REPORT TO CITY COUNCIL
SUBJECT:
City Council to Consider Classification of Use.
RECOMMENDATION:
Staff recommends that the City Council considers Resolution No. 2026-XX, classifying clothing stores as a permitted use in the C-5 General Commercial Zone District.
BACKGROUND:
Adriana G. Contreras has expressed interest in operating a clothing store in an existing structure at 13465 Manning Avenue. The property is zoned C-5 General Commercial, which is the City's least-restrictive commercial zone. On May 8, 2026 she submitted an application to the Planning Department requesting that " clothing store" be included as a permitted use within the City's C-5 General Commercial Zone District.
PROPOSAL & DISCUSSION:
Historically, zoning ordinances have been interpreted to be permissive, meaning that if a use is not specifically allowed, then it is by default prohibited. A use is expressly listed as prohibited when the intention is to establish that said use is strictly incompatible with the subject zone (e.g. a factory in a residential zone or a school in an industrial park). Generally, the addition of a use to a zone district requires an amendment to the text of the Zoning Ordinance. That process can be relatively costly and time-consuming, as it requires at least one noticed public hearing, first and second ordinance readings, and potentially more in-depth examination under the California Environmental Quality Act (CEQA).
Understanding that a zoning ordinance cannot possibly list all uses that could conceivably be allowed, there is an alternative to the zoning text amendment: the classification of use. Under that process, the City Council' may determine that the proposed type of use, while not listed as allowable in a particular zone, is substantially similar to other permitted or conditionally-permitted uses in that zone and should be allowed.
For the purposes of this proposal, staff suggests the following definition of "clothing store":
"Clothing store" shall mean a retail business engaged in the display and sale of new or used clothing, apparel, shoes, fashion accessories, handbags, or similar related consumer merchandise intended for personal use."
1 Parlier Municipal Code Chapter 18.34 details the procedures for use classification, indicating that the processes shall be undertaken by the Planning Commission. Given that there is no sitting Planning Commission, the responsibility instead falls to the City Council.
The Chapters of the Parlier Municipal Code (PMC) that establish the City's various zone districts all begin with a statement of intent for that zone. PMC Chapter 18.26 establishes and sets forth the criteria applicable to the C-5 Zone. Section 18.26.010 states:
"The C-5 general commercial district is developed to serve commercial uses which do not belong in the general trading district."
The intent of the C-5 Zone district is to accommodate intensive and specialized commercial uses that may not typically be appropriate within the C-4 General Trading District. However, the C-5 Lone also permits a range of retail and consumer-serving commercial activities, including furniture stores, mattress shops, pottery sales, grocery stores, and secondhand stores. The district is not exclusively limited to heavy commercial or automobile-oriented activities.
Permitted uses within the C-5 zone are organized into Retail, Services, and Recreation. The proposed clothing store is most appropriately classified as a retail use and is similar to the other retail-oriented uses permitted within the district, including "secondhand stores" listed under the Retail category. The sale of clothing and related consumer merchandise is similar to the other retail activities in the C-5 Zone.
CLASSIFICATION OF USE FINDINGS
Prior to classifying a use, the City Council must make findings as prescribed by Parlier Municipal Code Section 18.34.030:
1. That investigations have disclosed that the subject use and its operation are compatible with the uses permitted in the district wherein it is proposed to be located.
The evidence supports this finding. The C-5 General Commercial District is intended to be is generally compatible with existing allowable uses.
2. That the subject use is similar to one or more uses permitted in the district in which it is proposed to be located.
The evidence supports this finding. The Retail category of permitted uses in the C-5 General Commercial Zone includes secondhand stores. The proposed type of use is substantially similar to that use in that it involves the display and sale of clothing, apparel, shoes or other similar items.
3. That the subject use will not cause substantial injury to the values of property in the neighborhood or district in which it is proposed to be located.
The evidence supports this finding. There is no evidence to support a determination that the type of use proposed would negatively impact property values.
4. That the subject use will be so designed, located, and operated that the public health, safety, and general welfare will be protected.
The evidence supports this finding. By application of its Constitutionally reserved police power, the City of Parlier has established zone districts, each with a purpose and intent internally consistent as to the uses allowed within it, either by right or subject to a conditional use permit. Through enactment of its zoning ordinance and the zoning map that is a part thereof, the City Council has determined that the listings of uses within each zone district, the associated development standards and review processes, the areas) within the city limits to which each zone district is applied, and the discretionary authority reserved to the City to consider and approve, approve with conditions, or deny development proposals serve the function of protecting the public health, safety, and general welfare.
It is important for the Council to consider that it is not being asked to approve a specific business at a particular location; only that it determines that the proposed type of use is acceptable in general within the C-5 zone and whether it would be by right or conditional in nature. Given the above, it does appear that the proposed type of use is consistent with uses that are allowed either by right or with a conditional use permit in the C-5 zone, it does appear to fall within the realm of activities contemplated in the statement of intent for the C-5 zone.
