Public Comment to the City Council of Pasadena re. Rent Control Gentlemen and Gentlewoman of the Council,
I wish to voice my support for the Rent Control Measure which must be placed on the ballot for our vote in November 2022.
I am currently one of the hundreds of tenants who are facing displacement from their homes due to the blatant disregard of greedy owners in this City. I am a long term resident in this space (8+ years) along with fellow tenants at our address who have resided here even longer (up to 16+ years). We are stable and conscientious tenants who have never been late on a rent payment during our entire residency period and maintain our homes in pristine condition with no help from the current owners/management. I am a senior citizen who resides in the unprotected 1910 house apt. portion of the property. I have invested over $1000 in a Victorian garden to beautify the side area of this complex for all tenants to enjoy. It would otherwise be dirt. I have lived with damage to the interior of my apt. space from upstairs construction for over a year, neglected by the Owners - Owainat Properties, LLC and Phamily Management, despite being promised repairs by the owner. If I was capable of making those repairs myself I would have. I take pride in this entire complex. Phamily Management Company has been impossible to work with, bending to the owner's wishes by blocking us from our online payment portal, refusing to apply our August rent payments to our accounts (despite the payments being cashier's checks, hand-delivered and accepted at their office), harassing the tenants with phone calls about when we will be vacating and not acknowledging any of our correspondence which was confirmed to have been priority delivered by the USPS.
During Covid, despite many challenges, the tenants remained and always paid rent in a timely manner. When this property was purchased from the estate of our wonderful prior owner in October 2020, immediate rent increases were announced. We sustained the maximum rent increases allowed by the current rent cap of 10%.
This is not a minor increase and has raised my own rent almost $400 in 2 years. But, greedy for much more substantial increases, a majority of the tenants have now been told to vacate in order to maximize the rent on these units by virtue of fraudulent "intent to remodel" language. Rent Control would have protected us from being treated like inconsequential residents whose good track records and stability would be valued anywhere else in this country. Instead, the only tenants being allowed to remain (despite supposed "major renovations") have been currently installed at higher rents. Their apts. have not been remodeled and it is clear that remodeling is not the actual intent. Removal of the longest term residents to obtain the highest rents the market will bear is the intent.
With the horrendous rise by as much as 32% in rents here in Pasadena and the accompanying hike in the CPI due to inflation, these actions are lethal for tenants. The only protections we can hope for will be provided by Rent Control. We, as tenants, are the backbone of this City; good, law-abiding, respectable citizens who pay their rent. We enjoy the quality of life in Pasadena, but we are being driven out by this unbridled greed for beyond-reasonable rent. Rent Control will prevent the investment companies from buying up every available 08/08/2022

property in order to displace current residents and skyrocket rents. This is destabilizing our community in an unconscionable way.
Tenants in this City, who are 60% of the population, have worked hard to obtain the necessary signatures to place this matter on the ballot. Please support your tenant base, "your voters" and support this measure. We expect your support for the good of our tenant community which increasingly appears to be only for landlords.
You represent us all, not just property owners. Take a stance of support, make the language viable and applicable, and place this measure on the ballot.
Thank you.

Dear Mayor Gordo and City Councilmembers,
Opposing Rent Control
1. Every rent-controlled community has fewer poor and minority residents compared to other non-rent controlled communities because the populations that live there have greater ability to stay in one place for longer periods of time.
2. Deterioration of existing housing stock - owners end up just staying compliant instead of making significant improvements.
3. Market prices end up being higher. Look at all rent-controlled cities. They are all very expensive.
4. Harder for tenants to find a place to live because no one moves once they have a rent-controlled unit. This is proven time and time again in rent-controlled areas.
5. Adding more expenses to Pasadena owners and renters to fund bureaucracy to monitor units is counter-productive.
6. AB1482 already established rent caps that are in line with current inflation. No need for any more.
Best option would be to create an investor-friendly environment that will encourage an increase of new construction. The more laws created to restrict, the further you are pushing investors away.

