ENERGY FOR PALMDALE’S
INDEPENDENT CHOICE
ISSUE
Adopt Resolution No. CC 2023-023, a Resolution of the City Council of the City of Palmdale authorizing the execution of a Surety Bond to meet the financial security requirement for Energy for Palmdale’s Independent Choice.
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. CC 2023-023 authorizing the execution of a surety bond to meet the Financial Security Requirement for EPIC.
BACKGROUND
On April 2, 2019, City Council adopted Ordinance No. 1524 establishing the Palmdale Community Choice Aggregation ( CCA) program, Energy for Palmdale’s Independent Choice (EPIC). EPIC began serving electricity to customers in October 2022. EPIC’s mission is to provide the benefits of clean, renewable energy while achieving greater local control over electricity services, promoting competitively priced renewable energy options, and providing quality programs and services to the local community.
DISCUSSION
In 2018, the CPUC issued Decision 18-05-022 (Decision) which established reentry fees and Financial Security Requirements (FSR) for CCAs. The purpose of the FSR instrument is to cover reentry feesborne by the Investor Owned Utility (IOU) in the event of a mass involuntary return of CCA customers to the IOU, such as a decertification of a CCA or a CCA failure. The IOU may only withhold funds from the financial security instrument for unpaid administrative or procurement costs associated with the return of CCA customers to the IOU. Any withholding of those funds must first be approved by the CPUC.
Report to Mayor and City Council
Re: Adopt Resolution No. CC 2023-023 Authorizing the execution of a surety bond to meet the Financial Security Requirement for Energy for Palmdale’s Independent Choice April 5, 2023
The Decision required all CCAs, including EPIC, to submit an Advice Letter with the FSR instrument to the CPUC to show compliance with the Decision. The City’s CCA consultants, California Choice Energy Authority (CalChoice), worked with its legal team to draft the advice letter, which was submitted with a copy of an executed Letter of Credit, which was the instrument used to satisfy the FSR obligation. The FSR amount has been $147,000 since the initial posting of the Letter of Credit in 2021. The Letter of Credit, issued by River City Bank (RCB), is collateralized by a cash deposit of $147,000 in an account held with RCB in the City’s name.
The methodology used to calculate the FSR amount for CCAs is under review at the CPUC to ensure that IOUs do not unreasonably bear costs associated with CCA customer returns to the IOU. In anticipation of a change to the methodology to calculate the FSR amount which may result in an increase in the FSR amount, staff is proposing replacing the current Letter of Credit, which requires dollar-for-dollar cash collateral, with a surety bond, which is more flexible and has an approximate one percent (1%) annual fee. Because the methodology used to calculate the FSR includes benchmarks related to energy pricing, which can move up and down depending on market conditions, staff is requesting a not to exceed amount that contemplates future volatility in the energy market. Currently, the estimated fee for the first year is less than $2,000. When the current Letter of Credit expires, the $147,000 cash collateral will be released to the City.
Based on the foregoing, staff recommends the City Council adopt Resolution No. 2023- 023 authorizing the execution of a surety bond and related documents for the purpose of satisfying the Financial Security Requirement as required by the California Public Utilities Commission.
FISCAL IMPACT
Fees for FY 2022-2023 are approximated around $2,000 and have already been budgeted for in account 35034003-721411. Staff is requesting a not to exceed amount that contemplates future volatility in the energy market and is not to exceed $25,000, annually. Sufficient revenues will be generated by EPIC to cover operating expenses, including surety bond fees.

General Agreement of Indemnity
This General Agreement of Indemnity (this "Agreement") is made and entered into by the undersigned (individually and collectively, the “INDEMNITORS”) for the benefit of Federal Insurance Company and Westchester Fire Insurance Company, their respective direct and indirect subsidiaries, parent companies, and affiliates, whether in existence now or formed or acquired hereafter, co-sureties, fronting companies, companies which any of them may procure to issue or deliver any Bonds for, on behalf of or at the request of any of the Indemnitors, and reinsurers, and the successors and assigns of each of them (individually and collectively, the “SURETY”), for the purpose of indemnifying the SURETY from any and all loss, cost and expense in connection with any and all surety bonds, undertakings, guarantees and/or contractual obligations previously or hereafter executed, issued, procured, delivered or undertaken by the Surety, whether directly or as a result of any asset purchase, merger, acquisition or similar transaction, including any renewals, modifications and/or extensions thereof, for, on behalf of or at the request of: any of the Indemnitors, whether individually or jointly with others; any current or hereafter created or acquired subsidiary, affiliate, joint venture and/or other legal entity in which any of the INDEMNITORS has a substantial, material or beneficial interest; and/or any other party at the request of any of the INDEMNITORS (each a "Bond" and collectively "Bonds").