PUBLIC NOTICE
Classification of use does not require public notice.
ENVIRONMENTAL:
The first step in complying with the California Environment Quality Act is to determine whether the activity in question constitutes a "project" as defined in CEQA. The second step is to determine whether the project is subject to or exempt from the statute. This proposal does not qualify as a project as defined in CEQA Guidelines Section 15378(a). Although classification of use relates to uses permitted by the zoning ordinance, it is only an interpretation of existing policy (i.e. the purpose and intent of a particular zone district) and is distinct from an actual amendment to the zoning text (Section 15378(a)(1)). The requested classification of use is not being undertaken by a person with any form of assistance from a public agency (Section 15378(a)(2)). Finally, although it does require discretionary action by the City Council, it does not comprise issuance of a permit, license, or any entitlement from a public agency (Section 15378(a)(3)). Further, if the Council denies the request, then CEQA does not apply (Public Resources Code Section 21080(b)(5)) FISCAL IMPACT:
Costs for processes initiated by applicants are paid for through application fees. There is no impact to the General Fund or other City funds.

Resolution No. 2026-XX
RESOLUTION 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARLIER CLASSIFYING "CLOTHING STORE" AS A PERMITTTED USE WITHIN THE C-5
GENERAL COMMERCIAL ZONE DISTRICT
WHEREAS, Parlier Municipal Code Chapter 18.34 provides an avenue by which the Planning Commission, based upon four findings, may add a type of use as permitted or conditionally-permitted within a particular zone district ("classification of use"); and WHEREAS, as the City of Parlier has no sitting Planning Commission, procedures for which the Planning Commission is the designated decision-making body are instead addressed by the City Council; and
WHEREAS, at a regular meeting on May 21, 2026, the Parlier City Council did consider a classification of use to allow by right "clothing stores" within the C-5 General Commercial Zone District; and
WHEREAS, "clothing store" is defined as "a retail business engaged in the display and sale of new or used clothing, apparel, shoes, fashion accessories, handbags, or similar related consumer merchandise intended for personal use;" and
WHEREAS, the Parlier City Council makes the following findings pursuant to Parlier Municipal Code Section 18.34.020, the evidence for said findings contained within the record:
1. That investigations have disclosed that the subject use and its operation are not compatible with the uses permitted in the district wherein it is proposed to be located.
2. That the subject use is not similar to one or more uses permitted in the district in which it is proposed to be located.
3. That the subject use will not cause substantial injury to the values of property in the neighborhood or district in which it is proposed to be located.
4. That the subject use will be so designed, located, and operated that the public health, safety, and general welfare will be protected; and
NOW, THEREFORE BE IT RESOLVED as follows:
The Parlier City Council finds that the proposed classification of use does not meet the definition of a "project" contained within California Environmental Quality Act ("CEQA") Guidelines Section 15378(a), and therefore is not subject to CEQA; and The Parlier City Council classifies "clothing store" as a permitted use within the C- 5 General Commercial Zone District.

RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 2026-_ authorizing the City Manager to execute the Grant Agreement with Trust for Public Land in the amount of $100,000 for the Parlier Pocket Park Access for All Project.
BACKGROUND: Trust for Public Land has awarded the City of Parlier grant funding through its 10 Minute Walk Partnership Fund to support the Parlier Pocket Park Access for All Project. Under the agreement, the City will receive a fixed grant amount of $100,000.
The agreement term begins on the effective date of the agreement and continues through April 30, 2027, unless otherwise terminated or extended in accordance with the agreement. Approval of the proposed resolution will authorize the City Manager to execute the agreement on behalf of the City and allow staff to proceed with implementation of the grant-funded activities.
FISCAL IMPACT: The City will receive $100,000 in grant funding from Trust for Public Land for the Parlier Pocket Park Access for All Project. Payment will be made by Trust for Public Land within forty-five business days of the effective date of the agreement and receipt of the required W-9 and ACH/electronic banking information. REPORT TO CITY COUNCIL
SUBJECT:
Direction to Staff and Potential Resolution of Intention Regarding Carports RECOMMENDATION:
City Council to provide direction to staff regarding carport regulations. Council mat adopt a Resolution of Intention directing staff to prepare a zoning text amendment.
BACKGROUND:
Placement of both temporary and permanent carports within front yards has been a topic of discussion for some time. For general single-family uses, the provisions of the R-1 Single Family Residential zone require two covered parking spaces within a garage and a minimum front yard setback to a garage or carport of 20 feet. However, the City cannot mandate that people actually use the garage for parking. Some are used for storage of personal items, and Accessory Dwelling Unit (ADU) law allows owners to convert their garages to ADUs and prevents the City from requiring replacement parking. If a garage is simply converted to additional living space (i.e., not a full conversion to an ADU or a Junior ADU), the City can mandate replacement parking.