Dear Mayor Gordo and council members,
I urge the council to oppose the rent control ballot measure. The City of Pasadena is already covered by the state rent control law AB 1482. A ballot initiative would bind the city with housing policies that will make housing more expensive and harder to find.
The staff study highlights numerous issues, pitfalls and questions that voters will reject. Strict price controls are not a new concept. Study upon study has shown rent controls do not work and have counterproductive consequences.
It is important you take a stand and oppose this awful housing policy.
Thank you for your consideration.

To All,
The rent control ballot initiative as proposed creates an undue bureaucracy. This new program creates an 11-member Rental Housing Board that would oversee various rent stabilization and eviction regulations.
All at an estimated cost reaching over $5 million, which would be funded exclusively by Pasadena rental property owners. This is unnecessary and will greatly impact Pasadena's real estate market.
With this mind, please deliberate your position on the Pasadena Rent Control Charter Amendment and vote "no" on this proposal. I sincerely appreciate your consideration on this matter.
Thanks,
Mike

Dear Mayor Gordo and All Councilpersons,
I encourage you to oppose Rent Control in Pasadena. It does nothing to keep the rents low. Just take a look at some of the highest places to rent in the country - San Francisco and Santa Monica.
Here's an article that was published in the Washington Post.

The one issue every economist can agree is
bad: Rent control

Residential and commercial buildings in New York. (Spencer Platt/Getty Images) 1 There aren't that many things you can get economists to agree on. Fiscal stimulus, minimum wages, monetary policy, health care, bank regulation — on almost all the major issues of the day, you can find a respected economist to argue for either side.
Sign up for a weekly roundup of thought-provoking ideas and debates But there are a few questions where there's near unanimity, and rent control is one of them. Pretty much every economist agrees that rent controls are bad. And in the last decades of the 20th century, economists had some success persuading state and local governments to curb these policies.
Now the policy appears to be making a comeback. Two rent-control bills have cleared the housing committee in California's state legislature, and New York state looks like it's about to stiffen New York City's rent-stabilization regime and ofter other cities the option to copy it. City governments may have to relearn why their predecessors pruned back rent-control policies.
Rent control is supposed to protect poor, deserving tenants from the depredations of greedy landlords. And it does, up to a point. Research on rent control shows that many of the beneficiaries are low-income, and that controlling their rents makes it more likely that they'll stay in their apartments for a good long time.
Follow Megan McArdle's opinionsFollow
The problem is that rent control doesn't do anything about the reason that rents are rising, which is that there are more people who want to live in desirable areas than there are homes for them to live in. Housing follows the same basic laws of economics as other goods that consumers need: When the demand for a product consistently exceeds the supply, prices will rise until the quantity demanded is equal to the amount that suppliers have available.
As long as there's no new construction, controlling that natural increase is just a game of musical chairs. You can change which people get to live in a city, but you still leave just as many people out in the cold. Actually, a few more, because rent control also reduces the incentive to supply rental housing.
All this suggests an actual solution to skyrocketing rents: Build more housing, so that the rent controls won't be necessary, and offer subsidies to the smaller number of low- income people who simply can't afford decent housing. To do that, cities would need to ease the costly land-use regulations that make it so difficult for developers to fill the unmet demand. And in many cases, cities would also need to get rid of rent control, both to reassure potential landlords that they can build without fear of new controls and to encourage landlords to tear down smaller buildings and put up bigger ones, something that rent protections often prevent.
ADVERTISING
Alas, that's not going to happen, so coastal urbanites should brace for what will.
Declining housing stock is just one of the many potential costs of rent controls; others include a deteriorating housing stock as landlords stop investing in their properties, and higher rents. Yes, higher, because rent control creates a two-tier housing market. There are cheap, price-stabilized apartments that rarely turn over, because why would you give up such a great deal? Then there are the uncontrolled apartments, which everyone else in the city has to fight over, bidding up the price.
Perversely, the people paying above-market rent are often worse off than the people enjoying a hetty subsidy from their landlords. There's no means test for rent-stabilized housing, and while the average income of people in New York's rent-stabilized apartments is somewhat lower than that of people in market-rate housing, a recent analysis by the Wall Street Journal showed that the people getting the biggest benefit are white, affluent Manhattanites who presumably landed the apartments decades ago and held on while rents rose around them.
That could be an argument for controlling the rent on all the housing stock. But cities don't do that for a reason: If you force the price of something below market level, people will supply less of it. Since cities tend not to impose rent controls unless they're already experiencing a severe housing shortage, that would be bad. Thus, rent control usually applies only to older buildings, since you can't go back and unbuild an apartment house that was constructed before 1947. It doesn't completely solve the problem, since landlords still withdraw less-profitable units from the market, shrinking the housing stock over time. But it turns what would be a disastrous policy into one that is merely terrible.
"Merely terrible" is a low aspiration for something as important as housing policy, but at this point it's probably the best that New Yorkers and Californians can hope for.
Thank you for listening.

