pp. 234-235.)
(Ibid .;
STATEMENT OF FACTS
Appellantwas drivingher Renaultautomobiledown
Silver Lake Boulevard, at a speed of about 50 to 55 miles per hour, on May 15, 1984. (R.T. pp. 9-12, 17, 46, 120, 221, 236.) Although it was around 11:30 p.m., the headlightsof appellant'scar were dark (R.T. pp. 11, 221); and appellant failed to illuminate them even after Joe Santos , a motorist drivingbehindher, flashedthe lightsof his car as a signal to her (R.T. pp. 223, 253). Still travelling"very fast," appellantmade a sharp left turn onto ParkmanAvenue. (R.T. pp . 9-10 , 224. )
In making the turn, appellant'scar struck the left
side of a Datsunbeingdrivenin the oppositedirectionalong Silver Lake Boulevard by Gera Golden. (R.T. pp . 8-10 .) The impactof the collisionthrewMiss Goldenfrom her car to the street. (R.T. p. 12, 180.) Appellant'svehicle, spinning out of control, collided with some parked cars; Miss
Golden's, also occupiedby her mother, Gloria Golden, spun and came to rest at a traffic island . (R.T. pp. 127-129.) As passers -by rushed to help Gera Golden (R.T.
pp. 12, 180), appellantleanedagainsther car, smokinga
2 .
cigarette. (R.T.p. 13.) Mr. Santos, who hadstoppedat the scene, approached appellant and concluded that she was
"drunk." (R.T. p. 229.) Oscar Medina, a companionof Mr.
Santos, smelled an odor of alcohol about appellant. (R.T. p. 257.) To him, appellantdid not appear to be sober.
(Ibid.) MichaelBosley, GloriaGolden'sboyfriend, who was summonedto the scene by Mrs. Golden, noticed that appellant was losing her balance from one moment to the next as she leanedagainsther automobile. (R.T. pp. 202-203.)
Two or three minutes after the collision, appellant
re-enteredher car as if to drive away. (R.T. p. 181.)
Hilda Torres, who was tending to Miss Golden in the street, ran over and pulledthe ignitionkeys from appellant'scar. (R.T. p. 182.) Appellant stated that she was trying to move her car out of the way (R.T. p. 181), but Miss Torres could see that appellant'scar was not in the way of anything (R.T. p . 182). Appellant demanded that Miss Torres return the keys, but the latterrefused. (R.T. p. 182.) Noticingthe alcohol odor and appellant's difficulty in maintaining her balance, Miss Torres also concluded that appellant was drunk. (R.T. p. 182.)
Soon, paramedics and police arrived at the
intersection. (R.T. pp. 14, 45, 91.) Gera Golden and her mother each were transportedto a differenthospital. (R.T. p. 14.) Police officersStewartWeinreb and Richard Mumford spoke with appellant at the scene. (R.T. pp. 45-46.)
Appellant's eyes appeared bloodshot and glassy (R.T. p. 47); 3 .
her speechwas slow (R.T. pp. 84-86) and slightlyslurred (R.T. p. 130); and she smelled of alcohol (R.T. р. 46).
Officer Weinreb then conducted some "field sobriety
tests." (R.T. p. 53.) Appellantprovedunableto touchher
fingerto the tip of her nose (R.T. p. 53), or to walk
heel-to-toe in a straightline (R.T. p. 55). In addition, she was unable to maintain her balance while holding one foot slightlyoff the ground. (R.T. pp. 56-59.) Concludingthat appellantwas intoxicated, OfficerWeinrebplacedher under arrest. (R.T. p . 58.)
At the station house, the officers tested two
samplesof appellant'sbreathin a "gas chromograph
intoximeter." (R.T. pp. 59, 69.) The machine, which was workingproperly(R.T. pp. 275-276), reportedthat
appellant's blood alcohol level was .15 per cent (R.T.
p. 69).
-- --
A few days later on Mother's Day Gera
Goldsmithwas declaredto be brain dead. (R.T. pp. 8, 15.) She had never regained consciousness after the collision. (R.T.p. 15.) And it was thecollisionthathad causedher
death. (R.T. p . 300.)
DEFENSE
1 On the eveningof the accident, appellanthad
visited the house of friends in Venice , California . (R.T. pp. 319, 324.) Whilethere, appellantdranktwo glassesof
scotch-and-soda, the second one freshenedwith a "splash" of scotch, and one "sip" of wine. (R.T. pp. 332, 338, 399.) 4 .
Appellantdepartedfor homeabout10:30p.m. (R.T.p. 323.)
Whiledriving, she mighthaveturnedoffher headlights
inadvertently, when signallingfor a left turn sometime
beforeapproachingthe intersectionof SilverLake and
Parkman. (R.T. pp. 400-401.)
At that intersection, appellantsloweddown, moved
her car into the left-turn lane, and signalledwith the
directionallight. (R.T.p. 402.) The nextthingshe knew,
there was an "impact." (R.T. p. 402.) Appellantnever saw theothercarbeforethecollision. (R.T.p. 402.)
After the accident, appellant entered her car to
move it out of traffic . (R.T. p . 403. ) She was not
planning on leaving the scene. (Ibid.) The police
"intoxilyzer" that tested her breath samples was not working properly . (R.T. pp . 349-354 .)
CONTENTIONS
1. A confusingjury instructionrequiresreversal
of appellant'sdrunk-driving convictionin count II. (Α.Ο.Β. pp. 31-33.)
2. The court erroneously allowed prosecution
witness Joe Santos to testify that he had not been
"surprised" when the collisionoccurred. (Α.Ο.Β.pp. 33-34.)
3. A juror'smisconductin informingthe other
jurors of her experience at the collision intersection
requires reversal of both counts. (Α.Ο.Β. pp. 34-38.)
4. The judge improperlycoerced the jurors into
returningtheir verdict. (Α.Ο.Β. pp. 38-39.)
5 .
!
5 . The court abused its discretionin denying
probation to appellant. (A.O.B. p. 40.)
ARGUMENT
I
THE JURY INSTRUCTION ON FELONY
DRUNK -DRIVING WAS CORRECT
Appellantwas charged, in countII, with violating
Vehicle Code section 23153 (a). That section provides:
"It is unlawfulfor any person, while under

