CONSULTANTS TO CITY
With respect to Consultants, the awarding authority shall, before awarding a contract or issuing a purchase order, determine if the services to be rendered:
1. Relate to a specific project and the Consultant conducts research and arrives at conclusions with respect to his or her rendition of information, advice, recommendation or counsel independent of the control and direction of the City or any city official other than normal 17 contract monitoring and the consultant possesses no authority with respect to any City decision beyond the rendition of information, advice, recommendation or counsel.
2. Relate to the daily decision-making process of the City and the Consultant plays a role in the actual decision-making process of the City.
If it is determined that the Consultant's services fall into the latter category, the awarding authority shall review the consultant's duties and make a determination of the appropriate disclosure category or categories and shall forward a copy of this determination to the City Clerk and Consultant. Nothing herein excuses any such Consultant from any other provision of this Conflict of Interest Code.
