The Parlier Police Department has reviewed the application and conducted a preliminary operational assessment. The requested closures are consistent with prior events of similar scale and are operationally feasible with appropriate planning and resource allocation.

• Detour routes will be clearly marked to maintain traffic flow. • Emergency vehicle access will be maintained at all times. • Police personnel and/or approved traffic control staff will be assigned as necessary.

REPORT TO CITY COUNCIL
SUBJECT:
Consideration of Ordinance No. 26-03 Regarding Carports in the R-1 Single Family Residential Zone
RECOMMENDATION:
City Council to waive the second reading of and adopt Ordinance No. 26-03.
BACKGROUND:
At its regular meeting on May 21, 2026, the City Council adopted a resolution of intention directing staff to prepare a zoning text amendment for Council consideration. Following a public hearing at its regular meeting on June 18, 2026, the City Council introduced and waived the first reading of Ordinance No. 26-03.
PROPOSAL & DISCUSSION:
Ordinance No. 26-03 would remove the front yard setback requirement in the R-1 Single Family zone for carports, defined in PMC Section 18.04.094 as "a permanent roofed structure with not more than two enclosed sides used or intended to be used for automobile shelter and storage." This change would allow residents to construct, subject to a building permit, a permanent, open-sided structure in front of a garage or other portion of a dwelling to be used for vehicle parking. Further, the ordinance would reduce the side yard setback for carports to zero feet, provided the front of the carport is located at or behind the front of the dwelling.
Carports would remain subject to lot coverage standards. Roof drainage from these carports would be required to be directed to the subject property. Finally, the ordinance would modify the definition of "garage", which currently includes carports, to clarify that where separate standards for carports are discussed, those standards control.
Temporary facilities (e.g., canopies, tents, "easy-ups") would continue to be regulated as nuisances on a case-by-case basis as appropriate.
PUBLIC NOTICE
For the public hearing on June 18, 2026, a notice of public hearing was published in The Business Journal on June 8, 2026 and a similar notice was posted at City Hall and on the City's website. No additional noticing is required for this second reading.
ENVIRONMENTAL:
The first step in complying with the California Environmental Quality Act (CEQA) is to determine whether the activity in question constitutes a "project" as defined by CEQA, Public Resources Code Section 21000, et seq. and the CEQA Guidelines, California Code of Regulations Section 15000, et seq. The second step is to determine whether the project is subject to or exempt from the statute. This proposal qualifies as a project under CEQA because CEQA Guidelines Section 15378 expressly includes amendment of a zoning ordinance within the definition of a "project."
However, the proposed ordinance amendment does not approve or otherwise authorize any specific activity that could result in a physical change to the environment; it is solely an amendment to regulations. In cases where it can be shown with certainty that the project being considered has no possibility of causing a significant impact to the environment, the project is not subject to CEQA as indicated in Guidelines Section 15061(b)(3).
FISCAL IMPACT:
There is minimal fiscal impact related to staff costs for document preparation and research.

PARLIE AGENDA ITEM:
MEETING DATE: July 2, 2026
DEPARTMENT: Police
REPORT TO CITY COUNCIL
SUBJECT: Second Reading and adoption of Ordinance No. _Establishing Chapter 10.68 of the Parlier Municipal Code Regulating Police-Directed Towing Services and Establishing a Rotation Tow Program; Waive Full Reading and Adopt Ordinance.
RECOMMENDATION:
It is recommended that the City Council:
1. Conduct second reading of Ordinance No. establishing Chapter 10.68 of the Parlier Municipal Code regulating police-directed towing services within the City of Parlier;
2. Adopt Ordinance No. _ establishing Chapter 10.68 of the Parlier Municipal Code regulating police-directed towing services within the City of Parlier with an effective date of August 2, 2026
BACKGROUND
The Parlier Police Department routinely utilizes private towing companies for vehicle impounds, evidence holds, traffic collision removals, abandoned vehicle removals, and other police-directed towing services. Currently, the City does not maintain a formally codified ordinance establishing requirements and standards governing participation in a police tow rotation program.
The proposed ordinance establishes a comprehensive regulatory framework for police-directed towing services within the City of Parlier. The ordinance is intended to promote fairness, accountability, professionalism, and public safety by establishing minimum standards for tow operators participating in the City's rotational towing program.
The ordinance authorizes the Chief of Police to establish and administer a tow rotation program and establishes eligibility requirements, including licensing, insurance, equipment standards, storage facility requirements, response time expectations, recordkeeping obligations, and disciplinary procedures.
The ordinance further provides mechanisms for suspension or removal of participating tow operators for violations of applicable laws, regulations, or program requirements.
Adoption of the ordinance will ensure that police-directed towing services are provided in a fair, consistent, and transparent manner while protecting the interests of the public and the City.
First reading of the ordinance was conducted at the June 18, 2026 regular city council meeting.
Summary of the ordinance was published and circulated in the media as required by law.
DISCUSSION
The proposed ordinance provides:
• Authority for the Police Department to administer a rotational tow system; • Minimum qualifications for participation;
• Insurance and indemnification requirements;
• Vehicle and equipment standards;
• Secure vehicle storage requirements;
• Response time standards;
• Driver and employee background requirements;
• Procedures for rotation assignment;
• Suspension and removal procedures;
• Appeals process; and
• Administrative authority for the Chief of Police to adopt operational regulations necessary to implement the program.
The ordinance is modeled after commonly adopted towing regulations utilized by California municipalities and law enforcement agencies and is intended to improve service delivery and accountability.
FISCAL IMPACT
There is no significant fiscal impact associated with adoption of the ordinance. Administrative costs associated with implementing and managing the tow rotation program will be absorbed within the Police Department's existing operating budget.

