3. SB 805 (Perez) and 4. SB 627 (Weiner)
Thank you for considering supporting legislation which protects Pasadenans from unlawful immigration enforcement activities. However, without amendments, I do not recommend the Council support either SB 805 or SB 627. Moreover, based on the City Council timeline, there may not be enough time to obtain approval and get in support letters by the bill hearing dates (which may be the last week of session July 14th as neither bill has been scheduled to be heard yet).
SB 805 has two main aspects hat need further refinement:
a. The exemption of undercover law enforcement is problematic - it's too broad. Since "undercover" is not defined, ICE immigration enforcement, bounty hunters and others can essentially circumvent SB 805 entirely by claiming to be working "undercover". This large exemption alone renders the bill's intent futile.
b. The amendments to the Bail Fugitive Recovery Persons Act unnecessarily complicate the bill. It also doesn't address other contracted entities and individuals possibly being used to carry out immigration enfocement.
SB 627 has two main issues that need to be resolved:
a. As with SB 805, the undercover/SWAT exemption is too broad. b. The masking requirements conflict with two other active bills that give protections for the right to wear masks, AB 1326 (Ahrens) and AB 596 (McKinnor).
The Council could support alternative measures that will provide protections such as:
• SB-48 (Gonzalez) Immigration enforcement: schoolsites: prohibitions on access and sharing information.1
AB-419 (Connolly) Educational equity: immigration enforcement.2 • SB-98 (Perez) Education: immigration enforcement: notification. • SB-841 (Rubio) Keep Safe Spaces Safe Act.4
The Council need not wait for the State Legislature. Some measures that can be acted upon include:
Circulate Know Your Rights information and resources (California Latino Legislative Caucus)5 1 https://leginfo.legislature.ca.gov/faces^illNavClient.xhtml?bill_id=202520260SB48 2 https://leginfo.legislature.ca.gov/faces^illNavClient.xhtml?bm_id=202520260AB419 3 https://leginfo.legislature.ca.gov/faces/biIlNavClient.xhtm]?bill_id=202520260SB98 4 https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=202520260SB841 5 https://ladnocaucus.legislature.ca.gov/immigration
• Directing law enforcement to enforce ICE/lmmigration law enforcement identification (City of Huntington Park).6
Protect Civil Rights including seeking injunctive relief from unconstitutional searches, seizures, and detentions (Los Angeles County Board of Supervisors).
Review and/or pause use of Automated License Plate Readers (City of Denver, CO) (as it has been reported and confirmed that California law enforcement agencies have shared license plate data with ICE).9
• Review and implement privacy protection measures, using California Attorney General Bonta's model policies and guidance for complying with California law limiting state and local participation in immigration enforcement activities.10 11 I have been advocating that the Council to implement a City-wide privacy program and policies. At the very least, the City should be reviewing the implementation of AG Bonta's guidance, which I brought to the Council this past December. The Council needs to implement these public safety measures to meet the moment and protect Pasadenans now...our civil rights are on the line.
