Agenda Report
September 23, 2024
TO: Honorable Mayor and City Council
THROUGH: Finance Committee
FROM: Police Department
SUBJECT: AUTHORIZE THE CITY MANAGER TO TRANSFER TITLE OF A 2006
BIG TEX TRAILER TO THE CITY OF ARCADIA
RECOMMENDATION:
It is recommended that the City Council:
1. Find that the action proposed herein is not a "project" subject to the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 21065 and within the meaning of Section 15378(b); and
2. Authorize the City Manager to transfer title of a 2006 Big Tex Trailer to the City of Arcadia pursuant to Municipal Code 4.04.080.
BACKGROUND:
In efforts to maintain public safety on the streets of Pasadena, The Pasadena Police Department partners with the California Office of Traffic Safety (OTS) to conduct grant funded operations and programs throughout the city and in collaboration with other grant funded OTS agencies. OTS provides funding for personnel, training, and equipment each fiscal year to various California agencies with funding provided by the National Highway Traffic Safety Administration.
In 2006, the Pasadena Police Department purchased with OTS grant funding a 2006 Big Tex Trailer to be used for DUI (Driving under the Influence) operations for $24,910.
Today the trailer has an estimated value less than $4,999. In FY 2024, the Pasadena Police Depariiment was awarded $45,000 by OTS to purchase a new DUI trailer which has been obtained and is now in use.
I
MEETING OF9/23/2024AGENDA ITEM NO.9
Authorize the Title Transfer of a 2006 Big Tex Trailer to the City of Arcadia September 23, 2024
Public Works Fleet maintenance has decommissioned the 2006 trailer, and it is no longer used for Pasadena police operations. OTS has relinquished interest in the trailer and has asked Staff to consider transferring the trailer to an OTS agency that requested a DUI trailer but did not receive funding from OTS. OTS recommended the City of Arcadia as a potential candidate. The Arcadia Police Department is interested in receiving the trailer. The Arcadia Police Department is an OTS grant funded agency and a mutual aid Area C partner to the Pasadena Police Department.
Staff assessed the salvage process and options for transfer. The municipal code grants an exception to the salvage process under 4.04.080 which states, "property may be sold or transferred without complying with the provisions of this chapter; provided, that the city council authorizes the method of disposition by majority vote taken at a duly noticed regular or special meeting, acting upon a recommendation from the finance director which sets for the reasons for requesting an exemption from this chapter." Pasadena did not incur any costs when the trailer was originally purchased with OTS grant funds, and it has been in service for 24 years. The granting agency (OTS) recommended transfer to the Arcadia Police Department because they did not receive funding for a DUI trailer. Arcadia is a partner city adjacent to the City of Pasadena and providing equipment to facilitate DUI enforcement programs in Arcadia will benefit the surrounding communities including Pasadena.
CQUNCLL POLICY CONSIDERATION:
The proposed action is consistent with the City Council's Strategic Plan Goal of ensuring public safety because the trailer transfer will assist the neighboring police agency Arcadia Police Department in their ability to conduct drunk driving enforcement programs. The Pasadena Traffic Section has replaced the DUI trailer with a new updated model allowing our DUI enforcement efforts to continue.
ENVIRONMENTAL ANALYSIS:
CEQA excludes, from environmental review, actions that are not "projects" as defined by CEQA Guidelines Section 21065 and within the meaning of Section 15378(b).
Sections 21065 and 15378(b) define a project as an action which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Section 15378 excludes from the definition of "project" organizational or administrative activities that will not result in direct or indirect physical changes in the environment. The actions proposed herein, authorizing the transfer of title for a trailer to the City of Arcadia, is an administrative activity that will not result in direct or indirect physical changes in the environment, and therefore is not a "project" as defined by CEQA. Since the action is not a project subject to CEQA, no environmental document is required.
Authorize the Title Transfer of a 2006 Big Tex Trailer to the City of Arcadia September 23, 2024
FISCAL IMPACT:
The proposed action involves the transfer of a used DUI trailer that has already been replaced with OTS grant awarded funds. There is no impact to the General Fund.