The police department shall rotate its requests for the services of towing vehicles among the operators on the police department's rotational list for such vehicles. The rotation procedure shall be operated as follows:
(a) When an operator is given and completes a call, that operator shall move to the bottom the rotation list.
(b) Whenever more than one tow truck is needed to respond to a call for service, a separate operator shall be called for each truck. Each operator called shall be credited with a call and moved to the bottom of the rotation list in the order called. The police department has the discretion to use one operator at a scene for servicing multiple vehicles to maximize vehicle removal, traffic control and/or law enforcement. (c) Whenever the driver or owner of a disabled vehicle specifies a particular club, Association or tow service to be called to provide service, such calls shall not constitute a "rotation" call. This practice shall also be followed if the owner or his/her representative requests an operator authorized to tow on behalf of a named insurance company. (d) If the police department is unable to reach the operator in the first position on the Rotation list for a call, or is unavailable as otherwise requested, or if the operator accepts a call and is subsequently unable to respond as required, that operator shall be credited with a call and moved to the bottom of the rotation list.
(e) If the police department, in its judgment, determines that the operator in the first Position on the rotation list, or as otherwise requested for service, is improperly equipped Or otherwise incapable of adequately or efficiently responding to a specific call, the department may pass over that operator and continue down the list until it reaches an operator it considers capable of adequately responding to the call. If no operator on the list has the necessary skills or equipment to adequately respond, the department may request service from an operator not on the rotation list. A change from the normal rotation procedure under these circumstances does not alter any operator's position on the rotation list, except that the operator actually chosen shall be credited with a call and moved to the bottom of the list.
(f) Whenever an authorized police department employee determines that an emergency exists because an operator is unable, for any reason, to provide adequate tow service, the police department employee shall have the right to have such duties performed by any other means, starting with other operators on the rotation list, that most readily available to address the emergency in the most efficient and safe manner. (g) The Police Department shall maintain rotation records and make them available for inspection to operators and the public upon request.
10.68.140. Data Collection and Reporting •
All towing companies operating within the City shall be required to submit accurate and complete towing data to the City on a monthly basis in a format approved by the City Manager. The City shall compile and present a quarterly report to the City Council and make it available to the public.
The report shall include:
(a) The total number of vehicles towed during the reporting period. (b) A breakdown of tows by each towing company operating within the City. (c) The reason for each tow, categorized by type (e.g., parking violations, abandoned vehicles, law enforcement-initiated tows, etc.).
(d) Any additional relevant data that may be deemed necessary by the City Manager or Council to ensure transparency.
The quarterly report shall be presented at a regular City Council meeting and posted on the City's official website in an easily accessible format.
10.68.150. Suspension
Any Tow Truck company placed on the rotation list may be suspended by the Police Chief from such list if the Tow Truck company fails to comply with any of the conditions, regulations or requirements of this article. Upon learning of grounds for suspension, the Police Chief shall immediately, by written notice, inform the owner of the Tow Truck company of the suspension.
The Police Chief may reinstate the Tow Truck company to the rotation list upon satisfactory proof that the Tow Truck company is in compliance with the conditions, regulations, and requirements of this article and has completed its suspension.
10.68.160. Removal from rotation list.
Any Tow Company placed on the rotation list may be removed from such list in accordance with the provisions of the Tow Agreement for the Parlier Police Department.
Upon learning of grounds for removal, the Police Chief shall immediately, by written notice, inform the owner of the Tow Company of the action of removal.
10.68.170. Appeal.
Any action for denial of an application, and any Tow Truck company suspended in excess of 30 days or removed from the rotation list, shall have the right to appeal such order through a written communication to the City Manager within 10 days of notice of the action. If no appeal is filed within the time prescribed, the action of the Police Chief shall be final. The City Manager shall review any appeal and issue a written ruling to the apellant. An appellant shall not be allowed to participate in any tows, or be placed on the Rotation List, until such time that the appeal is resolved and the Police Chief finds that the appellant is entitled to be reinstated on the Rotation List.
10.68.180. Authority of Police Chief.
The Police Chief is authorized to promulgate administrative rules and procedures for the successful and effective implementation of this article including establishing, amending, updating, restating and entering into Towing Agreements subject to approval by the City Attorney. Said administrative rules and procedures shall be in writing.
10.68.190. Conflict with other laws.
In the event of any conflict between this article and any federal or state law, regulation, Permit or other ordinance of the city, the requirements which establish the stricter standard shall govern. To the extent permitted by law, nothing in this article shall preclude enforcement of any other applicable law.
10.68.200. Severability.
If any section, subsection, phrase, or clause of this article is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this division. The city council hereby declares that it would have adopted this article and each section, subsection, phrase, or clause thereof irrespective of the fact that any one or more sections, subsections, phrases, or clauses be declared invalid.