NOW THEREFORE, in consideration of the SURETY executing the Bonds, the INDEMNITORS agree that:
1. PREMIUMS & COLLATERAL FOR SURETYSHIP- The INDEMNITORS shall pay or cause to be paid to the SURETY both the agreed premium and, upon written request by the SURETY at any time, collateral security for its suretyship until the INDEMNITORS shall furnish to the SURETY competent written evidence, satisfactory to the SURETY, of the termination of any past, present and future liability under any Bond. The INDEMNITORS expressly waive any right to interest which may be earned on the collateral security and further consents that the collateral security provided in consideration of suretyship may be held by the SURETY in any investment or depository that the SURETY in its sole discretion deems advisable and prudent. The Surety’s election not to demand collateral now or at any time shall not operate as a waiver of the right to demand and receive such collateral at any time before liability has terminated under any Bond.
2. INDEMNITY & COLLATERAL FOR CLAIM- The INDEMNITORS shall indemnify and save harmless the SURETY from and against any and all liability, claim, demand, loss, damages, expense, cost, attorney’s fees and expenses, including without limitation, fees and disbursements of counsel incurred by the SURETY in any action or proceeding between the INDEMNITORS and the SURETY, or between the SURETY and any third party, which SURETY shall at any time incur by reason of its execution of any Bond or its payment of or its liability to pay any claim, irrespective of whether the claim is made against the SURETY as a joint or several obligor and whether the INDEMNITORS are then liable to make such payment, and to place the SURETY in funds to meet all of its liability under any Bond, promptly upon request and before the SURETY may be required to make any payment thereunder; and copy of the claim, demand, voucher or other evidence of the payment by the SURETY of any liability, claim, demand, loss, damage, expense, cost and attorney’s fees, shall be prima facie evidence of the fact and amount of INDEMNITORS’ liability to the SURETY under this Agreement. Any demand upon the SURETY by the Obligee shall be sufficient to conclude that a liability exists and the INDEMNITORS shall then place the SURETY with sufficient funds in a form and amount deemed acceptable in the SURETY’S sole discretion, as collateral security to cover the liability.
3. OTHER INDEMNITY -- The INDEMNITORS shall continue to remain bound under the terms of this Agreement even though the SURETY may have heretofore or hereafter, with or without notice to or knowledge of the INDEMNITORS, accepted or released other agreements of indemnity or collateral in connection with the execution or procurement of said Bonds, from the INDEMNITORS or others. The rights, powers and remedies given the SURETY under this Agreement shall be and are in addition to and not in lieu of, any and all other rights, powers and remedies which the SURETY may have
January 2016
or acquire against the INDEMNITORS or others, whether by the terms of any agreement or by operation of law or otherwise.
4. INVALIDITY- In case any of the INDEMNITORS fail to execute this Agreement, or in case the execution hereof by any of the INDEMNITORS be defective or invalid for any reason, such failure, defect or invalidity shall not in any manner affect the validity of this Agreement or the liability hereunder of any of the INDEMNITORS executing the same, but each and every INDEMNITOR so executing shall be and remain full bound and liable hereunder to the same extent as if such failure, defect or invalidity had not existed.
5. SURETIES - All of the terms, provisions and conditions of this Agreement shall be extended to and for the benefit not only of the SURETY, either as a direct writing company or as a co-surety or reinsurer, but also for the benefit of any surety or insurance company or companies with which the SURETY may participate as a co-surety or reinsurer and also for the benefit of any other company which may execute any bond or bonds at the request of the SURETY on behalf of any of the Principals.
6. DECLINE EXECUTION - Unless otherwise specifically agreed in writing, the SURETY may decline to execute any bond and the INDEMNITORS shall make no claim to the contrary.
7. CHANGES, WAIVER OF NOTICE - The INDEMNITORS hereby waive notice of changes to the Bonds or the obligations covered by the Bonds , and agrees that any such changes will not affect INDEMNITORS’ obligations under the terms of this Agreement. Such changes may include but are not limited to continuations, extensions or renewals of the Bonds, the execution of any substitute or substitutes therefore, with the same or different conditions, provisions and obligees with the same or larger or smaller penalties; it being expressly understood and agreed that the INDEMNITOR shall remain bound under the terms of this Agreement even though any such change does or might substantially increase the liability of the INDEMNITORS. The INDEMNITORS waive notice of the execution of Bonds, acceptance of this Agreement, default or other acts giving rise to a bond claim or liability of the SURETY under Bonds.
