REPORT TO THE CITY COUNCIL
SUBJECT:

Consideration and Necessary Action on Resolution Calling and Giving Notice of General Municipal Election on November 5, 2024, Requesting the County Consolidate and Canvass the General Municipal Election with the State-wide General Election and Requesting the Registrar of Voters to Render Services to the City Relating to the Conduct of the Municipal Election and Authorizing Reimbursement Funds to Pay for Those Services.

RECOMMENDATION:

Staff recommends Council adopt the Resolution calling the Election and consolidating it with the General State-wide Election and authorizing payment for services to be rendered by the Registrar of Voters in connection with the General Municipal Election DISCUSSION:

The next State-wide General Election is November 5, 2024. The terms of two members of the City Council, representing Districts 1 and 3 will expire following the November 5, 2024, Election and certification of the results by the Registrar of Voters. The proposed resolution is one adopted by the City Council every two years prior to general state-wide elections that occur every two years in November.

Elections Code §10400 allows the Board of Supervisors to consolidate the Municipal Election with the General State-wide Election which is always set for the same date. It is necessary to consolidate the Municipal Election with the State-wide Election because the City does not have the capacity to tally, canvas and certify the results of a vote of the people which is a function assigned by statute to the County Registrar of Voters.

Statute requires the City to pay for the services of the Registrar of Voters in connection with the conduct of the Consolidated State-wide Election. The Resolution is one required by the Elections Code and solicited by the Registrar of Voters every two years.

Adoption of this particular resolution is mandated by law as failure to adopt the resolution would mean that the open positions on the City Council would not be filled and would become vacant.

RECOMMENDATION:

Staff recommends Council adopt the Resolution calling the Election and consolidating it with the General State-wide Election and authorizing payment for services to be rendered by the Registrar of Voters in connection with the General Municipal Election.

RECOMMENDATION:

City Council adopt resolution Initiating Proceedings for the Annual Levy of Assessments for Landscape Maintenance and Lighting District No. 1 and authorize the City Engineer to file his annual report.

DISCUSSION:

This is the first of three actions by Council required by State law for the levy of the annual assessments. The City Engineer will prepare a report that will be submitted to the Council for review and approval. The next action required by Council will be the approval of the Resolution of Intention to Levy and Collect the Annual Assessments, which will set the date for the public hearing required prior to the confirmation of assessments. The final step in the process is for Council to conduct the required public hearing, receive any testimony, and confirm the annual assessments. The assessment roll is then submitted to the County Assessor for inclusion on the property owner's tax bill. There were annexations this past year.

PROPOSAL & DISCUSSION:

SITE PLAN
According to Parlier Municipal Code (PMC) Section 18.40.010, the City Council shall consider SPR's in the absence of a sitting Planning Commission. The applicant has submitted an application for a SPR that proposes the construction of a 56-unit apartment complex on APNs 355-412-02S and -03S. The 56 units would be split into seven building, including eight units each.

Each building would be two stories in height, and would have a building footprint of 4,020 square feet (sq ft). Each building would be 8,040 sq ft in total size. The units provided would be 1,005 sqft in size and would include two bedrooms and one bathroom. Staff have analyzed the project against the R-3 zone district (Medium Density Multiple Family Residential) development standards and found that the project meets all objective standards, with the exception of setbacks for accessory structures and fence height. The reasoning for use of R-3 standards and a discussion about the allowance for different accessory structure setbacks and fence height from what is normally allowed are discussed below.

