A. Weeds, asdefinedin Section8.08.010(b) of the PaloAlto MunicipalCode, are anticipatedto developduringcalendaryear2026uponstreets, alleys, sidewalks, and parcelsof privatepropertywithin the Cityof PaloAlto sufficientto constitutea public nuisanceasa fire menacewhendry or areotherwisecombustible, or otherwiseto constitutea menaceto the publichealthasnoxiousor dangerous.
NOW, THEREFORE, the Councilof the Cityof PaloAlto doesRESOLVEasfollows:
SECTION1. Weeds, asdefinedin Section8.08.010(b) of the PaloAlto MunicipalCode, whichareanticipatedto developduringcalendaryear2026uponstreets, alleys, sidewalks, and parcelsof privatepropertywithin the Cityof PaloAlto, areherebyfoundanddeterminedto constitutea publicnuisance. Suchnuisanceisanticipatedto existuponsomeof the streets, alleys, sidewalks, andparcelsof privatepropertywithin the City, whichareshown, described, anddelineatedon the severalmapsof the propertiesin saidCitywhicharerecordedin the Officeof the CountyRecorderof the Countyof SantaClara, referencein eachinstancefor the descriptionof anyparticularstreet, alley, or parcelof privatepropertybeingherebymadeto the severalmapsaforesaid, and, in the eventof there beingseveralsubdivisionmapson which the samelots areshown, referenceisherebymadeto the latestsubdivisionmap.
SECTION2. THEREFORE, ITISORDEREDthat the saidpublicnuisancebe abatedin the mannerprovidedby Chapter8.08of the PaloAlto MunicipalCode:
i. ITISFURTHERORDEREDthat a publichearingshallbe heldon the 9th dayof February2026, at the hour of 5:30pm, or assoonthereafterasthe matter maybe heard, at the CouncilChambersof the CivicCenterof saidCity, at whichthe Council shallhearobjectionsto the proposedweedabatementof suchweedsandgiveany objectionsdueconsideration;
ii. ITISFURTHERORDEREDthat the FireChiefof the Cityof PaloAltoisdirectedto give noticeof the publichearingin the time, mannerandform providedin Chapter8.08 of the PaloAlto MunicipalCode.
SECTION3. andthe expensesthereof assesseduponthe lotsandlandsfrom which, and/or in the front and rear of which, suchweedsshallhavebeendestroyedandremoved.
SECTION4. TheCityCouncilof PaloAlto adoptsthe determinationof SantaClara County, asthe leadagency, that the WeedAbatementProgramiscategoricallyexemptfrom the provisionsof the CaliforniaEnvironmentalQualityAct (“CEQA”) pursuantto CEQA Guidelinessection15308.
