REGULAR BUSINESS:
1. SUBJECT: Consideration and Necessary Action on Adoption of the Resolution No. 2022-52 Authorizing Deputy City Clerk to Execute Certificate of Acceptance of Deed for Real Property and Resolution No. 2022-53 Authorizing the Deputy City Clerk to Execute Certificates of Acceptance with Respect to Deeds Delivered to the City Pursuant to a Purchase Agreement Previously Authorized by the City Council.
RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 2022-52, Authorizing Deputy City Clerk to Execute Certificate of Acceptance of Deed for Real Property and Resolution No. 2022-53, Authorizing the Deputy City Clerk to Execute Certificates of Acceptance with Respect to Deeds Delivered to the City Pursuant to a Purchase Agreement Previously Authorized by the City Council.

Resolution 2022-53 of the City Council of the City of Parlier Authorizing Deputy Cit lerk to Execute Certificates of Acceptance with Respect to Deeds Delivered to the Cit Pursuant to a Purchase Agreement Previously Authorized by the City Council RECOMMENDATION:
Approve the Resolution 2022-51 of the City Council of the City of Parlier Authorizing Deputy City Clerk to Execute Certificate of Acceptance of Deed for Real Property Approve the Resolution 2022-52 of the City Council of the City of Parlier Authorizing Deputy City Clerk to Execute Certificates of Acceptance with Respect to Deeds Delivered to the City Pursuant to a Purchase Agreement Previously Authorized by the City Council BACKGROUND:
Resolution 2022-51 is the transfer of the grant deed, real property described in the attached Certificate of Acceptance. Sarbat Bhala Inc. purchased the property from the city to build a training center on or before Jan. 1, 2018, but the construction was never commenced so the property thereby the city demanded the property to be returned. This resolution is to accept the Deed for Real Property.
Resolutions 2022-52 is with respect to grant deeds delivered to the City pursuant to the terms of a purchase and sale agreement previously authorized by the City Council, the City's intent to accept the deed is demonstrated by the purchase and sale or other acquisition agreement previously approved by the City Council.
With respect to property acquired by the City pursuant to a negotiated purchase of real property by the City pursuant to an agreement previously approved by the City Council, the City wishes to designate its Deputy City Clerk as having blanket authority to execute Certificates of Acceptance which are required by law in order to record a deed in favor of the City.

RESOLUTION NO. 2022-52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PARLIER AUTHORIZING DEPUTY CITY CLERK TO EXECUTE
CERTIFICATE OF ACCEPTANCE OF DEED FOR REAL PROPERTY
WHEREAS, the City of Parlier transferred by grant deed, certain real property more particularly described in the Certificate of Acceptance that is attached and incorporated by reference to Sarbat Bhala Inc subject to conditions subsequent consisting of the construction of a new training center to commence on or before January 1, 2018, and the construction was never commenced; and
WHEREAS, the City demanded, and Sarbat Bhala Inc transferred the aforementioned real property back to the City on August 31, 2022 by Grant Deed; and WHEREAS, statute requires that any conveyance of real property to the City can only be recorded with a Certificate of Acceptance executed by a person authorized to do so.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The foregoing recitals are true and correct.
2. The Deputy City Clerk, Bertha Augustine, is authorized to execute the Certificate of Acceptance and cause the Certificate of Acceptance, that is attached and incorporated to this Resolution along with the Deed conveying the property to the City of Parlier described in the Certificate of Acceptance with the Fresno County Recorder's Office.

CERTIFICATE OF ACCEPTANCE
This is to certify that the City of Parlier, a California municipal corporation ("City") hereby accepts the "Property" as defined in the Deed to which this Certificate of Acceptance is attached. This acceptance is made pursuant to the authority conferred by City Resolution No. 2022-XX adopted on September 6, 2022, and the City hereby consents to the recordation of the Grant Deed to which this Certificate of Acceptance is attached.

RESOLUTION NO. 2022-53
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PARLIER AUTHORIZING THE DEPUTY CITY CLERK TO
EXECUTE CERTIFICATES OF ACCEPTANCE WITH RESPECT TO
DEEDS DELIVERED TO THE CITY PURSUANT TO A PURCHASE
AGREEMENT PREVIOUSLY AUTHORIZED BY THE CITY COUNCIL
WHEREAS, from time to time, the City acquires real property pursuant to an agreement with the property owner for the purchase or other acquisition of the property; and WHEREAS, with respect to grant deeds delivered to the City pursuant to the terms of a purchase and sale agreement previously authorized by the City Council, the City's intent to accept the deed is demonstrated by the purchase and sale or other acquisition agreement previously approved by the City Council; and
WHEREAS, with respect to property acquired by the City pursuant to a negotiated purchase of real property by the City pursuant to an agreement previously approved by the City Council, the City wishes to designate its Deputy City Clerk as having blanket authority to execute Certificates of Acceptance which are required by law in order to record a deed in favor of the City.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. With respect to property acquired by purchase pursuant to an agreement previously approved by the City Council, the Deputy City Clerk shall be and hereby is authorized to execute and record a Certificate of Acceptance of any such deed.
