RECEIVE REPORT RELATING TO THE CARRYING CONCEALED

WEAPON PERMIT PROCESS
Jason Clawson, Interim Chief of Police, introduced the item, and Thomas Blanchard, Temporary Police Lieutenant, provided a Powerpoint presentation and responded to questions.

Following discussion, Committee members requested that staff provide additional information on the process for determining the "good moral character" requirement for the Concealed Carry Weapon (CCW) permit applications. Javan Rad, Chief Assistant City Attorney, stated that staff will contact the California Attorney General's Office for additional guidance on this requirement.

In response to Councilmember Jones' questions about the proposed requirement of three letters of reference for CCW permit applicants, Lt.

Blanchard shared that the Pasadena Police Department (PPD) is proposing that CCW applicants submit one letter of reference from a family member and the remaining letters from non-family members.

Mayor Gordo noted that the fees proposed as part of this permit process are based on a 100% cost recovery model for the Police Department, and asked staff to examine the model used by the City of San Jose.

In response to Councilmember Hampton's question about the psychological examination required as part of the application process, Lt. Blanchard shared the proposed evaluation (Minnesota Multiphasic Personality lnventory-3 (MMPI-3) is similar to the exams taken by Police Officers, citing California Penal Code Section 26190, which states, "If psychological testing on the initial application is required by the licensing authority, the license applicant shall be referred to a licensed psychologist used by the licensing authority for the psychological testing of its own employees."
It was noted by Chris Kirby, Police Sergeant, that as part of the development of the concealed carry weapon application process, PPD staff contacted the Los Angeles County Sherriffs Department, Los Angeles Police Department, San Gabriel Police Department, Torrance Police Department, and Gtendale Police Department, and determined that each agency was similarly updating their CCW application process, and was able to compare the modifications being made to Pasadena's process from a best practices perspective.

In response to Councilmember Jones' question about determining "good moral character", Sgt. Kirby shared that a background investigator will review the submitted letters of reference and conduct an investigation to confirm there are no reasons for the applicant to be disqualified. In addition, the licensed Psychologist administering the MMPI-3 evaluation will determine whether the applicant is "suitable" or "not suitable".

In response to Councilmember Hampton's question about examples of automatic disqualifiers, Interim Police Chief Clawson responded that the criterion for making determinations is subjective and varies on a case-by-case basis, but the Police Department will be fair and balanced in its approach to issuing CCW permits to community members.

Mayor Gordo requested that the City Attorney's Office and City Manager work together to provide guidance on the application process.
