INVOCATION:

ADDITIONS/DELETIONS:

Neal Costanzo City Attorney announced to the council that a notice of a Public hearing for the proposed refuse rate increase needs to be added to this agenda.

Neal notified the Council that there needs to be an addition to the agenda. The consultant that the city hired did not alert the city in time for the March 7t 2024 Agenda. This notice came to the city's attention after the agenda for March 7, 2024 at 6:30 p.m. was posted. There is a need for immediate action for this item. The rates for refuse increase affective today whether or not the agenda is posted. Lack of acknowledgment on the city's part and immediate action meets the requirement that this item needs to be on today's agenda. This needs to have a 4/5s vote but due to the fact that there is not a full council it requires a unanimous vote.

The mayor will open and close this Public Meeting and continue this item for the next meeting on March 21, 2024 at 6:30 p.m. At that time the consultant will give a presentation of the increase of refuse rates and will have a resolution. If there is no protest of 50% of the residents that have refuse service then the council will be allowed to increase the rate if there is then the council will not be able to increase the rates. So far there is no protest.

REPORT TO CITY COUNCIL
SUBJECT:

Requesting approval to proceed with BSCC-907-22 Board of State and Community Corrections, under the Proposition 64 Public Health & Safety Grant.

RECOMMENDATION:

City Council to authorize the finance department and the Acting City Manager to proceed with the implementation of the BSCC 907-22 grant. This authorization includes the review all relevant documentation associated with the grant and ensure that any pending paperwork is completed and submitted as well as continuation with grant reporting and compliance and the operational agreements with CBO partners to provide the services and host activities for the grant.

BACKGROUND:

Grant BSCC-907-22 is administered by the Board of State and Community Corrections (BSCC) under Proposition 64, which addresses public health and safety concerns.

Proposition 64, also known as the Adult Use of Marijuana Act, was passed by California voters in November 2016, legalizing recreational cannabis use for adults aged 21 and over.

The BSCC-907-22 grant likely pertains to funding allocated for specific programs or initiatives related to public safety and community corrections, with a focus on addressing the impacts of cannabis legalization. These initiatives may include law enforcement training, substance abuse prevention and treatment, criminal justice reforms, or community outreach programs.

Grants like BSCC-907-22 are typically awarded to local government agencies, nonprofit organizations, or community groups to support efforts aimed at mitigating the potential negative effects of cannabis legalization while promoting public health and safety. The grant funds may be used for various purposes outlined in the grant application, such as personnel salaries, equipment purchases, program development, or community education campaigns.

As with any grant, recipients are required to adhere to specific guidelines and reporting requirements outlined by the funding agency, in this case, the Board of State and Community Corrections. This ensures accountability and transparency in how the grant funds are used and the effectiveness of the programs or initiatives funded by the grant.

REPORT TO CITY COUNCIL
SUBJECT: Adoption of Resolution No. 2024 - _authorizing the City Engineer to construct a crosswalk at Parlier Ave and Smyrna Ave.

RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 2024-— authorizing the City Engineer to construct a crosswalk at Parlier Ave and Smyrna Ave.

BACKGROUND: The City received funding through the Sustainable Transportation Planning (STP) Grant Program for the Parlier Active Transportation Study - Tactical Urbanism to conduct a series of pilot studies in the community to gather data to prepare an improvement plan for pedestrian and bicycle facilities. The Advisory Committee for this project determined the intersection of Parlier Ave and Smyrna Ave as a priority and requested a traffic study to be conducted due to its proximity to John C Martinez Elementary School and the number of pedestrian-involved collisions and the severity of those collisions.

The City Engineer conducted the traffic study and noticed several pedestrians crossing at this intersection without a crosswalk to go to John C Martinez Elementary School. It is recommended for a crosswalk to be installed at this intersection. However, a ramp will need to be constructed on the north side of the crosswalk for ADA accessibility. The crosswalk striping and temporary bulb-outs may be implemented through the Parlier Active Transportation Study - Tactical Urbanism project.

