SUBJECT: INDEPENDENT REVIEW OF THE OFFICER-INVOLVED SHOOTING OF
ANTHONY MCCLAIN
RECOMMENDATION:
Review the OIR Group report and responses from the Police Department, and determine appropriate referral to the Community Police Oversight Commission ("CPOC").
BACKGROUND:
Following the August 15, 2020 officer-involved shooting death of Anthony McClain, OIR Group was retained by the City to conduct an independent review of the shooting. OIR Group has reviewed two prior Pasadena officer-involved shooting deaths, from 2009 (Leroy Barnes) and 2012 (Kendrec McDade).
For the McClain officer-involved shooting, OIR was contracted to, among other things: (a) review the incident itself, as well as the Police Department's administrative review of the incident; (b) prepare a report that can be publicly disclosable; and (c) make a public presentation of the report to the City Council and/or Public Safety Committee.
On April 20, 2023, the City published OIR's report on the McClain shooting, as well as the Police Department's response to OIR's recommendations. Both OIR's report and the Police Department's response are attached to this Agenda Report.
The City Council established the Community Police Oversight Commission in October 2020. The ordinance establishing the CPOC states its purpose "is to enhance, develop, and strengthen community-police relations and review and make recommendations regarding the ongoing operations of the police department to the chief of police, city manager, and/or city council." Given the depth of OIR's report and the Police Department's response, the City Council may wish to determine the appropriate referral to the CPOC.
