Cal Valley Construction, Inc., Fresno $439,464.00 $439,464.00 WHEREAS, Addendum No. 3 provided that the apparent low bidder would be determined solely on the lowest Base Bid Total; the bids of Yanez Construction, Inc. and Harris Development Corp. dba HBC Enterprises contained arithmetic discrepancies between the unit prices bid and the item extensions written; and the City Engineer applied the unit prices as bid, as required by page 105 of the Bid Book, without changing any unit price, producing the corrected totals shown above and leaving the order of the bids unchanged; and
WHEREAS, the remaining irregularities in the low bid are minor and non-substantive and gave the bidder no competitive advantage; a Notice of Intent to Award was issued to all bidders of record on August 26, 2026 and no bid protest was filed within the protest period, which closed August 31, 2026; and the City Engineer has recommended award to Yanez Construction, Inc., the lowest responsive and responsible bidder; and
WHEREAS, the bid documents reserved to the City the right to award the three Bid Additives bid by Yanez Construction, Inc. — No. 1, Scoreboard, $18,500.00; No. 2, Playset, $135,000.00; and No. 3, Light Poles, $73,060.00 — in whole, in part, or not at all; the Bid Additives are new improvements rather than repairs to flood-damaged facilities, lie outside the scope of work approved under Project Worksheet No. 443, and are not eligible for federal or State reimbursement; and the Bid Additives are the subject of a separate resolution considered by the City Council concurrently with this Resolution and are not awarded by this Resolution; and WHEREAS, the City Council desires to approve a construction contingency, to allocate and appropriate a construction management and inspection budget, and to delegate change order and progress payment administration within those Council-approved amounts so the Project can be completed within the grant performance period ending December 31, 2026, the City Manager being charged with expenditure control and purchasing for the City under Parlier Municipal Code section

2.10.040(I).

NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Parlier as follows:

1. The recitals set forth above are true and correct and are incorporated herein by this reference, and the minor and non-substantive irregularities in the bid submitted by Yanez Construction, Inc. are waived.

2. Upon the recommendation of the City Engineer, the construction contract for the Parlier Veterans Park FEMA Repairs Project, City Project No. 225-026, is awarded to Yanez Construction, Inc. of Reedley, California, the lowest responsive and responsible bidder, in the Base Bid amount of Three Hundred Fifteen Thousand Four Hundred Ninety-Nine Dollars and No Cents ($315,499.00). No Bid Additive is awarded by this Resolution.

3. A construction contingency of Forty Thousand Three Hundred Thirteen Dollars and Seventy-Six Cents ($40,313.76) is approved, for a total authorized construction amount of $355,812.76. The contingency is equal to ten percent (10%) of the total authorized project cost stated in Section 4, and is the limit of the change order authority delegated to the City Manager under Section 6.

4. The sum of Forty-Seven Thousand Three Hundred Twenty-Four Dollars and Eighty-Five Cents ($47,324.85), being fifteen percent (15%) of the Base Bid amount, is allocated and appropriated to the Project account for construction management, inspection, materials testing and construction survey services, for a total authorized project cost of $403,137.61.

This appropriation is not part of the contractor’s authorized contract amount and is not available for change orders.

5. The City Council finds that the Base Bid work awarded by this Resolution is within the scope of work approved under FEMA Project Worksheet No. 443 and is reimbursable at the federal cost share; that the total authorized project cost of $403,137.61 is within the obligated project amount of $586,897.72; and that no General Fund appropriation is required by this Resolution.

6. The City Manager, or his designee, is authorized to approve and execute contract change orders within the contingency approved in Section 3, without further City Council action, provided that: (a) the total authorized construction amount of $355,812.76 is not exceeded, and any change order that would exceed it is presented to the City Council for prior approval; (b) each change order is supported by the written recommendation of the City Engineer and is executed in writing before the work is performed, except that in an emergency the written change order shall follow as soon as practicable; (c) no change order alters the scope of work approved under FEMA Project Worksheet No. 443 without the prior written concurrence of the California Governor’s Office of Emergency Services and the Federal Emergency Management Agency; and (d) any time extension that would waive liquidated damages is approved by the City Council.

7. Progress payments on the contract are authorized to be approved at the staff level upon the written recommendation of the City Engineer, subject to five percent (5%) retention and payment within the time required by Public Contract Code section 20104.50.

8. Final payment, release of retention, acceptance of the work and recordation of the Notice of Completion are reserved to the City Council. Change orders approved under Section 6 shall be reported to the City Council on the consent calendar not less than quarterly and again at project acceptance. The authorizations in Sections 6 and 7 apply only to this Project, remain in effect until the City Council accepts the work as complete, and may be modified or rescinded by the City Council at any time.

9. If the City Council also adopts the companion resolution awarding the Bid Additives, the City Manager is authorized to execute a single contract with Yanez Construction, Inc. in the combined amount awarded by both resolutions, provided that the contingency, construction management appropriation, change order authority and funding source established by each resolution continue to apply separately to the work each resolution awards, and that costs attributable to the Bid Additives are accounted for separately from the costs claimed for federal reimbursement under Project Worksheet No. 443.

10. The City Manager is authorized to sign the City’s standard form of contract for construction projects, as contained in the bid package and as approved by the City Attorney, on behalf of the City of Parlier.

I hereby certify that the foregoing is a full, true and correct copy of a Resolution duly and regularly adopted by the City Council of the City of Parlier at a meeting thereof held on the 3rd day of September 2026, by the following vote:
