Board of Zoning Appeals/determination of Planning Director (DHP2022-00231) Appellant’s Concept Design Review application was deemed incomplete based upon (1) the non-payment of fees, (2) the failure to file a notification packet, (3) the failure to file documentation showing the requested concession will result in cost reductions, and (4) non-compliance with the density, FAR and other
development standards set-forth in the Zoning Code. The fees have been paid and the notification packet has been filed. This appeal is being filed because items 3 and 4 violate State law and the BZA failed to address them. The fact that these determinations are included in the Incomplete Letter does not mean the determinations are not appealable and do not have to be addressed by the staff or Board of Zoning Appeals. Last, to the extent staff says that these determinations and/or compliance with the zoning code’s development standards will be addressed by the Design Commission as part of its concept design review hearing, which is a discretionary hearing, they further violate state law.