AGENDA REPORT
MEETING DATE: July 2, 2026 Council Item
TITLE: "Policy Governing Remote Participation and Enhancement of Public Participation in City Council and Commission
Meetings" to implement Senate Bill No. 707
PRESENTED BY: Bertha Escalera, City Clerk
RECOMMENDATION: Adopt the Attached Resolution to Adopt a Policy Entitled "Policy Governing Remote Participation and Enhancement of Public Participation in City Council and Commission
Meetings" to implement Senate Bill No. 707
BACKGROUND:
On October 3, 2025, Governor Newsom signed Senate Bill No. 707 ("SB 707"), which revises and updates the Ralph M. Brown Act's open meeting laws to provide greater flexibility in teleconferencing and enhance accessibility requirements, including translation services in certain circumstances and real-time captioning. SB 707 requires the City Council to formally authorize teleconferencing for advisory bodies, including commissions, committees, and boards, through a resolution or policy, pursuant to California Government Code section 54953.8.6.
These new requirements build on the existing teleconferencing framework established under prior legislation, including Assembly Bills 361 and 2449. SB 707 takes effect on July 1, 2026, and will remain in effect until January 1, 2030. A draft policy, entitled "Policy Governing Remote Participation and Enhancement of Public Participation in City Council and Commission Meetings" is now presented to the City Council to implement Senate Bill No. 707.
It is important to note that SB 707 has new provisions applicable to all city councils and new provisions only applicable to an "eligible legislative body", which is defined as "a city council of a city located in a county with a population of 600,000 or more". Accordingly, the City will be subject to all provisions of SB 707, i.e. both the general provisions of SB 707 and the provisions applicable to an "eligible legislative body" because the City is located in a county that exceeds a population of 600,000 people.
DISCUSSION:
SB 707 updates the City's open meeting requirements to enhance public participation, transparency, and accessibility.
01493.0001 2160307.1
Teleconferencing and Remote Participation Requirements
Mandatory Hybrid Meetings: The City Council must provide for hybrid meetings (in-person plus a teleconference option). The teleconference option must be either a two-way telephonic or audiovisual platform (e.g., zoom). If using audiovisual platforms, a call-in option and active captioning (if available) are required.'
Policy Regarding Broadcast Disruption: The City Council must adopt an open session policy regarding hybrid meetings that includes procedures for restoring service in the event of a broadcast disruption. The policy should include (i) steps to be taken if audio, video, or the entire platform fails, (ii) the appropriate personnel to take corrective action to restore service, and (iii) the procedure to notify the public and resume the meeting upon restoration of service.
In addition, the policy should also outline how the City Council will deal with a disruption or disturbance from a member of the public, either in-person or on teleconference, and restore decorum to the meeting. The policy should also address the procedures for accommodating disability requests by a Councilmember or a member of the public in participating in the meeting, as well as define "just cause" and "emergency circumstances" for purposes of remote participation by a Councilmember.
One-Hour Recess Requirement: If a disruption prevents the public from attending the meeting remotely, the City Council must take a recess and try to restore service. If service cannot be restored within one (1) hour, the City Council must conduct a roll call vote confirming that good faith efforts were made, and make a finding that public interest in continuing the meeting outweighs remote access.
Legal Basis for Remote Participation of Councilmember: Starting January 1, 2026, Councilmembers and commissioners who participate remotely must have their legal basis for remote participation recorded in the meeting minutes.
Councilmember with Disability: Starting January 1, 2026, Councilmembers and commissioners with a disability may participate remotely as a reasonable accommodation, including participation via audio only (but only if their condition prevents participation on camera). Once an accommodation is granted for a disability, the Councilmember's remote participation counts toward quorum at the in-person meeting site. Unlike the ' Cal. Gov. Code § 54953.4(b)(1).
2 Cal. Gov. Code § 54953.4(b)(1).
3 Cal. Gov. Code § 54953.8(b)(7).
01493.0001 2160307.1
"just cause" or "emergency circumstance" reasons for
Councilmembers/commissioners to participate remotely, there are no restrictions on the number of meetings a Councilmember/commissioner may attend remotely and no geographic limits on participation, once a disability is established and accommodated. However, those attending remotely must still disclose any present adults and their relationship to them.4
• "Just cause" definition expanded and extended: Currently, Councilmembers and commissioners may participate remotely due to "just cause". In addition to the existing reasons of childcare needs, a contagious illness, official City-related travel, and physical or family medical emergency, as of January 1, 2026 the definition of "just cause" will now include military service obligations. Previously sunsetting at the end of 2025, the allowance for remote participation via "just cause" has been extended to December 31, 2029.5
Enhancing Public Engagement:
Translation of meeting agendas: If 20% of the City's population speaks an applicable foreign language and at the same time, that population speaks English less than "very well" °, then the City must translate meeting agendas (but not the entire agenda packet) into that applicable language. There is no need to verbally state how the foreign language translation of the agenda may be accessed during the applicable Council meeting. [Note that the 20% calculation must be based on data regarding foreign languages from the most recent American Community Survey.] • Translation of the City website: Similar to meeting agendas, the following information on the City's website must also be translated if 20% of the City's population speaks an applicable foreign language and at the same time that population speaks English less than "very well". Each translation must be accessible through a prominent direct link posted on the City's website home page?
(A) An accessible internet webpage dedicated to public meetings that includes, or provides a link to, all of the following information:
4 Cal. Gov. Code § 54953(c).
5 Cal. Gov. Code § 54953.8.3(c).
6 Note that the term "very well" is not defined in the Govt. Code, but is a term of art used to identify individuals with limited English proficiency (LEP), and it refers directly to data from the U.S. Census Bureau's American Community Survey (ACS). The U.S. Census Bureau uses this specific phrasing in its survey to measure the level of English proficiency within households and communities. Individuals are considered LEP if they indicate on the ACS that they speak English "less than very well" (which includes responses such as "well", "not well", or "not at all"). 7 Cal. Gov. Code § 54953.4(b).