8. TERMINATION - This Agreement may be terminated by any of the INDEMNITORS upon twenty days’ written notice sent by registered mail to the SURETY at its home office at Chubb Surety, WA10G, 436 Walnut Street, Philadelphia, Pennsylvania 19106-3703, but any such notice of termination shall not operate to modify, bar or discharge the INDEMNITOR as to the Bonds that may have been executed before the date on which such termination notice becomes effective.
9. SEVERABILITY - If any provision or provisions of this Agreement be declared void or unenforceable under any law governing its construction or enforcement, this Agreement shall not be void or vitiated thereby, but shall be construed and enforced with the same effect as though such provision or provisions were omitted.
10. SPECIFIC PERFORMANCE – The INDEMNITORS hereby represent and acknowledge that if any INDEMNITOR breaches its obligations set forth in paragraphs 1 or 2 of this Agreement, the SURETY will have no adequate remedy at law, will suffer irreparable harm, and shall be entitled to injunctive relief enforcing the terms of such paragraph, as well as a final decree, order or judgment granting SURETY specific performance of the terms of such paragraph.
11. CHOICE OF LAW/FORUM - It is mutually agreed that this Agreement is deemed made in the State of New York, regardless of the order in which the signatures of the parties shall have been affixed and shall be interpreted, and the rights and liabilities of the parties determined in accordance with the laws of the State of New York. INDEMNITORS agree that all actions or proceedings arising directly or indirectly from this Agreement shall be litigated only in courts having status within the State of New York, and consents to the personal jurisdiction and venue of any local, state or Federal Court located therein.
12. JOINT/SEVERAL - Each undersigned INDEMNITOR, its successors and assigns, is jointly and severally bound by the foregoing conditions of this Agreement.
January 2016
13. PAY ON DEMAND BONDS – INDEMNITORS may request that SURETY, from time to time, execute Bonds which may require the SURETY to make payment to the Obligees of such Bonds upon such Obligees’ demand (“Pay on Demand Bonds”). INDEMNITORS undertake and warrant that they will deposit cash with the SURETY in such amount and form as demanded by the SURETY within 5 business days following receipt of a written demand from the SURETY stating that it has received a claim on one or more such Pay On Demand Bonds.
14. FACSIMILE – This Agreement bearing the signature of the INDEMNITORS shall be valid, effective and enforceable whether received by the Surety as an original, digital or scanned image, or as a facsimile transmission.
IN WITNESS WHEREOF, INDEMNITOR has signed this Agreement this _______ day of , 20____.

Please describe any public

As a Parks and Rec commissioner, we gave direction to staff and input to the San Fernando city council in the form of recommendations for improving services to residents.
How do you feel you would
add value to the Human
Rights Advisory Committe
e?
What unique
characteristics,
qualifications, perceptions,
and experiences would you
bring to the Committee?
Through the course of my employment and my civic engaged for the past fifty (50) years, I have dealt with human relations issues and concerns and
have strove to improve conditions
and ameliorate root causes that prevent us from understanding one another and prevent us from moving forward as one
people. Issues like barrio warfare to racial inequality in employment and education to the need for polit
ical
representations ands economic viability are examples.
What are your long
-
term
goals as a Human Right
Advisory Committee
member?
Strides have been made and human relations have improved over the past 50 years, but there remains a way to go. I have ide
as on how we can improve human relations in Palmdale and make the city more equal and equitable. There is a need to improve the lot of the most downtrodden, the immigrant
community, of which there are 40,000 in the city. Bringing them out of the shadows an
d into the social fabric of our society can
be done without hurting anyone and ultimately benefiting all. .
What additional
information would you like
us to know to better assess
your suitability for the
Human Rights Advisory
Committee?
I have vast exper
ience in the area of human relations and
believe I would be an asset to the city if given the opportunity and support. We can make Palmdale an exemplary city by
making it it one of the healthiest and safest cities in California and the Nation. There is no
reason why the city cannot be
labelled a Blue Zone by the World Health Organization and this is what I would like to accomplish.

Alpha Kappa Alpha Sorority, Incorporated
EveryoneOn, Executive Chair of the Board
Please describe any public
service experience serving
on a commission or public
body?
Although I do not currently serve on a commission or public body, I work very closely
with the California Public Utility
Commission, as well as digital equity advocacy groups to ensure all people in under
-
resourced communities have access
to affordable internet services, devices, and digital skills trainings.