Dear Mayor and City Councilmembers,
First off, thank you for your service to our city and its residents! Being a long time Pasadena resident, born and raised here, and having worked here my entire career, I have seen this city's growth and changes take place. Sometimes bad but mostly really good! I am reaching out today to strongly urge you to vote against enacting any new Rent Control laws in our city! We do NOT need more oversight as property owners and landlords. I see how Rent Control in the City of Los Angeles negatively impacts owners, landlords, and families. Our recent State Rental laws with AB1482 is perfectly sufficient to protect renters both in our state and city.
Please vote no on this new Ballot Measure!
Thank you,

Dear City Councilmember,
I respectfully request that you OPPOSE the rent control ballot measure.
Such a measure will destroy ownership by small Mom & Pop owners who have worked so hard to acquire a property for retirement savings or investment purposes. There are already so many costs owners must pay to maintain a habitable residence or units) and rent control will only detriment our ability to do so. There are no measures to protect from the rising costs of property taxes, insurance, repairs and other structural requirements or ordinances that are passed. There are only proposed measures to limit the funds by which an owner may use to cover these costs. If rent control is allowed to become law, at some point only institutional owners will exist in the housing market. Why would any individual want to invest in a rental property when they are ultimately subsidizing someone else's residence? We can't charge market rate but can get sued and lose our property if we make a mistake or can't cover the cost of a repair on a timely basis because we have limited income and cost keep skyrocketing. It makes NO ECONOMIC SENSE. Pretty soon there will be a glut of unrented units because the institutional owners can just wait to make a profit without dealing with the headaches that come with tenancy.
Please protect the investment that we and so many other individuals have worked so hard to make so we can be self-sufficient now and/or in the future. 08/08/2022