(1) A general explanation of the public meeting process for the City Council.
(II) An explanation of the procedures for a member of the public to provide in-person or remote oral public comment during a public meeting or to submit written public comment (III) A calendar of all public meeting dates with calendar listings that include the date, time, and location of each public meeting.
(IV) The agenda posted online.
Social Media Use: Existing law temporarily allows a Councilmember to participate in individual communications on an internet-based social media platform for specified purposes, provided that a majority of Councilmembers do not use the platforms to discuss or deliberate on matters within the City's specific subject matter jurisdiction. This bill makes removes the sunset date and makes this exception permanent.®
Brown Act Copy: The City must provide a copy of the Brown Act to each Councilmember of the City.°
Oral Reporting of Compensation Decisions: SB 707 clarifies that the City is required to orally report, prior to final action, a summary of any recommendation of final action on compensation for the City Manager, any department heads, or other comparable administrative officer during an open meeting at which the final action is to be taken.
Assistance in translation services: The City is required to reasonably assist members of the public who wish to translate a public meeting into any language or wish to receive interpretation provided by another member of the public. The bill does not require the City to provide translation services, but only to reasonably assist others who choose to engage in translation/interpretation services. It is important to note that in providing any translation service, SB 707 limits the City's liability in negligent translation and provides that the City will not be responsible for the contents or accuracy of any translation. 10
The bill states that the City Council shall publicize instructions on how to request assistance to the public.
8 Cal. Gov. Code § 54952.2(b).
° Cal. Gov. Code § 54952.7.
10 Cal. Gov. Code § 54953.4(b)(2).
01493.0001 2160307.1
The "assistance" listed in the bill may include any of the following, as determined by the City Council: (i) Arranging space for one or more interpreters at the meeting location, (ii) Allowing extra time during the meeting for interpretation to occur, and/or (iii) Ensuring participants may utilize their personal equipment or reasonably access facilities for participants to access commercially available interpretation services.
Automated translation tools, such as Google Translate, may be used to satisfy these requirements, provided the other statutory obligations are met and a disclaimer is included noting that translations are automatically generated and may not be exact.
Translation near posting sites: The City must also provide a freely accessible physical location near where the agendas are posted to allow the public to post additional translations of the agenda in that location. 1' Outreach requirements: The City must make reasonable efforts to invite groups that do not traditionally participate in public meetings to attend those meetings. Examples of such groups include the following:
Media organizations providing news coverage within the City or region, including ethnic and language-specific outlets serving non- English-speaking communities.
Civil-rights, civic-engagement, neighborhood, and community-based organizations, particularly those active in or serving multilingual or historically marginalized communities. 12
C. Additional Key Requirements
• Teleconferencing for Eligible Subsidiary Bodies: SB 707 further standardizes teleconferencing procedures for eligible subsidiary bodies, such as advisory boards and committees of the City. Before an eligible subsidiary body may use teleconferencing, the City Council must first tormally authorize it by charter, ordinance, resolution or other tormal action. 13 If teleconferencing is authorized, members participating remotely must maintain real-time, two-way communication for the duration of the meeting, unless the member has a physical or mental condition meeting ADA disability criteria that results in a need to participate off camera.
Further, the bill removes the prior requirement to publicly notice each 11 Cal. Gov. Code § 54953.4(c)(3).
12 Cal. Gov. Code § 54953.4(b)(3)(C).
13 Cal. Gov. Code § 54953.8.6. Note that the City Council is not required to authorize any of these teleconferencing procedures.
01493.0001 2160307.1
remote location. Also, SB 707 requires each legislative body to reauthorize an eligible subsidiary body's use of teleconferencing every six months by majority vote, confirming that the practice continues to serve the public interest in accordance with Government Code section 54953.8.6.
The proposed policy sets forth the authority of the City Council to authorize advisory commissions to use teleconferencing, but a separate resolutions) will need to be adopted by the City Council in the future if the City Council chooses to allow specific teleconferencing authorization. Costs of staffing and the technology for implementation of the hybrid format for each commission will need to be considered.
The policy, if adopted, will help to ensure compliance with Senate Bill 707. Further, the policy will support the City's mission to ensure public meetings remain transparent, accessible, and inclusive, consistent with the City Council's goal of proactive communication with all members of the community.
RECOMMENDATION:
1. Adopt the Attached Resolution to Adopt a Policy Entitled "Policy Governing Remote Participation and Enhancement of Public Participation in City Council and Commission Meetings."