Regardless of the reason, many residents have opted to place either permanent or temporary constructs over their driveways to provide limited covered parking. Accordingly, Code Enforcement has issued notices of violation to numerous property owners.
PROPOSAL & DISCUSSION:
Staff requests direction from the City Council about this issue. The Council may direct staff to return at a future meeting with proposed amendments to the zoning ordinance for Council consideration. Pursuant to Parlier Municipal Code Section 18.48.020(A), Council action to initiate such an amendment must be done via resolution; a resolution of initiation is attached.
If the Council does not wish to initiate changes at this time, that resolution has no effect.
PUBLIC NOTICE
There is no public notice associated with this item. Should Council direct staff to return with a draft ordinance, a public hearing is required, and notice will be provided pursuant to Gov.
Code Section 65090 and PMC Section 18.48.080(B).
ENVIRONMENTAL:
Council providing direction to staff as requested herein does not constitute a "project" under the California Environmental Quality Act (CEQA).
FISCAL IMPACT:
There is minimal fiscal impact related to staff costs for document preparation and research.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARLIER INITIATING AN AMENDMENT TO TITLE 18 OF THE PARLIER MUNICIPAL CODE
REGARDING CARPORTS

REPORT TO CITY COUNCIL
SUBJECT:
Approval of a Sole Source Purchase of DUI Community Outreach Materials from Positive Promotions in an Amount Not to Exceed $20,000
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 2026-_ _approving a sole source purchase of DUI Community Outreach Materials from Positive Promotions, in an amount not to exceed $20,000, and authorize the City Manager, Chief of Police, or their designee to execute all necessary documents.
BACKGROUND
Driving Under the Influence (DUI) prevention remains a core public-safety priority for the Parlier Police Department. In addition to enforcement operations, the Department conducts community outreach and education campaigns designed to reduce impaired driving and increase public awareness of DUl laws and consequences.
As outlined in the attached resolution, the Police Department has identified the need to procure DUI Community Outreach Materials to support prevention efforts. These materials include educational and promotional items used during community events, school outreach, DUI checkpoints, and grant-funded awareness campaigns. The use of standardized, high-quality outreach materials ensures consistent messaging and compliance with State of California grant program requirements.
SOLE SOURCE JUSTIFICATION
Staff recommends a sole source procurement from Positive Promotions based on the following:
• Specialized Public Safety Focus: Positive Promotions is a nationally recognized provider of law-enforcement-specific DUI prevention and traffic-safety outreach materials tailored to police department needs.
• Standardization and Compliance: The vendor provides materials that align with grant-funded DUl prevention program requirements, ensuring messaging consistency and eligibility for reimbursement.
• Comprehensive Product Line: Positive Promotions offers a wide range of pre- designed DUl education materials suitable for diverse community engagement settings, eliminating the need for multiple vendors.
• Operational Efficiency: Utilizing a single, specialized vendor reduces procurement time, ensures product consistency, and supports timely deployment of outreach efforts.
• Market Limitation: Based on staff review, no alternative vendor has been identified that can provide comparable law-enforcement-specific outreach materials meeting operational and compliance requirements within the required timeframe.
Consistent with City procurement policy, this purchase qualifies as a sole source due to specialization, compatibility, and program compliance considerations.
FISCAL IMPACT
The total cost of the purchase will not exceed $20,000 and will be funded through the CHP Cannabis Grant (Fund 289). As identified in the attached resolution, no impact to the City's General Fund is anticipated.

AGENDA ITEM:_ #11
MEETING DATE: May 21, 2026
DEPARTMENT: POLICE
REPORT TO CITY COUNCIL
SUBJECT:
Consideration and Approval of a Market Salary Adjustment for the Police Chief and Adoption of a Resolution Establishing the Annual Salary at $165,000.
RECOMMENDATION:
It is recommended that the City Council:
1. Approve a market adjustment to the compensation of the Police Chief position;
2. Establish the annual salary for the Police Chief classification at One Hundred Sixty-Five Thousand Dollars ($165,000); and
3. Adopt the attached Resolution approving the salary adjustment.
BACKGROUND:
The Police Chief position serves as the executive leadership position responsible for the administration, management, and strategic direction of the Police Department. The position oversees all law enforcement operations, personnel management, budget administration, policy implementation, emergency response planning, intergovernmental coordination, and public safety initiatives for the City.
As the City continues organizational development efforts and faces increasing operational demands associated with public safety administration, recruitment, retention, regional competitiveness, and executive leadership responsibilities, staff conducted a review of compensation levels for comparable executive law enforcement positions within the region.
