1 Ordinance No. ____
Ordinance of the Council of the City of Palo Alto Amending Section 18.08.040 of the Palo Alto Municipal Code (The Zoning Map) to Change the Zoning District Boundaries of 470 Olive Avenue from NV-R1 to NV-MXM
The Council of the City of Palo Alto ORDAINS as follows:
SECTION 1. Findings and Declarations. The City Council finds and declares as follows:
A. On May 27, 2025, the City Council directed staff to rezone 470 Olive Avenue from NV-R1 to a more appropriate zoning for housing transition.
B. On September 15, 2025, Jessica Agramonte, on behalf of Agramonte Property LLC submitted an application to rezone the property located at 470 Olive Avenue (“Property”, more particularly described in Exhibit A) from NV-R1 to NV-MXM (“Project”).
C. To align the Comprehensive Plan Land Use Map with the proposed zoning designation, the planning commission recommended, and Council adopted, Resolution _____amending the land use designation of the site from NVCAP Low Density Residential to NVCAP Medium Density Mixed-Use.
D. Following Staff Review, the Planning and Transportation Commission (“PTC”) held a duly noticed public hearing on July 8, 2026, and recommended ________ of the Project to the City Council.
E. On _______, following a duly noticed public hearing, Council determined that the rezoning is appropriate because it aligns with the adjacent NV-MXM zoned properties along El Camino Real, but provides a transition from those neighboring parcels, which are within the El Camino Real Focus area, to the adjacent lower density residential neighborhood northeast of the subject property.
F. The rezoning supports placement of the subject property on the housing inventory site to address no net loss requirements for the Regional Housing Needs Assessment, as required pursuant to state law.
SECTION 2. Amendment of Zoning Map.
Section 18.08.040 of the Palo Alto Municipal Code, the “Zoning Map,” is hereby amended by changing the zoning of the Property from North Ventura Single-Family Residential NV-R1 to North Ventura Medium-Density Mixed-Use NV-MXM, as shown in Exhibit B. *** NOT YET APPROVED ***

2 SECTION 4. Environmental Review.
The Council finds that the Ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 21080.085. This exemption applies to rezoning of sites to address No Net Loss Law (Gov Code Section 65863). Staff intends to place 470 Olive on the City’s housing inventory along with adjacent sites along El Camino Real, to address the shortfall of moderate-income units. Rezoning of this site is necessary for the site to accommodate moderate income units.
SECTION 5. Effective Date.
This ordinance shall be effective on the thirty-first day after the date of its adoption (second reading).