How do you feel you would
add
value to the Human
Rights Advisory Committee?
What unique
characteristics,
qualifications, perceptions,
and experiences would you
bring to the Committee?
At the center of everything I do is my commitment to recognize and honor the inherent dignity of each
human being, and value
the rich diversity of our communities. Throughout my career this guiding principle has opened the door for me to
meaningfully engage and stand in genuine solidarity with all people
–
particularly the most vulnerable
–
and contribute
to
the common good. It is my desire to continue my efforts by serving on the Palmdale Human Rights Advisory Committee, and advocate for residents of the city in which I live and love. I bring a wide range of professional experiences that would add value t
o the committee, to include, a middle school math and
science teacher in two of the most under
-
resourced
communities in California
-
South Central Los Angeles, and
West Oakland; a small business advisor to minority
-
owned
businesses; government affairs profe
ssional and DEI champion
for the world’s largest telecommunications company; the first woman and Black person to serve as Executive Chair of the Board of EveryoneOn, a National digital equity nonprofit organization; and the curator of DEI curriculum for th
e
University of California Santa Cruz Extension, which addresses highly complex social issues within a variety of industries while closing skills gaps and reducing DEI disparities.
What are your long
-
term
goals as a Human Right
Advisory Committee
member?
Technology is the thread that keeps us all connected. It touches every corner of our society
-
from education, housing,
employment, government, and race relations to social equity.
Never was that made more evident than when the world faced mandated isolati
on protocols due to the pandemic. Students,
working people, and families struggled to get and stay
4 connected. This is why I believe digital equity is a human rights issue and should be an integral part of the framework when building and maintaining an incl
usive community. One of my
long
-
term goals is to create more awareness around the
barriers to connectivity our community faces, and work to inform our digital inclusion policies, advocacy efforts, and funding to support connectivity for all our residents.
With the
passing of the unprecedented Infrastructure Investment and Jobs Act and Affordability Connectivity Program it presents an opportunity to create a more inclusive and equitable approach to digital equity.
What additional
information would you like
us to know to better assess
your suitability for the
Human Rights Advisory
Committee?
I am committed to strengthening inclusive strategies that better position the city of Palmdale to be the example of what is truly possible when you build a robust and su
stainable plan of action
based on a culture of diversity, inclusion, representation, and equality for all. I embrace the interdependence of diverse communities, and value the bonds of our mutuality. As Dr.
Martin Luther King Jr. stated, “Whatever affects o
ne directly
affects all indirectly.”

Please describe any public
service experience serving
on a commission or public
body?
I was an advisory member for California
Multiple Tiers of
Support Advisory Committee, the purpose of the advisory committee was to serve as a sounding board for the state pilot and its implementation. The mission was to improve school climate and reduce student suspensions that disproportionalit y
impact low income students of Color. We met online and in person to help develop a framework and used a shared
approach to develop the components of the pilot program.
How do you feel you would
add value to the Human
Rights Advisory Committee?
What uniq
ue
characteristics,
qualifications, perceptions,
and experiences would you
bring to the Committee?
I currently serve as a Human Rights Cadre Trainer for the California Teachers Association. My subject area covers Transformative Social Emotional Learning, w
hich is a term
used to describe SEL that uses an equity and social justice lens to implement SEL for community members including
children and adults. It covers belonging, agency, identity, empowerment and self determination. I would use a
Transformative SE
L lens as a member to help elevate all
voices in our community.
What are your long
-
term
goals as a Human Right
Advisory Committee
member?
I hope to create an updated action plan that focuses on engaging community stakeholders, researching and creating opp
ortunities for the community members to learn how to build bridges, focus on equity and connect across various
intersections. We should also include in our action plan a recommendation for programs, policies and activities that reduce discrimination and in
crease a sense of belonging, and
promote civil and human rights for all. I would also advocate for more educational and informational material to be
disseminated related to discrimination, microaggressions, 4 inequity, etc. and ways community members can pos
itively
address issues when they occur. I would also like the city to partner with organizations such as Operation Respect that offer free resources that can be shared in our community. For example, Operation Respect shares ways we can celebrate diversity
in a manner where we identify differences and
similarities in a non judgmental way and become more
sensitive in how we respond to community members who may have different backgrounds than our own.
What additional
information would you like
us to know to
better assess
your suitability for the
Human Rights Advisory
Committee?
I have lived in Palmdale for over 25 years and I've witness our community diversify over the years. I want to be apart of a program where I'm of service and help the City of Palmdale c
ontinue to be an example for other communities in our area and state.
