REPORT TO CITY COUNCIL
SUBJECT:

City Council to Consider Adoption of Ordinance No. 2024-01, amending Title 18 of the Parlier Municipal Code regarding accessory buildings and related approval processes.

RECOMMENDATION:

Staff recommends that the City Council waives the second reading of and adopts Ordinance No. 2024-01, amending Title 18 of the Parlier Municipal Code (MC) to revise language relating to accessory buildings in residential zone districts and lot coverage and creating the zone clearance process.

BACKGROUND:

On September 5, 2024, the City Council adopted Resolution No. 2024-56, directing staff to investigate amendments related to accessory buildings in residential zone districts. Specifically, there were concerns related to number, square-footage, and height allowed for accessory buildings. At a public hearing during the regularly scheduled City Council meeting on October 3, 2024, Ordinance No. 2024-01, containing the changes noted above, was introduced and its first reading waived by a vote of 5-0.

PROPOSAL & DISCUSSION:

Ordinance No. 2024-01 would establish Chapters 18.35 and 18.45 of the Parlier Municipal Code.

Chapter 18.35 would create three categories of permissible accessory buildings:

1. Site Plan Review
a. Buildings of 600 square feet to 1,200 square feet
b. Buildings with a plate height greater than 12 feet or an overall height greater than 16 feet

2. Zone Clearance (new form of Director approval; see below) a. Buildings greater than 120 square feet but less than 600 square feet b. Buildings with a plate height up to 12 feet or an overall height up to 16 feet

3. Exempt
a. Buildings up to 120 square feet
b. Play structures, outdoor fireplaces, and similar structures as determined by the Director
Building permits still may be necessary for accessory buildings in any of the three categories.

Minor revisions related to covered patios are included to prevent establishing conflicting provisions. Chapter 18.35 would also contain development standards specific to accessory buildings, including location on the lot, setback requirements, architectural compatibility (for buildings greater than 120 square feet), and access. As mentioned at the September 5 and October 3 meetings, accessory dwelling units (ADUs) and junior accessory dwelling units (JADUs) are regulated separately and are not subject to the standards in proposed Chapter 18.35.

Chapter 18.45 would create the Zone Clearance, a new, streamlined review procedure for minor processes. Its purpose is to ensure that non-planning processes, including building permits, business licenses, grading permits, and other approvals do not conflict with zoning requirements.

There is no application or additional fee for a Zone Clearance. Chapters 18.35 and 18.45, along with the other proposed text changes, are contained within the attached ordinance. Ordinances take effect 30 days following adoption.

ENVIRONMENTAL:

This proposal qualifies as a project under CEQA because it includes amendment of a zoning ordinance as detailed in CEQA Guidelines Section 15378(a)(1). However, the proposed ordinance amendment does not approve or otherwise authorize any specific activity that could result in a physical change to the environment; it is solely an amendment to regulations. Further, any physical changes resulting from implementation of the revised language would themselves be subject to only ministerial approvals, therefore being exempt from CEQA. In cases where it can be shown with certainty that the project being considered has no possibility of causing a significant impact to the environment, the project is not subject to CEQA as indicated in Guidelines Section 15061(b)(3).

FISCAL IMPACT:

Minor impact to the General Fund in the form of staff costs for research, report preparation, and meeting attendance. Potential minor increase in building permit fees received.

STAFF REPORT
TO: THE SUCCESSOR AGENCY TO THE PARLIER REDEVELOPMENT AGENCY FROM: David Cerda, Acting City Manager
DATE: December 5th, 2024
SUBJECT: RECOGNIZED OBLIGATION PAYMENT SCHEDULE 25-26 FOR THE JULY 2025 THROUGH JUNE 2026 PERIOD AND

SUCCESSOR AGENCY ADMINISTRATIVE BUDGET FOR
FISCAL YEAR 2025-26

BACKGROUND
HSC Section 34177(I) requires the Successor Agency to prepare a ROPS showing all the obligations of the former Redevelopment Agency and the sources of funds for repaying obligations. This ROPS covers the period July 1, 2025 through June 30, 2026 ("25-26 period"), and must be approved by the Oversight Board then sent to the California State Department of Finance ("DOF") and the County Auditor-Controller no later than February 1, 2025. The Successor Agency may face a fine of $10,000 per day for ROPS submitted after this deadline. The Successor Agency will be submitting the ROPS 25-26 to the Fresno County-wide Oversight Board for their review and approval at their meeting on January 23d, 2025. Distribution of redevelopment The City of Parlier serves as the Successor Agency of the former Parlier Redevelopment Agency.

As Successor Agency, the City is responsible for all assets, properties, contracts, leases, obligations, and records of the former Parlier Redevelopment Agency. For the Successor Agency to continue paying obligations duly received from the former Redevelopment Agency, the Dissolution Act requires the Successor Agency to prepare an annual Recognized Payment Obligation Schedule ("ROPS") setting forth the Successor Agency's payment obligations for two six-month periods.

Due to the Department of Finance annually by February 1, the ROPS shall include any bonds, loans, payments required by the federal government, contracts, costs associated with Disposition and Development Agreements, and other similar obligations to third parties.

ANALYSIS
Staff Report

Page 2 of 2 ends

Recognized Obligation Payment Schedule
The five items on the ROPS 25-26 are the same five obligations as those included on ROPS 24-

25. For ROPS 24-25, the Successor Agency is requesting a total of $995,245 in Redevelopment Property Tax Trust Fund money to fund ROPS obligations, $527,376 for the first half of the fiscal year and $467,869 for the second half of the fiscal year. The obligations listed on the ROPS • Fiscal Agent Fees
• 2015 Tax Allocation Refunding Bonds
• 2015 TARB Continuing Disclosure
• Successor Agency Administrative Budget of $151,000
Once approved by the Successor Agency, the ROPS 25-26 and the accompanying administrative budget would be considered by the Fresno Countywide Oversight Board.

Dissolution activities are expected to continue as long as the Successor Agency pays debt service on the 2015 Tax Allocation Refunding Bonds, which are retired on August 1, 2033 (during the ROPS 2033-34 A period).

Administrative Budget
The Dissolution Act allows successor agencies to collect an administrative allowance to recover costs for administration of successor agency duties performed by the local agency, subject to a cap of $250,000 or 3 percent of enforceable obligations, whichever is greater. For fiscal year 2025-26, the Successor Agency is requesting an administrative budget of a little over half of the allowable limit ($151,000), which is comparable to the amount received and expected to be used in the current year.

RECOMMENDATION:

Staff recommends that the Agency:
