CITY COUNCIL

CITY ATTORNEY
Agenda Report
December 5, 2022
SUBJECT: REVISION OF DESIGNATED CITY OFFICIALS AND

EMPLOYEES REQUIRED TO FILE CONFLICT OF INTEREST

STATEMENTS
RECOMMENDATION:

It is recommended that the City Council adopt a resolution updating those who will be required to file conflict ofinterest statements as pertaining to positions within various City departments.

BACKGROUND:

The City is required, by California Fair Political Practices Commission ("FPPC") regulations, to update its Conflict of Interest Code at this time, which will be accomplished by approval of the attached Resolution. In addition to its substantive reporting requirements, two appendices are attached to the Resolution. Appendix A is a list of employees, commissioners and consultants who must file reports under the Conflict of Interest Code along with the disclosure category assigned to each position based on the type of duties that an individual performs. Government Code Section 87302 exempts from listing in Appendix A, those positions listed in Government Code Section 87200, including City Council Members (as they are separately required to report their interests). Appendix B contains a detailed description of the disclosure categories and the specific FPPC reports which must be filed by persons in each category.

Appendix A includes the many position changes in departments throughout the City. No employees who were previously required to file conflict of interest statements have been exempted from doing so in this revision. All changes are reflected by bold; deleted positions are HAed out.