August 8, 2022
To: Pasadena City Council
From: Greg Anderson, 40 Year Pasadena Rental Housing Provider and Affordable Housing Developer
Re: Pasadena Rent Control Charter Amendment
Council Members:
Please consider the following as you deliberate your position on the Pasadena Rent Control Charter Amendment:
PASADENA ALREADY HAS RENT CONTROL AND JUST CAUSE EVICTIONS THROUGH THE STATEWIDE TENANT PROTECTION ACT (AB 1482) EFFECTIVE JANUARY 1, 2020, and which does not limit annual rent adjustments to below the CPI rate of inflation (with no control on operating costs) as would Pasadena Rent Control.
THE AUGUST 2022 OBJECTIVE ANALYSIS PREPARED FOR THE CITY OF PASADENA CONCLUDED THE FOLLOWING:
"The provisions outlined in the proposed Amendment would add a new and complex government function in Pasadena."
08/08/2022
Item 11, 12, 13
1 b. A new 26-member (or larger) bureaucracy would be created and the entire estimated $5,800,000 start-up cost and estimated $5,500,000 year 2 cost (and annually thereafter WITH NO COST CAPS) of Rent Control would be paid entirely by Pasadena rental housing providers.
C. The Rental Housing Board must include seven tenants serving initial four-year terms ". ...who do not have a material interest in (and therefore no experience) in rental property...." Four additional at-large members and two alternate members may also be tenants.
The 11-member Rental Housing Board would have complete independent discretion to act without City Council control or oversight. e. Each member of the 11-member Rental Housing Board will be compensated $40.28/hr. for up to 20 hours a week ($805.60 per member per week) and up to $3,453 monthly ($40.28 x 85.71/hrs. per month). The estimated weekly cost of the Rental Housing Board is $8,861, and $530,200 for year 1 inclusive of Workers' Compensation, general liability insurance, benefits and Medicare, all of which will be paid entirely by Pasadena rental housing providers. f. The Rental Housing Board will solely determine the annual fees paid by Pasadena rental housing providers which are estimated year 1 to be is $184 per unit x 31,316 Pasadena rental units.
g. The Rental Housing Board would have sole discretion to determine what is a "fair return" to Pasadena rental housing providers.
h. The Objective Analysis did not consult Pasadena housing providers and does not analyze actual conditions and what occurs in the ongoing rental of the 31,316 Pasadena rental units that would be controlled by the Rental Housing Board. None of the generalized conclusions in the Objective Analysis were applied to what actually occurs in Pasadena.
i. The Objective Analysis states, "Landlord income from each property will vary widely depending on the starting rents, tenancy turnover rates, vacancies, operating costs over time, and market conditions. As a result, the financial effects on landlords_from the rent stabilization regulations in the Amendment cannot be estimated." j. "The long-term impacts of second generation rent regulations were not addressed in the literature reviewed."
3. THE OBJECTIVE ANALYSIS DID NOT CONSIDER WHAT ACTUALLY OCCURS IN THE ONGOING RENTAL OF 31,316 PASADENA RENTAL UNITS AND COULD NOT ESTIMATE
THE FINANCIAL EFFECTS ON PASADENA RENTAL HOUSING PROVIDERS OF RENT CONTROL AS DETERMINED BY A TENANT CONTROLLED RENTAL HOUSING BOARD.
5. THE PROPONENTS OF RENT CONTROL HAVE ALSO NOT MADE THE CASE THAT 31,316 PASADENA RENTAL UNITS AND HUNDREDS OF MOSTLY SMALL RENTAL
HOUSING PROVIDERS MUST NOW BE MADE SUBJECT TO CONTROL BY A POLITICALLY
APPOINTED RENTAL HOUSING BOARD CONSISTING OF TENANTS WITH NO RENTAL HOUSING OPERATING EXPERIENCE. THIS IS AN OBVIOUS CONFLICT OF INTEREST THAT SHOULD BE AVOIDED.
Pasadena's rental housing is primarily older (40-100 years) which requires a high level of increasingly expensive maintenance and continuing replacements and upgrades to remain functional. This is a delicate market balance and the imposition of price (rent) controls at below the rate of inflation and with no controls on increasing operating expenses will inevitably result in 2 serious adverse impacts to Pasadena's rental housing. How do adverse impacts to Pasadena rental housing not result from the punitive controls and costs in this Charter Amendment? I believe that an analysis of what actually occurs in Pasadena would show a substantial number of smaller mom and pop owners that over the years have generally kept rents below market, been sensitive to tenants with particular needs and limited income, and that take good care of their property. My experience and observation over 40 years is that the Pasadena rental market has generally worked well and has encouraged both the maintenance and preservation of its aging housing stock and the development of new rental housing.
I also believe that a complete analysis would show that any bad actors in the Pasadena rental market are limited and represent a very small percentage of the 31,316 Pasadena rental units.
To the extent there is a discernable problem that is not adequately covered by the AB 1482 Statewide Tenant Protection Act effective January 1, 2020, and the extensive tenant protections already provided by California law, the other 99% of us that are and have been responsible Pasadena rental housing providers would support the Council in structuring targeted tenant recourse, possibly consisting of empowered neutral arbitrators at a fraction of the cost, rather than imposing a continuing bureaucratic structure on 31,316 Pasadena rental units and costing millions yearly.
For all of the above reasons I urge the Council to oppose Rent Control and pursue alternative targeted tenant recourse for any specifically identified issues in Pasadena.
Sincerely,
Greg Anderson

Hi Felicia,
I had emailed you about this before, but everyone knows that rent control discourages builders/developers for developing housing units, discourages rental maintenance/improvements and makes landlords not want to invest in Pasadena.
Please do not be so short sided as to pass any rent control measures ... they has never worked and I don't think you want Pasadena to be of one of "those" cities. If left alone, supply and demand will balance each other out, but discourage people from building/improving/maintaining and the next thing is the only one building is the city...
As a Pasadena born property owner, I urge you whole heartly to not be a part of the problem and vote "NO!" on any rent control measures.

Thank you for your consideration.--

Please support the housing providers who work to provide fair and equitable accommodations for the residents of Pasadena. We already have enough bureaucracy from the state and county, and additional restrictions will have many housing providers exit the city, or convert their housing to commercial units as we've seen throughout the pandemic. PLEASE SUPPORT HOUSING PROVIDERS AND DO NOT ENABLE further restrictions on housing providers.

Council Member Williams, Council Member Masudo and Mayor Gordo I write to you as a Pasadena property owner and landlord. My wife and I live in District 2 on S Grand Oaks Ave, and we own and manage a 12-unit apartment complex in S Virginia Ave in District 4. We urge you to oppose the proposed rent control Charter Amendment today for the following reasons. - Landlords and property owners have worked hard to keep people housed during the COVID 19 crisis. We ourselves gave rent breaks of over $20,000 to help keep people current. For over two years, we have been unable to raise rents or (when necessary) use the threat of eviction to deal with bad behavior from tenants. During that time, we have faced major increases in our costs, such as: utility prices have risen over 50%, lumber and other repair materials have more than doubled in costs, residents have shifted their buying habits to Amazon deliveries leading to increases in trash from packaging and a 20% rise in our trash hauling costs. We have been using our personal funds to pay for maintenance, and we are not in a financial position to absorb any further impacts caused by rent control.
The proposed cost to landlords of $184 per unit is not trivial. It is around one percentage point of total rent income for a year, and this is a business that measures its profit margins in terms of a very few percentage points (typical "cap rates" for rental property sales in Pasadena are 3-5%). - The proposed Rental Housing Board is simply another layer of bureaucracy. The analysis from Management Partners already proposes 26 new FTE, plus 11 board members, plus 2 alternate board members. That's 39 jobs, and anybody with experience in government spending knows that the numbers only increase, not decrease.
08/08/2022
Item 11, 12, 13
- The Board's requirement to have seven of its eleven members be tenants, is explicitly in conflict with its role in permitting rent increases. The board members will have no incentive or experience to understand the position of landlords.
Meanwhile, the Board's role in allowing rent reductions when petitioned by tenants, is likely to be weaponized by tenants. We have already spent the last 12 months dealing with one tenant who has sued us in Pasadena Small Claims Court alleging defamation (she lost because it wasn't true) and who has dragged us through a Department of Fair Employment & Housing complaint alleging racism (the DFEH has ruled against the claim because it's also untrue). Allowing tenants a weapon like this will simply add to the level of harassment that landlords face.
Ms Williams, Mr Masudo, Mr Gordo - we're just small business owners in Pasadena. We've worked through everything the City has asked of us in the last two and a half years, but this is a step too far. Please consider the impact this bureaucratic, expensive, anti-business proposal would have on people like us, and please consider putting your weight behind making it easier for us to build new housing units instead, so we can fix the housing supply problem.