The review determined that the current compensation level for the Police Chief position is below market relative to similarly situated agencies and does not adequately reflect the scope of responsibility associated with the position. The Police Chief is responsible for oversight of patrol operations, investigations, animal control, code enforcement functions, grant administration, budget development, labor relations support, strategic planning initiatives, emergency management coordination, and City-wide public safety programs.
To remain competitive and ensure retention of executive leadership personnel, staff recommends implementation of a market salary adjustment.
The proposed adjustment would establish the annual salary of the Police Chief position at:
Annual Salary: $165,000
Equivalent Monthly Salary: $13,750
This adjustment is intended to align compensation with market conditions and executive- level responsibilities.
FISCAL IMPACT:
The proposed salary adjustment will increase personnel expenditures associated with the Police Chief position. Sufficient appropriations will be incorporated within the Police Department budget and future fiscal planning documents.
Any associated impacts related to retirement contributions, payroll taxes, and benefits will be absorbed within existing personnel budgeting processes or addressed through future budget amendments as necessary.

REPORT TO CITY COUNCIL
SUBJECT: Authorize the City Manager to Authorize the Proposed Budget and Implementation of a Water Meter Transmitter Replacement Program Utilizing Cellular Technology.
RECOMMENDATION: Staff recommend that the City Council approve and authorize the City Manager or designee to proceed with implementation of the Water Meter Transmitter Replacement Program — Partial City Upgrade in the estimated amount of $1,000,000.
BACKGROUND: The City of Parlier's existing water meter transmitters were installed in approximately 2009 and have exceeded their expected service life of 8-10 years. As a result, the City is currently experiencing widespread transmitter failures. At present, over 200 residential accounts are affected by non-functioning transmitters. These failures prevent accurate water usage readings, resulting in unaccounted water consumption and loss of revenue to the City. Due to the age and condition of the system, failures are expected to continue increasing, further impacting billing accuracy and operational efficiency. Staff evaluated replacing the existing transmitters with cellular-based technology, which allows water usage data to be transmitted directly to City Hall and improves billing accuracy and efficiency.
The recommended Partial City Upgrade will replace transmitters in approximately half of the City, prioritizing areas with the highest failure rates. This phased approach addresses the most pressing failures and revenue losses first while keeping initial capital expenditures manageable. Additional phases may be programmed in future budget cycles as funding becomes available to extend cellular transmitter coverage to the remainder of the system.
FISCAL IMPACT: Funding sources may include Water Enterprise Funds, reserves, financing, or future grant opportunities. Continued inaction will likely result in ongoing revenue loss due to unbilled water usage.
Estimated Cost: $1,000,000

STAFF REPORT
SUBJECT
Discussion Regarding Reinstatement of Water Shut-Off Policy and Implementation of Payment Arrangement Policy for Delinquent Utility Accounts
RECOMMENDATION
This item is presented for discussion only. No action is requested at this time. Staff intends to return at a future meeting with a formal policy for Council consideration and adoption.
BACKGROUND
Prior to the COVID-19 pandemic, the City of Parlier enforced water shut-offs for utility accounts that became delinquent due to non-payment. During the pandemic, water shut-offs were suspended in response to public health concerns and statewide protections intended to assist residents experiencing financial hardship.
Since that time, the City has not reinstated water shut-offs for delinquent utility accounts. As a result, unpaid balances have continued to accumulate, creating financial impacts to the City's Enterprise Funds. Utility billing currently includes all applicable fees and charges for Water, Sewer, and Disposal services, which are required to be paid simultaneously; however, many accounts have remained unpaid for extended periods without enforcement measures in place.
DISCUSSION
Staff is evaluating the reinstatement of the City's water shut-off procedures for non-payment in compliance with Senate Bill 998 (SB 998), also known as the California Water Shutoff Protection Act. SB 998 establishes requirements and consumer protections that public water systems must follow prior to discontinuing residential water service for non-payment.
The proposed policy framework would include:
• Compliance with all notification and procedural requirements established under SB 998; Reinstatement of water shut-offs for delinquent accounts after all required notices and timelines have been met;
• Establishment of a formal payment arrangement policy for customers experiencing financial hardship;
• Clear payment arrangement terms and deadlines to encourage timely repayment of delinquent balances; and
Enforcement of payment arrangements consistently, with exceptions granted only under unusual circumstances at the discretion of the City Manager.
The intent of the proposed payment arrangement policy is to provide customers with an opportunity to maintain service while also ensuring accountability and protecting the fiscal health of the City's Enterprise Funds.
Staff believes reinstating these enforcement measures is necessary to improve revenue collection, maintain equitable treatment among utility customers, and support the long-term financial sustainability of the City's water and utility operations.
FISCAL IMPACT
The continued suspension of water shut-offs has contributed to revenue loss across the City's Enterprise Funds due to increasing delinquent utility balances. Reinstatement of shut-offs and implementation of structured payment arrangements are anticipated to improve collections and reduce outstanding receivables.