GENERAL PLAN CONFORMITY
In response to California's Housing Crisis, the Legislature has declared that a local agency shall not disapprove a housing development project for very low, low-, or moderate-income households, or condition approval in a manner that renders the housing development project infeasible for development for the use of very low, low-, or moderate-income households, including through the use of design review standards, unless it makes written findings, based upon a preponderance of the evidence in the record, as to one of the following:
a) The jurisdiction has adopted a housing element pursuant to this article that has been revised in accordance with Government Code Section 65588, is in substantial compliance with this article, and the jurisdiction has met or exceeded its share of the regional housing need allocation pursuant to Government Code Section 65584 for the planning period for the income category proposed for the housing development project, provided that any disapproval or conditional approval shall not be based on any of the reasons prohibited by Government Code Section 65008. If the housing development project includes a mix of income categories, and the jurisdiction has not met or exceeded its share of the regional housing need for one or more of those categories, then this paragraph shall not be used to disapprove or conditionally approve the housing development project. The share of the regional housing need met by the jurisdiction shall be calculated consistently with the forms and definitions that may be adopted by the Department of Housing and Community Development pursuant to Government Code Section 65400. In the case of an emergency shelter, the jurisdiction shall have met or exceeded the need for emergency shelter, as identified pursuant to paragraph (7) of subdivision (a) of Section 65583. Any disapproval or conditional approval pursuant to this paragraph shall be in accordance with applicable law, rule, or standards.
b) The housing development project or emergency shelter as proposed would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact without rendering the development unaffordable to low- and moderate-income households or rendering the development of the emergency shelter financially infeasible. As used in this paragraph, a "specific, adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete. The following shall not constitute a specific, adverse impact upon the public health or safety:
i. Inconsistency with the zoning ordinance or general plan land use designation. ii. The eligibility to claim a welfare exemption under subdivision (g) of Section 214 of the Revenue and Taxation Code.
c) The denial of the housing development project or imposition of conditions is required in orderto comply with specific state or federal law, and there is no feasible method to comply without rendering the development unaffordable to low- and moderate-income households or rendering the development of the emergency shelter financially infeasible. d) The housing development project or emergency shelter is proposed on land zoned for agriculture or resource preservation that is surrounded on at least two sides by land being used for agricultural or resource preservation purposes, or which does not have adequate water or wastewater facilities to serve the project.
e) The housing development project or emergency shelter is inconsistent with both the jurisdiction's zoning ordinance and general plan land use designation as specified in any element of the general plan as it existed on the date the application was deemed complete, and the jurisdiction has adopted a revised housing element in accordance with Government Code Section 65588 that is in substantial compliance with this article. For purposes of this section, a change to the zoning ordinance or general plan land use designation subsequent to the date the application was deemed complete shall not constitute a valid basis to disapprove or condition approval of the housing development project or emergency shelter.
i. This paragraph cannot be utilized to disapprove or conditionally approve a housing development project if the housing development project is proposed on a site that is identified as suitable or available for very low, low-, or moderate-income households in the jurisdiction's housing element, and consistent with the density specified in the housing element, even though it is inconsistent with both the jurisdiction's zoning ordinance and general plan land use designation. li. If the local agency has failed to identify in the inventory of land in its housing element sites that can be developed for housing within the planning period and are sufficient to provide for the jurisdiction's share of the regional housing need for all income evels pursuant to Government Code Section 65584, then this paragraph shall not be utilized to disapprove or conditionally approve a housing development project proposed for a site designated in any element of the general plan for residential uses or designated in any element of the general plan for commercial uses if residential uses are permitted or conditionally permitted within commercial designations. In any action in court, the burden of proof shall be on the local agency to show that its housing element does identify adequate sites with appropriate zoning and development standards and with services and facilities to accommodate the local agency's share of the regional housing need for the very low, low-, and moderate-income categories.
ili. If the local agency has failed to identify a zone or zones where emergency shelters are allowed as a permitted use without a conditional use or other discretionary permit, has failed to demonstrate that the identified zone or zones include sufficient capacity to accommodate the need for emergency shelter identified in paragraph (7) of subdivision (a) of Section Government Code 65583, or has failed to demonstrate that the identified zone or zones can accommodate at least one emergency shelter, as required by paragraph (4) of subdivision (a) of Government Code Section 65583, then fhis paragraph shall not be utilized to disapprove or conditionally approve an emergency shelter proposed for a site designated in any element of the general plan for industrial, commercial, or multifamily residential uses. In any action in court, the burden of proof shall be on the local agency to show that its housing element does satisfy the requirements of paragraph (4) of subdivision (a) of Government Code Section 65583.

The City does not have a currently adopted Housing Element for the region's current housing cycle and is out of compliance with State requirements as a result. Despite the project site being planned for Neighborhood commercial land uses and zoned C-5 (General Commercial), which does not permit housing of any kind, a proposed affordable housing development is required to be approved on the site so long as the housing development project would not have a specific, adverse impact upon the public health or safety unless disapproved or that there is no feasible method to satisfactorily mitigate or avoid adverse significant impacts of the proposed housing development project. The project, as a multi-family housing development has been analyzed against the R-3 zone district development standards as these are the most applicable standards for such projects and provides the highest allowable density within the City.

