Subject: Proposal to Provide Professional Engineering Services for the Preparation of a Grade Separation Study for the West Santa Ana Bicycle and Pedestrian Trail Phase III Improvement Project - Revised
Dear Ms. Figueroa:

Willdan Engineering (Willdan) is pleased to provide this proposal to provide professional engineering services for the preparation of a Grade Separation Study (GSS) to evaluate the feasibility of a grade separation crossing of the West Santa Ana Bike Trail (Phase III) and Union Pacific Railroad's (UPRR) Subdivision railroad corridor in the City of Paramount. Willdan has teamed with our railroad specialist subconsultant, JMD Inc., to prepare the GSS due to JMD’s extensive railroad experience. The GSS will identify the most feasible alternative for a grade separation of the proposed bikeway that meets the City’s objectives and California Public Utilities Commission (CPUC) requirements for future project development and funding, since the City’s proposal for an at-grade railroad crossing alternative was denied by UPRR.

Attached is JMD’s “Proposal to Provide Professional Railroad Engineering Services for the West Santa Ana Bike Trail (Phase 3) Grade Separation Feasibility Study, Paramount, California.” The scope of work for this proposal was developed collaboratively by the Willdan team and City staff.

The Willdan team will manage the overall study, attend coordination meetings, and support the City during the preparation of the GSS. Our role will focus on the following activities:
• Project Management Support
• Contract Financial Management
• Subconsultant Management

SCHEDULE
Willdan estimates that a draft GSS report can be completed for City review within five (5) months of a Notice to Proceed. A final GSS report can be submitted within one (1) month upon receipt of City and CPUC review comments.

The report is a comprehensive review of the condition of all city streets within Paramount boundaries and identifies those streets in most need of repair.

The adopted Fiscal Year 2024-25 budget includes Capital Improvement Project No. 9431 under which the following streets will be resurfaced:

SUBJECT: ADDING CHAPTER 2.08 TO TITLE 2 OF THE PARAMOUNT

MUNICIPAL CODE TO PROVIDE FOR THE ELECTRONIC AND

PAPERLESS FILING OF FAIR POLITICAL PRACTICES COMMISSION

CAMPAIGN FINANCE DISCLOSURE STATEMENTS AND

STATEMENTS OF ECONOMIC INTEREST

BACKGROUND
The Political Reform Act of 1974 requires appointed and elected officials to disclose information related to campaign finance and economics interests. The mission of the Act is to serve as the legal bedrock of governmental ethics in California. The Fair Political Practices Commission (FPPC) has primary responsibility for the impartial and effective administration of the Political Reform Act and sets regulations related to disclosure of campaign finance information and economic interests.

As the local filing officer for FPPC campaign finance documents and statements of economic interest in Paramount, the City Clerk is responsible for receiving and reviewing the documents and making them accessible to the public pursuant to FPPC regulations.

Currently, elected and appointed officials, City Council candidates, campaign committees, designated City staff and other filers identified in the City’s Conflict of Interest Code are only able to file their statements in hard copy, with an original signature per FPPC regulations.

During the budget adoption process, funds were allocated to procure an electronic/paperless filing system to provide a more efficient process for filing and managing these forms.

DISCUSSION
To increase efficiency and facilitate compliance with state law and FPPC regulations, the City looked to retain a robust, easy to use system for the electronic filing of economic and financial disclosure statements for filers in the Paramount organization. In addition to increased efficiency, electronic filing will eliminate the need for wet signatures and redaction of statements posted online and will automatically post a redacted version of each filing online upon submission of the electronic filing. For those filers who are unable Agenda Report August 13, 2024
ORDINANCE NO. 1187 Page 2
to file electronically, the City Clerk, as the City’s Filing Officer, will have the right to accept a paper filing in lieu of an electronic filing.

Under the City Manager’s signature authority, the City recently entered into an agreement with NetFile to provide an electronic/paperless filing system. This electronic/paperless filing system accommodates online filing of campaign finance disclosure statements (Form 460, 470, 496, 497, etc.) as well as statements of economic interest (Form 700) and meets the requirements of the Secretary of State. The system also provides access to on-demand ethics training for elected and appointed officials, as well as staff as mandated under Assembly Bill 1234 (2006) which requires local public officials to complete two hours of ethics training every two years. The ethics training course is designed to educate public officials on ethical standards required of individuals who works in local government and meets the requirements of AB 1234.

In order for the City of Paramount to accept electronically filed campaign finance related documents, the City Council will need to adopt an ordinance approving the use of an online or electronic filing system that includes the legislative finding that the online or electronic system will operate securely and effectively and will not unduly burden filers.

In terms of security, the NetFile system is a web-based, vendor-hosted application that utilizes “industry best practices” for securing data, using the same data encryption for online filings that is used by banks for online banking. NetFile stores and backs up data at two separate locations, creating the essential safety measures and redundancy that allow for the recovery of information in the event of an emergency or disaster.

The attached ordinance makes the necessary findings to allow for paperless filing of campaign finance statements.

The Form 700 and ethics training components of NetFile do not require an ordinance and are simply an internal procedural change.

FISCAL IMPACT
The annual cost for the NetFile system is $5,400. This expense was included in the adopted FY 2024-25 budget.

VISION, MISSION, VALUES, AND STRATEGIC OUTCOMES
The City’s Vision, Mission, and Values set the standard for the organization, establish priorities, uniformity and guidelines; and provide the framework for policy decision making. The Strategic Outcomes were implemented to provide a pathway to achieving the City’s Vision. This item aligns with Strategic Outcome No 6: Efficient, Effective, and Fiscally Responsible - Deliver an efficient and effective City government in a fiscally responsible, transparent and collaborative manner.