FISCAL IMPACT: It is estimated $5,000 will be needed to construct the ramp, which may be funded through the Local Gas Tax.

REPORT TO CITY COUNCIL
SUBJECT:

City Council to Consider Approval of Conditional Use Permit (CUP) for Beer and Wine Sales at La Hacienda Mariscos y Sushi.

RECOMMENDATION:

Staff recommends that the City Council adopts Resolution No. 2024-XX, approving a CUP to allow alcohol sales at La Hacienda Mariscos y Sushi.

BACKGROUND:

Owner: Raymond L. & Mary C. Chun, Trustees
Applicant: Emilio Alvarado Jr.

Location: 13669 Manning Avenue, Suite 107; APN 358-390-29; southeast corner of Manning Avenue and S. Mendocino Avenue
Site Size: Location is one suite on a parcel of 7.53 acres General Plan: Neighborhood Commercial
Zoning: C-4, Central Trading District
Existing Use: Restaurant
Surrounding Uses: North - Vacant; C-5
East - Multi-family Residential; R-3
South - Agriculture; AE-20 (County)
West - Gas Station, Vacant; C-5
Street Access: E. Manning Avenue, S. Mendocino Avenue
PROPOSAL & DISCUSSION:

On November 13, 2023, the Community Development Department received an application from Emilio Alvarado Jr. of La Hacienda Mariscos y Sushi (applicant), requesting authorization for the sale of alcohol at the existing restaurant. The subject property is located within the C-4 zone district, where alcohol sales within restaurants are allowed subject to the approval of a CUP. As a result, the applicant has applied for a CUP in order to permit the sale of alcohol within La Hacienda Mariscos y Sushi.

The applicant has applied for a Type 41 (On-Sale Beer & Wine - Eating Place) license with the California Department of Alcoholic Beverage Control (ABC). Type 41 alcohol licenses allow for the sale of beer and wine at bona fide eating places (restaurants) for consumption on-site, or off the premises. Distilled spirits would not be allowed to be sold under this license type and minors would be allowed on the premises. Parlier Municipal Code Section 18.24.040 specifies that restaurants within in the C-4 district may serve alcohol with the approval of a CUP, further specifying that the license allowed under the CUP must be a Type 41 license. No other alcohol license types are permitted within the C-4 zone district.

While the applicant is the owner and operator of La Hacienda Mariscos y Sushi, the restaurant is one suite within a larger commercial development, which is owned separately. As CUPs, by their nature, run with the land, permission from the property owner is required as part of the application.

The property owners, Raymond L. & Mary C. Chun, Trustees, have given written permission to the applicant to serve alcohol on-site. The approval of the CUP would be tied specifically to Suite 107 of the overall commercial development. Should Suite 107 come under different operation at any point and operate in a manner which does not utilize the provisions granted under the CUP, the CUP shall expire and become void after one year of non-use.

As of March 4, 2024, and according to ABC, Census Tract 85.01 (where the project site is located) contains two active on-sale alcohol licenses. According to ABC, this census tract may contain three active on-sale alcohol licenses before becoming oversaturated. The approval of this CUP would result in a third on-sale alcohol license, meeting the limit. Findings for public convenience and necessity are therefore unnecessary for issuance of the requested license.

FINDINGS:

Prior to approving a CUP, the City Council must make findings as prescribed by Parlier Municipal Code Section 18.38.070:

The site for the proposed use is adequate in size and shape to accommodate the use and all yards, spaces, walls and fences, parking, loading, landscaping, and other features required to adjust the use with land and uses in the neighborhood.

The proposed use would occur within an existing restaurant. The site is part of a larger commercial complex under common ownership and has ample space for parking, circulation, loading, and other operational aspects. No physical improvements are proposed as a part of the project.

2. The site for the proposed use relates to streets and highways adequate in width and pavement type to carry the quantity and kind of traffic generated by the proposed use.

The site has access to Manning Avenue and S. Mendocino Avenue. Given that the proposal consists of an existing use, it is not anticipated that the allowance of the existing use to sell alcohol will generate an additional quantity or type of traffic that would substantially affect the City's circulation system.

The proposed use will have no adverse effect on abutting property or the permitted use thereof.

The City Council has imposed operational conditions that it deems sufficient to minimize or eliminate adverse effects to the surrounding neighborhood.

4. The conditions stated in the resolution are deemed necessary to protect the public health, safety, and general welfare.

All conditions of approval stem from the Parlier Municipal Code or are otherwise required in order to prevent undue effects of the operation from damaging the public health, safety, and welfare.

ENVIRONMENTAL:

The first step in complying with the California Environmental Quality Act (CEQA) is to determine whether the activity in question constitutes a "project" as defined by CEQA, Public Resources Code Section 21000, et seq. and the CEQA Guidelines, California Code of Regulations Section 15000, et seq. The second step is to determine whether the project is subject to or exempt from the statute. This proposal qualifies as a project under CEQA because it involves the issuance to a person of a "lease, permit, license, certificate, or other entitlement for use" as described in CEQA Guidelines Section 15378. However, the approval of the CUP would simply authorize an additional component to an existing use within an existing building with no physical modifications or alterations to that building. Accordingly, staff recommends that the City Council finds the project to be exempt from CEQA under CEQA Guidelines Section 15301, Existing Facilities. If the project is approved, a Notice of Exemption for the project will be filed with the County Clerk and the State Clearinghouse approval.

FISCAL IMPACT:

Costs for processes initiated by applicants are paid for through application fees. There is no impact to the General Fund or other City funds.

REPORT TO THE CITY COUNCIL
SUBJECT:

Refuse Rate Setting
RECOMMENDATION:

Staff recommends that the City Council approve revised refuse rates to be effective April 1, 2024.

A proposed resolution is attached.

BACKGROUND:

A rate study, dated December 20, 2023 (attached), was conducted by Dan Bergmann of IGService. The rate study reviews revenue and expenses for the refuse enterprise fund, and also reviews specific rates charged to customers to assure they are consistent with the cost of providing services.

Initially, on December 7, 2023, Mr. Bergmann presented to the City Council proposed rate increases for both refuse and sewer. However, based on directions from the City Council at that time, the proposed increases shall be limited to refuse only. Accordingly, refuse-only rate increase notices were sent out to all refuse customers in early January (attached).

The refuse increases reset rates in the first year to align with the revised fee schedule of Mid- Valley, while also providing adequate revenue for City overhead costs, such as the cost of billing and customer services. Following the first year, beginning July 1, 2025, refuse rates will be reset based on the Consumer Price Index used in the Mid-Valley contract with the City. Detailed explanations for the rate setting methodology can be found in the rate study.

FISCAL IMPACT:

Revenue is increased for the refuse fund such that it can recover a slight present negative balance. The projected increase for FY24/25 is $96,000 over FY23/24, based on an eight percent increase overall effective April 1, 2024. Increased revenue from rates for the refuse enterprise fund relieves the pressure on the general fund needed for other city services.

Refuse Rate Study for City of Parlier

1 Refuse Rate Study for City of Parlier
Purpose
The purpose of this cost-of-service refuse study is to review and modify the existing refuse rate tructure such that customers pay rates in proportion to the cost to provide specific services. A part of this study, overall operating costs and revenue have been analyzed to evaluat reasonableness of costs, and the need to increase overall revenue. These steps are conducted to Contracted Refuse Service
Refuse services in Parlier are provided by a private company, Mid-Valley Disposal, Inc.

Effective March 1, 2022, the agreement with Mid-Valley was amended to include more recent legal and waste hauling requirements, associated with Senate Bill 1383. Beyond Mid-Valley's increases associated with the additional costs of SB 1383, the agreement with Mid-Valley allows for an annual cost increase linked to a Consumer Price Index (CPI).

