REPORT TO CITY COUNCIL
SUBJECT:

Adopt Resolution 2023- XX authorizing the City Manager to accept the "Prop 64 PH&S Grant Program" and enter into the grant agreement and any amendments.

RECOMMENDATION:

Staff recommends council to adopt Resolution 2023- XX authorizing the City Manager to accept the "Prop 64 PH&S Grant Program" and enter into the grant agreement and any amendments.

EXECUTIVE SUMMARY:

The Board of State and Community Corrections (BSCC) released the Proposition 64 Public Health and Safety (Prop 64 PH&S) Grant Program Cohort 3, Request for Proposals (RFP). The Prop 64 PH&S Grant Program directs revenue from the cultivation and sale of cannabis to projects that promote public health and safety. Eligible applicants for the Prop 64 PH&S Grant Program are local governments (i.e., Counties, Cities, and City/County) in California that do not ban both indoor and outdoor commercial cannabis cultivation, or retail sale of cannabis or cannabis products. The RFP provides additional information concerning the definition of "ban cultivation" and "ban retail sale." This RFP makes available $150 million through a competitive process for projects that address local impacts due to the legalization of cannabis in California. Activities and strategies must fall within four Project Purpose Areas (PPAs): 1) Youth Development/Youth Prevention and Intervention; 2) Public Health; 3) Public Safety; and 4) Environmental Impacts.

The City of Parlier submitted an application that would address PPA 1 and PPA 3. The City of Parlier's project will include a full time Officer whose primary focus will be cannabis related include Youth Outreach, Cannabis Education, and Crime Prevention. Parks and Rec will have Youth Recreation Program to provide prosocial activities and resources to include sports and community events. The Officer will build relationships with youth through engagement in outdoor activities and leadership development working in partnership with the city's Parks Dept. The CA Health Collaborative will create opportunities for youth to engage in leadership and media program. To address the violence, we will organize a taskforce and develop a Strategic Plan on Violence Prevention and its correlation with cannabis. Our Cure Violence Collaborative service providers, to include Breaking the Chains, will provide services to youth to eliminate cannabis use and involvement, targeted interventions, victim services, and behavioral change plans.

The grant award is $2,980,000.

REPORT TO CITY COUNCIL
SUBJECT: Adoption of Resolution No. 2023 - authorizing the City Engineer to issue a notice to proceed on the City of Parlier's TCP Project
RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 2023- _ authorizing the City Engineer to issue a notice to proceed to Clark Bros Inc.

BACKGROUND: In August 23, 2022 the City went out to bid for our TCP Removal Treatment at Wells 2A, 4A, 8, and 9A. The lowest apparent bidder was Clark Bro's inc. with the total cost of $10,782,972.00. The State Water Resources Control Board, division of financial assistance has promised a total funding amount of close to $17 Million, which will fund the project in its entirety, including the separate purchases of GAC Filtration tanks, this cost is not included in Clark Bro's Bid. The City, has approximately $6 million dollars from a previous settlement which can be used to pay for some of these improvements. A meeting was held 5/3/23 with the State Water Resources Control Board to see if we could expedite their approval process, we were informed that they hope to have a finalized finance letter by the end of May 2023, but we are authorized to begin construction at risk in the meantime.

According to the Board's Estimated schedule, it is possible we would receive the finance letter by May 31,2023, it is estimated that the City would then receive reimbursement by August 2023.

The Board has informed us that these dates could change.

According to the contractor's attached draw schedule, we would have spent $4,027,500 by the time we receive our first reimbursement from the Board. If the reimbursement is delayed, it could mean we would have to suspend construction.

Although there are risks to begin construction, it may be risks the City would want to take to begin this much needed project.

FISCAL IMPACT: It is uncertain with so many variables what this would cost, it is assumed all expenses are to be paid by the State Water Resources Control Board, division of finance.