forbiddenby law or neglectany duty imposedby law
in the drivingof the vehicle, whichact or neglect
proximatelycauses bodily injuryto any person
other than the driver ."
Appellant contends that the jury instruction relevant to this drunk drivingcount was inadequatein that it did not make clear what conduct or which driving violations shown by the evidence could constitute the "act forbidden by law" element of the offense. (Α.Ο.Β.pp. 31-33.)1/ Underthe

imposed by law in the driving of such vehicle ,

instruction, shesays, thejurorsmighthave"bootstrapped"

This Court Should Decline to Review
Appellant's Claim on Its Merits
At trial, however, appellantnever objectedto the
instruction or otherwise requested the modification she now suggestsfor the first time on appeal. (R.T. p. 442.)
Although it is true that the appellate court "may" review the adequacyof jury instructionswithouta contemporaneous
objectionbelow (Pen. Code, § 1259), this Court should
declineto do so in this case; for the defenselawyerwho
refrainedfrom objectingbelow is the same lawyer now
pressing the claim on appeal. This Court, that is, should not become a willing participantin such gamesmanship.
People v. Miller (1960) 185 Cal.App.2d 59, 84.)
(See
Refusalto reviewthe claimwouldnot unfairly

habeas corpus. (See People v. Pope (1979) 23 Cal.3d 412, 426.) Because the circumstances suggest that counsel's
silenceat trial was deliberatein this case, however, any mistake in the instruction should be deemed an "invited error" not susceptible to review on appeal. (See People v.
Wickersham, supra, 32 Cal.3dat pp. 333-335.)

