Councilmember Hampton expressed frustration and concern regarding what he deemed to be a prolonged investigation surrounding the officer involved shooting of Anthony McClain specifically, as well as the City’s officer-involved shooting investigation process in general. He requested that the City Council recommend establishing a C ity personnel policy that would require administrative reviews to be completed within a specified time period. Councilmember Hampton advocated for City employees to be held accountable, be disciplined if they violate City employment policies, and/or (in certain circumstances ) terminated if 02 10/13/2021

Councilmember Kennedy left
the meeting at 7:24 p.m.

they are unqualified to do their jobs. He stated he believes the administrative review of personnel matters , completion of the review , and subsequent determination of the employment status should not be based on whether the actions are subject to a criminal investigation, but rather based on the violation of City policy. He strongly suggested that the City receive a second opinion on the legal process, and advocated for the City Council to establish a new policy specifying time limits to complete administrative reviews of personnel matters.

In response to Councilmember Madison, Javan Rad, Chief Assistant City Attorney, responded to questions surrounding the legal processes related to officer-involved shooting investigations.

Councilmember Madison stated his hope that the City will do better to support the investigative procedures, due process, and a fair and just conclusion that is supported by the law, the facts, and the policies and procedures of the City that are in place at the time of each incident.

In response to Councilmember Kennedy, the City Manager stated that the community has been informed of the City’s process for critical incidents and officer -involved sh ootings at a number of Council Committee meetings and community meetings. He stated that the Police Department will post on the City’s website a process flowchart, that would include information on the steps that take place following a critical incident, such as an officer involved shooting. Councilmember Kennedy requested that additional information on state l aw and City policies related to officer-involved shootings be posted on PD’s website.

Following discussion, Councilmember Hampton requested that staff forward this item to the full City Council for further discussion and requested additional data on the number of police officers terminated or separated from the City in the past 5 years.

The Chair stated that this reporting should not be limited to only the Police Department but should be transparent across all sectors of the 03 10/13/2021

In response to Councilmember Hampton request to bring this item to the full City Council, the Mayor stated he inte nds to connect after the meeting with Councilmember Hampton, the City Manager and the City Attorney.