As discussed above, a "specific, adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete (Gov.

Code § 65589.5, subd. (d)(2)). Staff found no evidence of any significant, quantifiable, direct, and/or unavoidable impacts based on objective, identified written public health or safety standards, policies, or conditions as they existed on the date this application was deemed complete.

DENSITY BONUS
The applicant has requested a density bonus pursuant to Government Code Section 65915.

Under a density bonus the applicant is provided the opportunity to request incentives or concessions, allowing the project to deviate from required development standards, so long as the project provides a certain level of affordability. The Parlier Apartments project has requested a deviation from the setback requirements for accessory structures. As proposed, the project would construct carports set back 10 feet from the front yard property line, while PMC Section 18.18.110 requires that accessory structures be set back from the front yard property line a minimum of 15 feet. Additionally, the project has requested a deviation from the fencing height requirements of the R-3 zone district. Pursuant to MC Section 18.18.140, fencing in the R-3 district may be three feet in height in the front yard area, or four feet in height if the fencing conforms to City standard drawings. The project proposes wrought iron fencing in the front yard area that would be six feet in height.

An applicant for a density bonus pursuant to Government Code Section 65915(b) may submit to a city, county, or city and county a proposal for the specific incentives or concessions that the applicant requests pursuant to this section, and may request a meeting with the city, county, or city and county. The city, county, or city and county shall grant the concession or incentive requested by the applicant unless the city, county, or city and county makes a written finding, based upon substantial evidence, of any of the following:
a) The concession or incentive does not result in identifiable and actual cost reductions, consistent with subdivision (k), to provide for affordable housing costs, as defined in Section 50052.5 of the Health and Safety Code, or for rents for the targeted units to be set as specified in Government Code Section 65915(c).
b) The concession or incentive would have a specific, adverse impact, as defined in paragraph (2) of subdivision (d) of Government Code Section 65589.5, upon public health and safety or on any real property that is listed in the California Register of Historical Resources and for which there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact without rendering the development unaffordable to low-income and moderate-income households.
c) The concession or incentive would be contrary to state or federal law.

Staff have reviewed the request and have found that no finding can be made to disapprove the granting of an incentive or concession for the project.

Pursuant to Government Code Section 65915(d)(2)(B), the applicant is entitled to two incentives or concessions for projects that include at least 17 percent of the total units for lower income households, at least 10 percent for very low income households, or at least 20 percent for persons and families of moderate income in a development in which the units are for sale. The project would provide the adequate number of units to meet this requirement and receive the requested incentives. The required front yard setback for accessory structures has been reduced to 10 feet and the maximum fence height in the front yard area would be six feet as a result.

PARKING
Pursuant to PMC Section 18.18.150, the project is required to provide one covered parking space and one-half open parking space per unit. With 56 total units proposed, the project would thereby be required to provide 56 covered parking spaces and 28 open spaces. The submitted site plan proposes 129 total parking spaces, 75 of which are covered, 11 of which are designated for visitor use, and 6 of which would be handicap accessible.

LANDSCAPING
The applicant has submitted a conceptual landscape plan for the project. Landscape plans will be reviewed to ensure compliance with State water efficient landscaping requirements. Review and approval of the submitted landscape plan and related irrigation plans are required prior to building permit issuance.

ELEVATIONS
The construction of the buildings approved under the SPR is conditioned to conform with the elevations submitted and approved by the City Council. The project would result in the construction of seven total building, to a height of 26'1", which is less than the maximum allowed height of 40 feet in the R-3 zone district.

PUBLIC INFRASTRUCTURE
The project will be conditioned to make improvements to public infrastructure to ensure that public health, safety, and general welfare is maintained for residents of the project and residents in the surrounding neighborhood. Pursuant to Senate Bill 1383, the project is required to provide adequate capacity for the disposal of solid waste, recyclables, and organics. The trash enclosures on-site must provide bins/carts for each.

According to CalRecycle's 2014 Characterization of Commercial Sector Disposal and Diversion in California, multi-family development projects are anticipated to produce 0.30 cubic yards of solid waste a week. At 56 units, the project would produce approximately 16.69 cubic yards of solid waste a week. The project will be conditioned to provide adequate disposal facilities to meet expected demands.