B. The Instructions on Count II Were Proper
Even if thisCourtwere to reviewappellant'sclaim
on its merits, it should conclude that the instructions relevantto countII were correct. To determinethe adequacy of instructionsregardingan elementof an offense, all the instructionsmustbe consideredas a whole, and in lightof the arguments of counsel. (People v. Wright (1985) 39 Cal.3d 576, 589; People v. Bottger (1983) 142 Cal.App.3d 974,
982-983& fn. 3 [SecondDist., Div. Five).) Here, as
appellantacknowledgesin her brief, "[t]he prosecutor's
whole case • •
.. • failingto yield
.[was] that the acts forbiddenby law that
proximately caused the accident were
the right-of-way [Veh. Code, § 21801(a)]
[violatingthe basic speed law [§ 22350] ( )." (Α.Ο.Β.
p . 31. )
... and ...
Even if it were possible for the jury to have
ignored this salient point, the challenged instruction made it clear. The instructioninformedthe jury that a felony drunk driving convictionrequiredboth (a) proof that the defendantdroveunderthe influenceof alcoholand (b) proof that, "when so driving," she [did] "an act forbidden by law" or "neglect(ed) any duty imposedby law." (R.T. p. 454,
lines 24-28.) Because it paralleledthe languageof the
drunk driving statuteitself, the instructionwas
presumptivelyadequate. (People v. Failla (1966) 64 Cal.2d 560, 565.) Moreover, the court also reiterated the elements !
9 .
of the offensein a way that emphasizedthat the two showings were separate :
"In order to prove

a violation . . . of

"Two, that when so drivingsuchpersondid

11 (R.T. p. 455, lines 13-21, emphasisadded.)
Thus, especially given the obvious thrust of the People's case as identifiedby appellantin her brief, the plain
meaning of the instructions made it clear to the jurors that a guiltyverdictin countII requiredthemto determine, not only whether appellant was under the influence when her automobile killed Gera Golden, but whether she also committed a separateculpableact that proximatelycaused the death.
Finally, withoutprotestor contradictionby
defense counsel, the prosecutor explained the elements of the felonydrunkdrivingchargein a way thatcontradistinguished the under the influence element from potential acts

mentioned were quite different in nature from simple

driving-under-the-influence.2/ Indeed, defensecounselin his argumenttacitlyadoptedthe prosecution'spremisewhen
he arguedthat the evidencedid not make out the requisite independentviolationof law. (R.T. pp. 533-534.)
Appellant'sbelatedinterpretationof the instructionin this appeal, a characterizationwooden and implausible, cannot withstand scrutiny .
Appellant suggests that the instructions should
have specifiedthe failure-to-yield and speedingviolations as the only potential"act forbiddenby law" predicatesfor felonydrunkdrivingliability. (Α.Ο.Β.p. 31.) But the
instructionsas a whole, and the argumentof counsel, focused the jury'sattentionon thesetwo basesfor a verdict. The
instructionsspecificallydefined the failure-to-yield and speedingviolationswith regard to the manslaughtercharge (R.T. pp. 452-454, 465), which in form closely resembledthe felony-drunk-driving charge. And, as noted (see fn. 2), the prosecutor mentioned "speeding" and "unsafe left turn" among severalpossiblepredicatesfora guiltyverdictin countII.
(R.T. p. 470.)
Appellant implies that the instruction was
incorrect insofar as it might have allowed the jury to
2. The prosecutorargued: "Both of the felony drunkdriving offenses require that there be a violation of the statute, a violationof law, a Vehicle Code violation, somethinglike speeding, drivingwithout lights, unsafe leftturn, somethingof that nature. .You must believe that at the time this happenedErica StaffordTamblynwas drivingunder the influenceof alcohol." premise its verdictupon some violationof law other than failure-to-yieldor speeding, or uponany unspecifiedactof culpablenegligence. (A.O.B. pp. 32-33.) But there is no reason to assume that the jury, despite the parties' obvious preoccupationwith the specifiedfailure-to-yieldand
speedingviolations, wouldhavebelieveditselfchargedto
decide the case on some other grounds. Anyway, even if, as appellantclaims, the jury might have decided that
appellant'sconduct in drivingher car at night without
headlightsconstitutedthe proximatecause of Miss Golden's death, such a finding would have been a sufficient basis for a guilty verdict anyway. The negligentdriving of a vehicle is itself an unlawful act sufficient to make out a violation of Vehicle Code section 23153. (People v. Oyaas (1985)
173 Cal.App.3d663, 669-670.)
c . The Claimed Instructional Error ,
in Any Event , Was Harmless
Even if the challenged instruction did not
adequatelyapprisethe jurors of their duty in determining the independent"unlawfulact" or "neglect" componentof the section 23153 offense, the conviction nevertheless must be affirmedon grounds that the error, demonstrably, was
harmless . (See Rose v . Clark (1986) 478 U.S. 92 L.Ed.2d 40, 45-49; Cal. Const., art. VI, § 13.) Regardless of the jurors' treatmentof that subordinatecomponentof the