Mayor Gordo and Distinguished Council Members,
I have owned investment property in Historic Highlands area of Pasadena for many years. I work hard to maintain my properties, invest significantly in them, and charge fair market rents to tenants, all of whom appreciate the safety, cleanliness, and functionality of their homes.
I strongly OPPOSE Charter Amendment Rent Control Measure on November, 2022 ballot. This program creates an 11-member Rental Housing Board that would oversee various rent stabilization and eviction regulations, all at an estimated cost reaching over $5 million, which would be funded exclusively by Pasadena rental property owners.
The proposed measure is wasteful bureaucratic overreach that will not benefit tenants or landlords. This measure will simply create more unneeded governmental intervention and waste. Rental prices will stabilize in the coming years as we all emerge from COVID-19 pandemic market shifts, please allow fair market value to correctly price the market without this proposed layer of bureaucratic waste that benefits nobody, other than the extraneous agency it will create. 08/08/2022

Good morning,
While my email will more than likely be overlooked, I want to bring to your attention that no rent control in California or possibly the world has even created more housing, or a lower rental price. It has time and time again made rent prices higher, relationships sour between landlords and tenants, and worst of all slow down the economy. If you look at your city as a whole you have been without rent control for many years while other cities have imposed it. Your rental market has always been for the money a value to what is charged in those other communities, and things have been good for the renters and the landlords. Do a quick study on Glendale a city who was in your same situation less than 5 years ago, and now their rental prices have skyrocketed. Its simple economics, if you control the supply (people staying longer than they would as they are in a rent controlled unit) then the price has to go up.
I truly hope you do not approve this measure as there is no point to it. I am a property manager who has no skin in the game if you will. I have seen what rent controls do to relationships and prices and you do not want this for your city.
Sincerely,
08/08/2022

Dear Council members,
As someone who has worked in Property Management for over 30 years and am currently an essential housing provider in the City of Pasadena I urge you NOT to support the Ballot Measure.
This measure is over reaching and will cost the City of Pasadena millions of dollars in litigation costs over the next several years.
Many of the regulations outlined in the Ballot Measure result in costly litigation because they violate the housing providers rights. According to the Ballot Measure the Board (comprised of individuals with no stated financial competency requirements and likely no Property Management Experience) the right to hire outside legal counsel (without permission from City Council) and The City of Pasadena would be required to pay the bill.
In neighboring cities such as Highland Park and Eagle Rock (City of LA Rent Control) rent prices are even higher than Pasadena.
1 08/08/2022
Item 11, 12, 13
Basic Tenant Protections and Rent Control (such as AB1482) are good and fair. Stricter rent control forces more and more housing providers to raise rent annually whereas in the past most of us did not.
Stricter Rent Control and Tenant Protections will NOT keep rent lower for the majority of residents.
There are AB1482 as Well as City Of Pasadena Tenant Protection Ordinance policies already in place. If these regulations were enforced then most issued would be addressed.
I realize that you have no power to stop the Ballot Measure, YET, endorsing it is a whole other thing.
Our residents need to hear from the voices of reason WHY the current Ballot Measure is Bad for Pasadena.
Please Vote NOT to Endorse the Ballot Measure.
Sincerely,
Deborah Lutz

Re: RENT CONTROL BALLOT MEASURE.
Dear Mayor Gordo, Vice Major Wilson and council members, My parents were Pasadena residents since 1957 and owned rental units and my father operated a restaurant in Pasadena since the early 1970. My wife and I are also long term residents of Pasadena. I am self employed as an attorney in Pasadena and represent both tenants and landlords.
I urge the council to oppose the rent control ballot measure. The City of Pasadena is already covered by the state rent control law AB 1482. A ballot initiative would bind the city with housing policies that will make housing more expensive and harder to find. It also increases the tax burden on Pasadena residents.
The staff study, which I have read, correctly highlights numerous issues, pitfalls and questions that should cause you to oppose the policy. The proposed policy doubles down on all the issues which negatively affect all citizens. It will increase taxes on all and impose additional burdens on landlords. That motivates landlords to leave the landlord "business". The increased burden will negatively affect tenants by decreasing landlord maintenance and requiring landlords to raise the rent to the maximum legal limit when many "small unit" landlords prefer to retain long term tenants by not increasing rent.
Strict price controls are not a new concept. Many studies have shown rent controls do not work and have counterproductive consequences. It is important you take a stand and oppose this awful housing policy. Thank you for your consideration
Sincerely,
PETER E. RONAY