The proper i also tage diren tore an are in are and ser guerio we bel subject City requirements. Adequate site drainage will be required to be shown on project improvement plans.

PUBLIC NOTICE
Applications for a SPR do not necessitate public notice prior to decision on the application.

FINDINGS:

Prior to approving a SPR, the City Council must make findings as prescribed by Parlier Municipal Code Section 18.40.040:

All provisions of Title 18 of the Parlier Municipal Code have been complied with.

The project has been reviewed for compliance with Title 18 of the Parlier Municipal Code. Subject to conditions placed on the project, the project will comply with all applicable provisions of the Parlier Municipal Code.

The following are so arranged that traffic congestion is avoided and pedestrian and vehicular safety and welfare are protected, and there will be no adverse effect on surrounding property:
a. Facilities and improvements.

The project has been conditioned to construct facilities and improvements to City and State standards and regulations. Construction of the project in conformance with local and State regulations would ensure that significant adverse effects do not occur to the surrounding properties.
b. Vehicular ingress, egress and internal circulation.

The project proposes two driveways along E. Parlier Avenue. The proposed driveways, along with internal drive aisles are required to meet City standards, ensuring that adverse effects do not occur. The project meets such requirements, as proposed.
c. Setbacks.

The project would comply with all applicable setback requirements. The project has been granted a deviation from required setbacks for accessory structures under the State's Density Bonus Law. All other setbacks conform to the R-3 zone district standards.
d. Height of buildings.

The project proposes seven buildings of 26'1" in height. Building height is allowed up to 40 feet in the R-3 zone district. The project would not conflict with applicable height requirements as a result.
e. Location of service.

The project is located along E. Parlier Avenue where connection to all necessary public services and utilities are readily available.
f. Walls.

Within the R-3 zone district, fences are allowed to a maximum of four feet in the front yard (if meeting City standards) and six feet in the side and rear vards. The project proposes six foot fencing within the front yard area. An existing six foot block wall exists on the southern and western property line, while a six foot chain link, slatted fence exists on the eastern property line. The project has been aranted a deviation from the required fence height in the front yard area under the State's Density Bonus Law. The maximum fence height in the front yard area will be six feet.
g. Landscaping.

The project submitted a conceptual landscape plan with the SPR application. The City Engineer shall review and approve the landscape plan prior to building permit issuance. This will ensure no adverse effects occur.

3. Proposed lighting is so arranged as to reflect the light away from adjoining properties.

On-site lighting is required to be submitted for review and approval by the City Engineer. City review of the project's lighting plan will ensure that the project does not create an adverse effect on adjoining properties.

Proposed signs will not by size, location, color or lighting interfere with traffic or limit visibility.

Any signs for the project would be required to be approved under a separate sign permit. Any potential sign applications would be subject to the provisions of the Parlier Municipal Code which protects the public and traffic from signage that interferes with vision.

ENVIRONMENTAL:

The first step in complying with the California Environmental Quality Act (CEQA) is to determine whether the activity in question constitutes a "project" as defined by CEQA, Public Resources Code Section 21000, et seq. and the CEQA Guidelines, California Code of Regulations Section 15000, et seq. The second step is to determine whether the project is subject to or exempt from the statute. This proposal qualifies as a project under CEQA because it involves the issuance to a person of a "lease, permit, license, certificate, or other entitlement for use" as described in CEQA Guidelines Section 15378. However, the project would be eligible for the use of a categorical exemption from CEQA under CEQA Guidelines Section 15332 - In-fill Development Projects. The project qualifies for this exemption because it would occur within the City on a site of less than five acres, the site is void of any natural features that could contain special status • species or their habitat, significant impacts to traffic, noise, air quality, or water quality would not occur, the site could be properly served by all public services and utilities, and the project is consistent with all applicable General Plan and zoning requirements and designations. While the site is planned Neighborhood Commercial and zoned C-5, the applicable General plan designations for the project is High Density Residential and the applicable zoning designation is R-3. This is as a result of the type of project proposed and its processing under the Housing Accountability Act. Accordingly, staff recommend that the City Council finds the project to be exempt from CEQA under CEQA Guidelines Section 15332. If the project is approved, a Notice of Exemption for the project will be filed with the County Clerk and the State Clearinghouse approval.

FISCAL IMPACT:

Costs for processes initiated by applicants are paid for through application fees. There is no impact to the General Fund or other City funds.