countI provesthat they necessarilyfoundthat appellant
committedone of the two specifiedviolationsof law, either failure-to-yield or speeding; for the jury instructions on that countspecificallydescribedthoseoffensesas the two
possiblelegalviolationsthatwouldsupporta guilty
verdict. (R.T.pp. 452-454, 464-465.) Thus, thejury's
verdictunder unconstestedand proper instructionsin count I providedthe findingof fact that, appellantclaims, was
missingfrom the jury's verdict in count II. That finding rendersthe alleged instructionalinfirmityin count II
harmless. (People v. Sedeno (1974) 10 Cal.3d 703, 711.) Appellantmightarguethatthe jurors, in returning
the count I verdict, relied upon the "negligent act" theory, rather than the "unlawfulact" theory, so that their verdict does not necessarily supply the allegedly uncertain "act forbiddenby law" finding in count II. But even assuming such a finding of negligencewould not itself establishthe "unlawfulact" requirement(see People v. Oyaas, supra,

173 Cal.App.3d at pp. 669-670; People v. Despenza (1962) 203 Cal.App.2d283, 290-291) the record nevertheless

yield; for, by appellant'sown testimony, she madethe left turn and immediatelycollidedwith the victim's car in the intersection. (R.T. p. 402.) With respectto this

THE CONDUCT OF JUROR DELGADO DID NOT
PREJUDICE APPELLANT
Juror Tina Delgado, whose boyfriendhappenedto
driveherthroughthe intersection, brieflyand inadvertently saw the scene of the crime one night during the period of jury deliberations. (R.T. p. 578.) Shortly, after the
deliberatingjury had obtaineda second viewing of a
videotapeof the scene (Def. Exh. G; R.T. pp. 569-570),
Ms. Delgado "supplemented" what she believed the videotape had shownby remarkingthat, in her experience, the
intersection indeed had been flat. (R.T. pp. 578, 596.) Appellantargues that juror Delgado'sconduct gave rise to an unrebuttedpresumptionof reversibleerror. (Α.Ο.Β.
pp. 34-38; see People v. Honeycutt (1977) 20 Cal.3d 150, 156.) But, althoughthe jurorcertainlymade a mistake, an appropriate examination of the "entire record to determine whether there is a reasonableprobabilityof actual harm" resultingfrom the juror's actions serves to rebut any
presumption of prejudice in this case. (Hassan v . Ford Motor Co. (1982) 32 Cal.3d 388, 417, emphasisadded; People v. :
15 .
Sassounian (1986) 182 Cal.App.3d 361-399-400; People v. Diaz (1984) 152 Cal.App.3d 926, 935.)
Any prejudicewas rebutted, first, by the trial
judge'sadmonitionto the jury:
"It's come to the attention of the court that
Juror No. 12, Ms. Delgado, apparentlylives close
to the scene of the alleged crime, and has
inadvertentlydriventhroughthat intersection, and
thereafter shared with the jury some of her
opinionsregardingthat intersectionor the street
immediately before the intersection. [1] I want
all of the jurorsto disregardanythingthatMs.
Delgado may have said concerning that subject."
(R.T. p. 600.)
Appellant says the judge should have asked the
jurorswhetherMs. Delgado'sinformationaffectedtheir
deliberations. (Α.Ο.Β. p. 35.) But, immediately after
admonishingthe jurorsto disregardMs. Delgado'sremarks,
the judge asked them, "Will you promise me that you will do that?" (R.T. p. 600.) As the recordreflects, "The jury
responded in the affirmative." (Ibid.) This inquiry surely was the equivalentof the questionappellantsays the judge ought to have asked.
1 A further indication that the judge's inquiry was
adequatelies in the fact that defensecounse, now counselon appeal, never suggestedthe voir dire he now championson appeal. Moreover, counsel never acceptedthe judge'soffer 16 .
to provideall twelvejurorswitha viewof the scene, to
neutralizeany untowardeffect of Ms. Delgado'sremarks.
(R.T. p. 597.) Indeed, by his own admission, counselnever even obtaineda ruling on his motion for mistrialon the
basis of juror misconduct.3/ Counsel'sactions if
insufficient to amount to an outright abandonment of his jurormisconductchallengeon appeal(see Peoplev. Obie
(1974) 41 Cal.App.3d 744, 750) at least suggest it was
apparentat trial that the court's responseto the juror
problem was adequate.
--
--
Moreover, the overwhelming evidence of appellant's
guilt renderedthe nature of the juror'sconduct immaterial and neutralizedthe seriousnessof it. (Cf. People v.
Sassounian, supra, 182 Cal.App.3dat p. 399, and cases
cited therein.) As noted in argumentI, there could be no seriousquestionthat appellant'sleft turnwas the proximate
3. The record shows that counsel made a mistrial motion after Ms. Delgado first described her activities (R.T.
