RECOMMENDATION: Staff recommends approval Resolution No. ## to designate and authorize the Public Works Director to submit a grant application for the Rubberized Pavement Grant Program.

BACKGROUND: The Department of Resources Recycling and Recovery (CaRecycle) offers the Rubberized Pavement Grant Program to promote markets for Rubberized Asphalt Concrete (RAC) products with crumb rubber derived from only California- generated waste tires. The program is designed to encourage first-time or limited users of rubberized pavement in two project types: Hot-Mix Asphalt and Rubberized Chip Seal.

The City of Parlier intends to utilize rubberized hot-mix asphalt concrete for the rehabilitation project that will consist of milling the existing pavement surface to pave a new top surface layer along Mendocino Avenue from Progress Drive to the southern city limits. Proposed construction dates are from 05/2026 to 11/2026. This project is estimated to utilize approximately 2,111 tons of hot-mix rubberized asphalt concrete.

To improve efficiency in these circumstances, the State of California Department of General Services (DGS) has developed a Master Service Agreement with U.S. Bank for the issuance of government purchasing cards (CAL-Card). This program provides State and local agencies with a secure and regulated method for making authorized small- dollar purchases.

The CAL-Card is a VISA purchasing card specifically designed for government use, offering greater acceptance among suppliers, improved timeliness of procurement, and reduced administrative costs. The program helps streamline small purchases while maintaining strict accountability and compliance with procurement regulations.

DISCUSSION:

The proposed City of Parlier Credit Card Use Policy and Procedures CAL-Card establishes clear and consistent guidelines for the issuance, management, and appropriate use of city-issued CAL-Cards.

Key provisions include:
• Limited Issuance
Cards may be issued only to the City Manager, Assistant City Manager, Finance Director, and City Department Directors as authorized by the City Manager. Additional cards to city staff shall not be issued unless otherwise approved by the City Manager and Department Director.
• Authorization and Oversight
• The City Manager or designee authorizes card issuance, credit limits, and changes. The Finance Division administers the program, ensuring all uses comply with IRS and city policy requirements and the State of California, Department of General Services.
• Restricted Use
• The CAL-Card is strictly for official city business and may not be used for personal purchases.
• Transaction Limits
• The standard spending limit is $2,500 per transaction, unless otherwise approved by the City Manager.
• Prohibited and Restricted Purchases
• The policy lists categories of purchases that are prohibited (e.g., alcohol, gifts, entertainment, professional services, or political contributions) and restricted (e.g., subscriptions, IT equipment, food for meetings). • Accountability
Cardholders must maintain receipts, reconcile monthly statements, and submit documentation to the Finance Department within three business days of the receipt of the statement.

Security and Safeguarding
, Cards must be stored securely within city facilities and may only be removed for official travel or authorized business.
• Policy Violations
Misuse or noncompliance may result in disciplinary action, up to and including termination and/or criminal prosecution.

These procedures strengthen fiscal accountability, ensure compliance with procurement best practices, and reduce administrative processing costs for small purchases.

FISCAL IMPACT:

There is no direct fiscal impact associated with adopting the CAL-Card Policy.

STAFF RECOMMENDATION:

Adopting the City of Parlier CAL-Card Policy and Procedures will ensure the city has a standardized, transparent, and efficient method to manage small-dollar purchases, while maintaining strong internal controls and fiscal oversight.

CREDIT CARD USE POLICY AND

PROCEDURES - CAL-CARD
APPROVED BY THE PARLIER CITY COUNCIL [DATE]
ADOPTED BY RESOLUTION 2025-_
SUBJECT:

Credit Card Use Policy and Procedures - CAL-Card
INTRODUCTION:

The City of Parlier uses a variety of methods for the purchase of goods and services. However, for small dollar purchases, processing an express or regular purchase order is not always cost-effective or efficient. In addition, occasionally local suppliers refuse to accept either type of purchase order.

To address this need, the State of California Department of General Services (DGS) developed a aster Service Agreement with U.S. Bank to provide VISA bank cards to State and local governmer mployees as a payment method for small purchases of goods and/or services. This uniqu government credit card has the employee's name embossed on it and is identified as a State of California U.S. Bank VISA Card - also known as the "CAL-Card." The CAL-Card helps promote increased supplier/contractor acceptance, improves the timely delivery of products and services, and reduces certain business-related costs. The CAL-Card program is not intended to, nor will it be used to, circumvent any existing statutes, laws, or City of Parlier procurement procedures and policies.

PURPOSE:

The following CAL-Card policies and procedures establish guidelines for the use of the credit card by City of Parlier employees. CAL-Cards shall be issued to a limited number of city employees for the purpose of making authorized small-dollar purchases, securing reservations and paying travel expenses when on official city business. Use of the CAL-Card should only be for instances where a Purchase Order, Request for Payment or Expense Reimbursement cannot be utilized.

ISSUANCE OF CITY CREDIT CARDS:

The issuance of the CAL-Card is limited to:
• City Manager
• City Assistant Manager
• Finance Director
• City of Parlier Directors as designated by the City Manager.

Additional cards to City staff shall not be issued unless otherwise approved by the City Manager and Department Director.

REPORT TO CITY COUNCIL
SUBJECT: Authorization to Terminate Agreement with Unwired Broadband for Convenience

RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution authorizing the City Manager to issue a one hundred eighty (180) day written notice to Unwired Broadband to terminate the existing agreement for convenience, pursuant to Section 9 of the Agreement.

BACKGROUND
The City of Parlier entered into an agreement with Unwired Broadband on August 15, 2024 to allow the installation and operation of broadband infrastructure within the City.

The purpose of the agreement was to improve internet connectivity and expand broadband services to residents and businesses.

In February 2025, the agreement was amended to reflect updated provisions related to project scope and implementation timelines.

DISCUSSION
Since the commencement of work under the agreement, the City has received multiple complaints from residents and property owners, including but not limited to:
• Damage to water lines
• Open holes left unaddressed at construction sites
• Damage to personal or private property
These complaints raise concerns about the quality of work and public safety, as well as potential liability to the City. While City staff has worked with the contractor in an attempt to resolve these issues, the recurrence of complaints has led to the determination that continuing the agreement is not in the City's best interest.

Section 9 of the agreement expressly allows either party to terminate the agreement for convenience with 180 days' written notice. Furthermore, the agreement states that any construction plans approved by the City prior to the effective date of termination will remain governed by the agreement even after termination.

FISCAL IMPACT
There is no direct fiscal impact resulting from the adoption of this resolution. Any future costs related to ongoing or remaining obligations under previously approved plans will be addressed through existing project budgets or through coordination with Unwired Broadband.

ENVIRONMENTAL REVIEW
This action is not a project under the California Environmental Quality Act (CEQA) and is therefore not subject to CEQA review.

CONCLUSION
Based on recurring performance issues and pursuant to the City's rights under the agreement, staff recommends that the City Council adopt the attached resolution to formally initiate termination of the agreement with Unwired Broadband for convenience, and authorize the City Manager to issue the required written notice.
