Agenda Report
February 5, 2024
TO: Honorable Mayor and City Council
FROM: Water and Power Department
SUBJECT: REJECT ALL BIDS TO FURNISH AND DELIVER CONCRETE

MATERIALS FOR THE WATER AND POWER DEPARTMENT
RECOMMENDATION:

It is recommended that the City Council:

1. Find that the proposed action is exempt from the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b)(5) (projects which a public agency rejects or disapproves) and Section 15270 of the State CEQA Guidelines; and

2. Reject all bids received on December 5, 2023, in response to the Notice Inviting Bids to Furnish and Deliver Concrete Materials.

BACKGROUND:

The Water and Power Department ("PWP") developed bid specifications to furnish and deliver concrete materials for ongoing projects, as needed. The bid specification invited responses to award a contract to the lowest responsible and responsive bidder to furnish and deliver concrete materials.

A Notice Inviting Bids was advertised on OpenGov on November 16,2023. The electronic posting generated 2,708 notices to prospective bidders. A total of two bids were received on December 5, 2023, one from Technology International, Inc. and one from Robertson's Ready Mix LTD.

COUNCIL POLICY CONSIDERATION:

Rejecting all bids supports the City Council's goals to maintain fiscal responsibility and stability.

Public Resources Code Section 21080(b)(5) and Section 15270 of the State CEQA Guidelines is exempt from CEQA "projects which a public agency rejects or disapproves." The rejection of bids for a company to Furnish and Deliver Concrete Materials is exempt from CEQA per these Sections.

FISCAL IMPACT:

There is no fiscal impact as a result of this action.