p. 581); but the judge, partiallybecausethe trialprosecutor was unavailable to respond, said he would "takethat motion under advisementand give it some thought... [1] The matter is denied without prejudiceat thistime. You can renewit, and I thinkwe oughtto get [the prosecutor ] back ." (R.T. p . 583. )
The next day, with the prosecutor having returned, defense counsel in chambers noted his motion for a mistrial again. (R.T. pp. 587, 598.) The court responded, "Well, youmay renewyour motionat the morningsession, Mr. Cheroske.... [1] If the motionis renewed, you have a motion, youwill have a chance to argue on the record." (R.T. p. 599.) At the morning court session, the judge admonishedthe juryto disregardMs. Delgado'sremarks (R.T. p. 600); but defensecounsel never renewed his motion in court and, as he laterconceded after trial, "the request was made for a mistrial, and there was never any ruling on that." (R.T. p. 617.) 17 .
result of the victim's death. The only material issues at trial, in reality, were (a) whether appellantwas intoxicated and (b) whetherher conductwas grosslynegligentor merely negligent. The shapeof the intersectionhad no bearingon the questionof appellant'sdrunkenness. And, despitethe
overstatementin appellant'sbrief(A.O.B.p. 35, lines
21-25), evidence of the contours of the intersection bore, not on the existenceof negligence, but only on the level of negligence. That is, it is hard to imaginehow any urban intersectioncould be contouredin a way that would make it so difficultto see oncomingtrafficthat one could, without advertingto the danger, strike the driver'sside of an
oncoming car in the middle of the intersection. In any
event, as the videotapein Defense ExhibitG shows, the
intersection in question in this case could not rationally be deemedso outrageouslydangerousas to give rise to a serious question of whether appellant even had been "ordinarily" negligentat all. The jury, apparentlycompromisingwith one holdoutjuror, resolvedthe negligencein appellant'sfavor, by findingonlysimplenegligencein the manslaughtercharge.
Thus, Ms. Delgado's remarks did not cause appellant any "actual harm ."
III
THE COURT PROPERLY ALLOWED PROSECUTION
WITNESS JOE SANTOS TO TESTIFY THAT THE
COLLISION DID NOT SURPRISE HIM
ProsecutionwitnessJoe Santos, whom appellant
overtook in her car immediately before the fatal collision, 18 .
testifiedover defenseobjectionthat he was not "surprised" at the collisionbetweenappellant'sand Ms. Golden's
automobiles. (R.T. pp. 226-227.) Mr. Santos, who had
testifiedthathad observedappellantstartto turnwhile
Ms. Golden was approachingin the oppositedirection (R.T. p. 225), explainedwhy he was not surprised: "It looked so it looked positive . I don't know trying to come up
with the word . It looked so I just knew if the car at the speed that they were going, if she was going to turn or if thecarwas goingto turn, theyweregoingto collide."
(R.T. p. 227.)
--
--
--
Appellant contends that Mr. Santos' tesitimonial
claim that he had not been "surprised " by the collision constitutedan inadmissibleopinionby a non-expert. (Α.Ο.Β. p. 33.) But, to the extent that Mr. Santos' averred lack of "surprise" was tantamountto an "opinion" that the accident was likelyto occur, his full testimonyon the issue
establishedthat such an "opinion" was "rationallybased upon [his] perception," and helpful to a clear understandingof his testimonyregardingthe relativepositionsand speedsof the two cars. Thus, his "opinion" was admissible, as an exercise of the trial court's broad discretion to admit evidence, under Evidence Code section 800.
Even if appellantcouldmeet his heavyburdenof
demonstratingthat the court's rulingwas so irrationalas to constitutean abuseof discretion, any errorin admittingthe opiniontestimonywouldproveharmless. AlthoughMr. Santos' 19 .
opinionwas helpfulto a betterunderstandingof his
testimony, the significanceof his testimonyon this point lay in the fact that he was able to see, from a vantage behindappellant'scar, theveryapproachof thevictim's
automobilethat, the defenseimplied, might have been
obscuredby the configurationof the intersection. Appellant does not suggest that Mr. Santos' direct account of his own observationsin this regardwas inadmissible. Given
Mr. Santos' damagingtestimony, any error in receivinghis "opinion" that he was not "surprised" by the collisioncould not likely have cost appellant a better result at trial. (See Cal. Const., art. VI, § 13; Evid. Code, § 353; Peoplev.
Watson, supra, 48 Cal.2d at p. 836.) This conclusion is buttressedfurtherby the fact that the jury apparently
deemed appellant's conduct in making the turn to be merely negligentand not grossly so.
IV
THE COURT DID NOT "COERCE " THE VERDICT
Appellantargues that the court
--

