2. DISCUSSION AND REVIEW OF AB 1766 STONE; CALIFORNIA
ID'S FOR ALL *
California ID9s for All
AB 1766 (Stone, Jones-Sawyer, Rivas, Gipson, Kalra,
Cristina Garcia, Durazo)
@ MaA Stone

SUMMARY
AB 1766 will expand California Identification Card
eligibility to all Califomians, regardless of their
immigration status.

BACKGROUND
Identification cards enable inclusion and
meaningful participation in our neighborhoods,
cities, and our state. IDs allow one to open a bank
account, obtain benefits, access healthcare, secure
housing, and much more. Californians have access
to a few different options for identification:
• California Identification Cards are used to prove
one's identity or age but do not allow someone
to operate a motor vehicle. Only California
residents who are lawfully present in the U.S.
can obtain the official state ID.
• Driver's Licenses are available for applicants
that can prove legal presence in the United
States and categories of people including U.S.
citizens, U.S green card holders, and Deferred
Action for Childhood Arrival (DACA)
recipients can apply for them.
• AB 60 (Alejo, 2013) Driver's Licenses are
available for applicants who can provide proof
of identity and California residency to obtain a
driver's license but are not required to prove
their legal presence in the United States.
• The federal REAL ID can be used to board
flights within the United States and enter secure
federal facilities, such as military bases and
federal courthouses. The Real ID is only
available to those with legal presence in the
nation.

In some instances, a California resident is ineligible
or unable to obtain a government-issued ID
altogether. These instances include people who do
not have meaningful access to a car, or have the
ability to take a driving test. In these cases, a person is expected to rely on ID s such as gym
memberships or college/university IDs ;/they have
access to those institutions. Otherwise, they may
use a consular ID or foreign passport to corroborate
their identities. However, this is an often dangerous
"outing" process for those who are not lawfully
present in the United States, hence making them
feel unsafe and vulnerable in revealing that they are
foreign nationals living in the U.S.

PROBLEM
There are approximately 2.7 million undocumented
people in California. Since more than a million
people have obtained a driver's license under AB
60, there are approximately 1 .7 million
undocumented people who are eligible and could
benefit from having a state govemment-issued
identification card.2
In particular, women, elders, and people with
disabilities are disproportionately impacted by the
inability to obtain an AB 60 driver's license.

Women within a household are less likely to have
access to a car than their male counterparts.3
Additionally, people with mobility issues,
disabilities such as epilepsy, and elders who
develop degenerative eye, muscular, or cognitive
diseases are unable to obtain driver's licenses and
thus, do not have any access to state government-
issued IDs. Finally, undocumented people leaving
incarceration are also unable to obtain an original
AB 60 driver's license because they cannot take a
driving test while in prison.

AB 1766 will expand ID access for all, regardless of
immigration status. Lack of identification is one of
the largest barriers to successful reentry into the
community as IDs are essential to securing housing,
social services, and other benefits.

SOLUTION
' "Profile of the Unauthorized Population - CA." migrationpolicy.org, November 1,2021. https://www.migrationpolicy.org/data/unauthorized- immigrant-population/state/CA.
2 "DMV Surpasses 1 Million Driver Licenses under AB 60." California DMV, June 15,2020. https://www.dmv.ca.gov/portal/news-and-media/dmv- surpasses-l-million-driver-licenses-under-ab-60/.
3 Carlier, Mathilde. "U.S. Car Owners by Gender 2021." Statista, December 22, 2021. https://www.statista.com/statistics/l 04121 5/us-car-owners-by-sex/.

Since 2013, the state has continued to expand
services to all Califomians. The ID is the most
essential gateway to meaningful participation and
inclusion, and as such, they should be available to
every California resident.

AB 1766 requires the Department oflVIotor
Vehicles (DMV), by January 1, 2024, to issue a
California identification card to applicants unable to
provide satisfactory proof of their status in the
United States as authorized under federal law.