Brown Act's open meeting laws to provide greater flexibility in teleconferencing and enhance public participation, transparency, and accessibility in public meetings of the City Council and authorized commissions approved by the City Council pursuant to this Policy.

For purposes of implementation of SB 707, the City Council hereby adopts the following requirements.
I. Hybrid meeting format.
teleconferencing pursuant to Section VII below shall be conducted in a hybrid-format, consisting of two-way telephonic or audiovisual platform, with a call-in option and automatic captioning activated if the platform provides this feature, pursuant to Government Code section 54953.4(b)(1), as may be amended

The City Clerk or appropriate technical personnel shall take immediate corrective action to restore service. Notice of the disruption shall be posted on the City's website and announced at the in-person meeting location, if feasible.
If remote access cannot be restored within one (1) hour, the City Council or approved commission shall conduct a roll call vote confirming that good faith efforts were made to restore service and shall make a finding that the public interest in continuing the meeting outweighs the need for remote access before proceeding in accordance with Government Code section 54953.8(b)(7).

All disruption procedures shall apply equitably whether the disruption affects the public, a Councilmember/ a commissioner (for commissions approved for teleconferencing pursuant to Section VIl below), or a member participating remotely for disability accommodation. These procedures also apply to disruptions impacting individuals participating remotely as a reasonable accommodation under applicable law.

For purposes of this Policy, "disrupting" means engaging in behavior during a meeting that actually disrupts, disturbs, impedes, or renders infeasible the orderly conduct of the meeting, including failure to comply with reasonable and lawful regulations governing public comment.
Prior to removing an individual for disruptive behavior, the presiding officer or their designee shall warn the individual that their behavior is disrupting the meeting and that failure to cease the behavior may result in removal. Required disclosures regarding adults present at the remote location shall be made as required by law.
V. Translation and public access.

The City Council shall adopt resolutions authorizing such teleconferencing and, if so adopted, may reauthorize teleconferencing for eligible subsidiary bodies every six (6) months by majority vote confirming that such practice serves the public interest.
VIlI. Social media use.