by telling the
jurorsthatthey must try to resolvethe case and by allowing deliberations to continue after the lone holdout juror for a "not guilty" verdicton the felonymanslaughtercounthad
accused his felow jurors of badgering him improperly
(Α.Ο.Β. pp. 38-39.) The judge's
instructionsabout the jurors' duties, however, were correct; and his decision to let them continue their deliberations was "coerced " the verdict .
proper .
20 .
On thethirdday of theirdeliberations, the jurors
reportedthat theywere dividedeleven-to-one on countI, but had not even consideredthe "lesser included" offense option in that count, or eitherof the two remainingdrunk-driving counts. (R.T. pp. 576-577.) Without any objectionfrom
defensecounsel, now counselon appeal, the courtinstructed the jurors as follows:
"Both the People and the defendant are
entitled to the individual opinion of each juror.
It is the duty of each of you to considerthe
evidencefor the purpose of arrivingat a verdict,
if you can do so.
"Each of you mustdecidethe case for
yourselves, but should do so only after a
consideration of the evidence and instructions with
the other jurors.
"By 'discussion,' we mean a fair and
open-minded discussion. You should not hesitateto
change an opinion if you are convinced it is
erroneous. And the key to that phrase, if you are
convinced. I am speaking of every individual
juror.
"However, you should not be influenced to
decide any question in a particular way because a
majority of the jurors or any one of them favors
such a decision .
21 .
"Now, that's the positionthat the jurors must
take in resolvingthis case. We need each of your
individualopinions. You will have the benefit of
argumentand consultationwith otherjurors. If
you are convinced your opinion is in the majority,
sobeit. If you cannot be convinced, sobeit, but we
insist you make an effort to resolve differences ,
and that effort be open-minded and with fair
consideration of all the evidence .
"Once you have reachedthat point you have
concluded your duties as jurors." (R.T. p. 580,
emphasisadded.)
With minor differences as to form, this instruction
was commendedas proper by the State Supreme Court in
People v. Gainer (1977) 19 Cal.3d 835, 856. (See CALJIC No.
17.40.) Appellant, however, says that the instruction
insofar as it stated "we insist you make an effort to resolve differences "
--
--
ventured beyond what the Gainer Court
commended into the territory that the Gainer Court condemned. (Α.Ο.Β.p. 38.) But he does not explainwhy. The challenged portiondoes not differ in any significantway from the
admonition that "[i]t is the duty of each of you to consider the evidence for the purpose of arriving at a verdict if you can do so " the languageof the instructionspecifically
approvedin Gainer. The challengedportionmerely explained again that the jurors must try to reach a verdict fairly and reasonably. Especiallyin the absenceof any explanatory