PLANNING COMMISSION
Wednesday, June 8, 2022

1. ROLL CALL

2. PUBLIC COMMENT NOT ON THE AGENDA

3. APPROVAL OF MINUTES
A. APRIL 13, 2022 - CONTINUED FROM MAY 25, 2022
APRIL 27, 2022

4.DIRECTOR'S REPORT

PUBLIC HEARINGS

5. FULLER THEOLOGICAL SEMINARY MASTER PLAN AND DEVELOPMENT AGREEMENT AMENDMENTS (270-282 NORTH LOS ROBLES AVENUE)
The proposed amendments to the Fuller Theological Seminary Master Plan and Development Agreement, originally adopted in 2006, would exclude the property at 282 N. Los Robles Avenue from both the Master Plan and Development Agreement, in order to facilitate the construction of a six-story multi-family residential development with 105 dwelling units. The property at 270 N. Los Rabies Avenue is a part of the project site but is not a part of the Master Plan or Development Agreement. No other changes to the Master Plan or Development Agreement are proposed.

It is recommended that the Planning Commission:
1) Recommend that the City Council find that the project is exempt from the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines Section 15305 (Class 5: Minor Alterations in Land Use Limitations) and 15332 (Class 32: In-fill Development Projects);
2) Recommend that the City Council adopt the findings and conditions of approval for the proposed amendments to the Fuller Theological Seminary Master Plan; and
3) Recommend that the City Council amend the 2006 Development Agreement.

Case Manager: David Sinclair

6. RENEWAL OF PLANNED DEVELOPMENT #36 (3200 E. FOOTHILL BLVD.

PLANNED DEVELOPMENT)
A request to renew the Planned Development (PD) Plan for PD-36, originally approved by the City Council on July 16, 2018 and became effective on August 26, 2018, per Ordinance No. 7328. Pursuant to Section 17.26.020.c.3.e of the City's Zoning Code, a PD Plan shall expire two years from the effective date of the ordinance. However, on March 30, 2020, the City Council adopted Resolution No. 9774 suspending certain time limits, and extending the timeline of approvals of Planned Development by 24-months, in this case to August 26, 2022. The request is to renew the PD Plan for two additional years (August 26, 2024) from the expiration date.

Staff Recommendation:
1) Find that there are no changed circumstances or new information as part of the proposed application that necessitate further environmental review beyond the Sustainable Communities Environmental Assessment (SCH#2018021017) by City Council on July 9, 2018;and
2) Approve the renewal of Planned Development #36.

Case Manager: Alison Walker

7. PLANNED DEVELOPMENT #39 (AFFINITY PROJECT) - 465-577 S. ARROYO

PARKWAY
The applicant, The Arroyo Parkway, LLC, has submitted applications for a Planned Development (PD) District and Variance for Historic Resources on a 3.3 acre site to facilitate the Affinity Project, which proposes demolition of six (of the nine) existing commercial buildings, and construction of two seven-story buildings consisting of medical office uses, assisted living and independent living uses, and ground floor commercial uses. Included is the ability to exchange medical office uses for up to 197 residential dwelling units. Up to five new levels of subterranean parking would accommodate the uses. The three existing buildings retained by the Project include the Whole Foods Market and an associated subterranean parking structure at 465 South Arroyo Parkway, and two historic structures at 501 and 523 South Arroyo Parkway.

It is recommended that the Planning Commission:
1) Continue the project to a date certain.

5. REVISION OF PD #21 - 250 N. MADISON AVENUE
A request to modify the Planned Development (PD) Plan for PD #21 (Montgomery Engineering), originally approved by the City Council on September 12, 1988.

Currently, the PD Plan limits uses to offices associated with a college (Fuller Theological Seminary). The revision to the PD Plan would allow administrative office uses not associated with a college.

It is recommended that the Planning Commission:
1) Find that the proposed amendment to PD #21 is categorically exempt from environmental review pursuant to the guidelines of the California Environmental Quality Act (Public Resources Code Code §21080(b)(9); Administrative Code, Title 14, Chapter 3, §15301, Class 1, Existing Facilities); and there are no features that distinguish this project from others in the exempt class and, therefore, there are no unusual circumstances; and
2) Adopt the Findings and approve the revision to PD #21; Case Manager: Martin Potter

6. CENTRAL DISTRICT SPECIFIC PLAN STUDY SESSION
Staff will hold a second study session with the Planning Commission to present an update on the Central District Specific Plan (CDSP), focusing on plan boundaries and standards that would regulate future development in the plan area.
