RESOLUTION OF THE CITY COUNCIL OF CITY OF PASADENA ESTABLISHING
INSURANCE REQUIREMENTS OF SOLID WASTE COLLECTION FRANCHISE SYSTEM
WHEREAS, Section 8.61.110 of the Pasadena Municipal Code requires that minimum levels and standards of insurance imposed on holders of non-exclusive solid waste collection franchises be established by resolution of the City Council; WHEREAS, Resolution 6850, adopted by the City Council on January 26, 1993, provides the minimum levels and standards of insurance required to be maintained by solid waste collection franchisees; and
WHEREAS, the City's insurance requirements now are maintained by the Risk and Insurance Administrator;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pasadena, California, that:
1. Pursuant to Section 8.61.110 of the Pasadena Municipal Code, the amount of type of insurance to be maintained by each solid waste collection franchisee shall be established by the Risk and Insurance Administrator, and shall be sufficient to ensure that the franchisee is able to discharge any liability which may foreseeably be imposed upon said franchisee as a result of the franchisee's solid waste collection activities and to discharge said franchisee's duty to indemnify and defend the City of Pasadena from any such liability.
2. To the extent this Resolution is inconsistent with any prior resolution setting insurance requirements for solid waste hauler franchisees, the terms of this Resolution shall prevail.