Parlier's role for the refuse enterprise is billing, payment collection, and limited customer services. Parlier's personnel coordinate closely with Mid-Valley regarding new services and changes in services. Mid-Valley is paid once per month by Parlier based on the number of services in place the previous month and the fee schedule in the contract, which is different than the rates charged to customers by Parlier. The differences between Parlier's rates and fees paid Mid-Valley covers a portion of Parlier's billing, customer services, and general overhead.

Existing Rate Structure
The last rate study was completed in April 2018, setting rates for five years with the last annual adjustment July 1, 2022. However, because of the negotiations with Mid-Valley early in 2022 related to increased costs associated with SB 1383, the July 2022 increase was forgone and instead, on October 1, 2022, City staff increased rates approximately ten percent to compensate for Mid-Valley's increase. For each existing rate, the margins between the fees paid to Mid- Valley by the City and the rates charged to customers by the City vary. This is corrected in the proposed rate structure such that the City's margin is the same for each rate offered.

Existing and proposed rates can be seen in Attachment 1.

Historical and Projected Expense and Revenue
Over 80 percent of expenses for the refuse enterprise is Mid-Valley Disposal, as the City's contracted service provider. The remaining expenses are a portion of the City's cost for billing, customer service and general overhead. For FY24/25, personnel costs are projected at $173,100, supplies and materials at $61,500, and bad debt expense (unpaid bills) at three percent of revenue, or $51,700.
2 Increasing existing overall revenue by eight percent for FY24/25 provides a slight net positive income for the year, also correcting for slight net losses in the previous years. For subsequent years, an inflationary increase is shown at four percent per year in the revenue and expense table; however, the actual increase will be based on the CPI utilized in the Mid-Valley agreement with the City. The cash balance in the refuse enterprise is projected to become less negative over the five-year planning period, moving toward a zero balance. The refuse enterprise does not need reserve funds because all equipment used to provide services belongs to Mid-Valley.

In the first planning year of FY24/25, the Mid-Valley CPI is estimated at four percent. (This was checked with Mid-Valley as a good estimate.) Accordingly, the initial rate increases yielding an overall eight percent increase in revenue are planned to carry through 2024, such that there will be no CPI increase July 1, 2024, and the first CPI increase will then be applied to customers effective July 1, 2025. This is specified at the bottom of the proposed rate table.

Historical and projected revenues and expenses are shown in Attachment 2.

Rate Design
The proposed customer rates are made to be directly proportional to the fees charged by Mid- Valley. Each of Mid-Valley's specific fees has been increased by approximately 26 percent to cover overhead costs and unpaid bills discussed above.

The changes to existing rates in the first year vary widely. The large variations are caused by the changes needed in customer rates to realign with the fees charged by Mid-Valley. This is necessary to comply with the requirements of Proposition 218, such that the services provided are in proportion to the rates charged. The largest group impacted are single-family homes with an initial increase of 17.5 percent. Single-family rates move from $26.26 to $30.86 in the first year for an increase of $4.60 per month. A residential rate comparison is shown in the bar chart on the next page.

Not all rates increase. For example, the commercial rate for a three-yard bin with three pickups per week decreases seven percent, from $359.21 to $332.27.

The rate model is shown in Attachment 3. The left columns show the present billing data to contirm the existing system count of containers in the field combined with existing rates yield the existing revenue that is being billed. The Mid-Valley section shows the corresponding existing fees paid to Mid-Valley to yield the total paid to Mid-Valley each month, including the

5.6 percent CPI increase effective July 1, 2023. Each new rate was determined by manually adjusting the values in "Rate Change Needed to Achieve Even Margin." Specifically, each rate was adjusted to achieve a 26 percent increase (or close to 26 percent) increase above the Mid- Valley rates shown in the Mid-Valley section.