22 .
argumentin appellant'sbrief, thereis no reasonto conclude that the challengedinstructionwas improper.
Appellantfurtherargues, it appears, that the
court should have declareda mistrialthe morning of the
fourth day of deliberations. That morning, the foreman
reportedthat the jurors, apparentlystill divided
eleven-to-one on the felonymanslaughtercharge, stillhad not voted on the "lesser included offense" option and had taken only "preliminary" votes on the two drunk driving counts. (R.T.p. 600.) Also, the apparentholdoutjuror
communicated his claim that the other jurors had been
"badgering" and "belittling" him. (R.T. p. 589.) The court told the jury to considerthe "lesser offense" option on countI. (R.T. p. 601.) Eighty-threeminuteslater, the
foremanreporteda deadlockas to all counts, and inquired about the resolutionof the holdout'srecent requestto be discharged from the jury for medical reasons. (R.T.
pp. 602-604.) The court told the jury to continue
deliberations, explainingthat the apparentholdout juror appearedable to dischargehis duties and cautioningall the jurorsnot to "intimidate" him. (R.T. p. 604.) Immediately beforenoonthatday, the foremanreportedthatthe jurywas
continuingto deliberate. (R.T. p. 605.) At four o'clock, the jury returnedunanimousverdictsthat appellantwas
guilty of the lesser misdemeanor offense in count I and was guilty as charged of felony drunk drving in count II. (R.T. p . 606. )
23 .
:-
i
At no time during these proceedingsdid defense
counsel, now counsel for appellant on appeal, request a mistrialor anyactionon groundsof allegedcoercionof the
holdoutjuror. Instead, as noted earlier, counselmoved for a mistrialonlyon groundsthata differentjuror,
Ms. Delgado, had committed misconduct. (R.T. pp. 598-599.) He should not now be heard to complainabout the trial
court's decision .
542, 547.)
(See People v. Rogers (1978) 21 Cal.3d
Even if thisCourtwere to considerappellant's
belated claim, it should be rejectedon its merits. Whether to dischargean allegedlydeadlockedjury is a decision
within the discretionof the trial judge (Paulsonv. Superior Court (1962) 58 Cal.2d 1, 6), whose decision is not to be overturned"unless there is a strong showingof a manifest miscarriage of justice and no possibility for differeing opinionson the facts (Peoplev. Ham (1970) 7 Cal.App.3d768, 775 ) .
In this case, the court's decision did not result
in any "manifest" injustice. Indeed, it appearsthat it was the minorityjurorwho succeededin bringingthe others
around to a more lenient misdemeanor verdict on count Ι . In recognition of this fact, appellant in his brief seems to concede that he is not entitled to a reversal on that count at all . (Α.Ο.Β. p. 39.)
More important, sound reasonsmandatethe
conclusion that the court's decision to allow the jury to 24 .
deliberatethroughthe day was appropriate. First, as noted above, neitherpartyobjectedto it. Second, the jurorsonly that day had begun to considerthe "lesser" offense in count I and the chargedoffensesin countsII and III. Third, the jurorshad not been deliberatingan inordinatelylong time withoutresult, especiallygiventhefactthattheywere
still in the process of reviewingthe defense'svideotape exhibiton the firstday of whatturnedoutto be onlyfour
days of deliberations. Appellant'sclaim that his jury was "coerced," therefore, shouldbe rejected.
V
ANY FAILURE TO STATE REASONS FOR
DENYING PROBATION WAS HARMLESS
Appellant, last, arguesthat the courterroneously
imposed a state prison sentence on count II without stating a specificreasonfor thatdecision. (Α.Ο.Β.p. 40.) The
CaliforniaRules of Court, of course, require such a
statementof reasons. (Cal. Rules of Court, rules 439(d), 443.) Even though the court in this case did not state any reason for denyingprobation, however, the sentence
nevertheless should be upheld.
The only real issueat the sentencinghearingwas
whetherthe court should grant probationor sentence
appellant to prison for the low term. That was the exclusive subject of recommendations and arguments of counsel (R.T. pp. 625-629), and it apparentlyaccountedfor the trial
court'sdecisionto obtain a diagnosticstudy of appellant 25 .

from the Department of Corrections (R.T. pp. 618-620). In sentencingappellantto prison for the low term, then, the court necessarily determined that the nature, circumstances, and seriousness of the crime involvingthe death of a
young lady at the hands of a drunk driver outweighedthe considerationsfavorableto appellant. Because the trial
court resolved that specific issue exclusively, a remand for a formalstatementof reasonswouldamountto nothingmore
than "slavish adherence to ritualistic formula." (People v.
Blessing (1979) 94 Cal.App.3d835, 839.) Any error,
therefore, shouldbe deemedharmless. (See ibid.; Peoplev.
Romero (1985) 167 Cal.App.3d1148, 1151; People v. Lambeth (1980) 112 Cal.App.3d 495, 501.)