Conclusion
The work of this rate study results in major changes to Parlier's refuse rates. Proposed rates are provided that are proportional to the new fees provided by Mid-Valley, including rates for recycling and organics. The resultant rates are compliant with the requirements of Proposition 218 regarding cost-of-service rate setting methodology. 4 ATTACHMENT 1: Present and Proposed Rates

CITY OF PARLIER

NOTICE OF PUBLIC HEARING FOR PROPOSED INCREASED REFUSE RATES To inform ratepayers and to comply with California Proposition 218, (California Constitution Article XIIID, Section 6), the City of Parlier gives the following notice:

HEARING DATE: Thursday, March 7, 2024, at or after 6:30 p.m.

HEARING LOCATION: City of Parlier City Council Chambers, 1100 East Parlier Avenue, Parlier, CA, 93648.

PLEASE TAKE NOTICE THAT on March 7. 2024, at or after 6:30 p.m., the Parlier City Council will hold a public hearing to consider proposed modification and increases to refuse charges for services furnished by the City, and to hear and consider objections and protests to the proposed refuse rate modifications and the Report described below.

LOCATION OF REPORT: A report by IGService, dated December 20, 2023, describing details of the refuse rate modifications and increases and the method used to calculate the rate modifications and increases (the "Report") has been prepared, and the contents of the report submitted to the Council. The Report is on file at Parlier City Hall, 1100 East Parlier Avenue, and can also be found on the City of Parlier website. A copy of the Report can also be reviewed or obtained upon request. The proposed refuse rates were presented and discussed during the Parlier City Council meeting held on December 7, 2023.

AMOUNT OF PROPOSED RATE MODIFICATIONS FOR YOU: The amounts of refuse rates (present and proposed) are included as Exhibit "A".

REASON FOR THE PROPOSED MODIFICATION OF REFUSE RATES: The proposed modification of Parlier's refuse rates is to make the rate structure consistent with the cost of services provided. The increases are primarily to cover contracted costs for services provided by Mid-Valley Disposal associated with new organics-handling requirements. The revenue from the modified rates and charges will not be more than the funds required for the City to provide adequate refuse service to you and other City customers.

BASIS FOR PROPOSED MODIFICATIONS OF REFUSE RATES: A description of how the modifications were calculated can be found in the Report on file at Parlier City Hall and on the City of Parlier website. A copy of the Report can also be reviewed or obtained upon request.

PROCEDURE FOR HEARING AND DETERMINING MAJORITY PROTEST: At the time stated above, the Council will hear and consider all objections and protests, if any, to the proposed refuse rate modifications and other matters described in the Report. The Council may continue the hearing from time to time. Prior to the close of the hearing, if written protests against the proposed modified refuse rates are presented and not withdrawn by a majority of the record owners of the parcels that would be subject to the modified refuse rates, the City may not impose the modified refuse rates; instead, refuse rates would continue at their existing amounts. If, at the close of the protest hearing, there is no majority protest as described above, the Council may approve the refuse rate modifications, as proposed or as changed by the Council, to be effective commencing April 1, 2024.

PRESERVING THE RIGHT TO CHALLENGE: Any person who wants to preserve the opportunity to file a lawsuit challenging the proposed refuse rate modifications, if imposed, or other matters described in the Report must file a written protest with the Council, stating the specific grounds of the protest. Any grounds not stated in a written protest filed with the Council before the close of the protest hearing on March 7, 2024, will be deemed waived and may not be raised in any subsequent lawsuit.

HOW TO PROTEST THE PROPOSED RATE INCREASES: All owners and tenants of property receiving refuse service, and interested persons are invited to attend the Public Hearing noticed above. Written protests must be received (not postmarked) by the City Clerk before or during the public hearing. Council will not count written protests submitted after the conclusion of the public hearing. Any protest submitted by e-mail or other electronic means will not be accepted. The protest must be signed by the property owner(s) or tenants) and must include the assessor's parcel number(s) or street addresses) of all property(les) serviced, and your statement that you protest the increase in the refuse rates. Only one written protest per identified parcel or property will be counted for purposes of determining whether there is a majority protest.

ADDITIONAL INFORMATION: For additional information and answers to questions about the proposed refuse rate proceeding, contact Bertha Escalera, Assistant City Manager, (559) 646-3545 x 2279, or [email protected].
