City Council Agenda November 7, 2023
Council Agenda Report
From: Ryan Cornell, Administrative Services Director
Subject: Fiscal Year 2023-24 Quarterly Budget Report and Amendments CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Date: November 7, 2023
Facts
1. In accordance with the Council’s adopted fiscal policies, quarterly, but no less than semi-annually, there will be a comprehensive review of the operations in comparison to the existing budget.
Projections of revenues and expenditures through the end of the fiscal year (FY) will be prepared and reviewed by the City Manager and the Director of Administrative Services with a report and presentation to the City Council.
2. This report provides an overview of the City’s projected financial position based on actual transactions incurred for FY’s 2022-23 and 2023-24. It should be noted that financial information provided for FY 2022-23 has not been audited. As such, additional adjustment may be required; however, staff does not anticipate that there will be significant changes.
3. On June 21, 2022, City Council adopted the Operating and Capital Budget for FY’s 2022-23 and 2023- 24; and an Updated Budget Report for FY 2023-24 was approved on June 20, 2023. Several assumptions and predictions were used in the budget process; therefore, it is important to revisit assumptions to ensure accuracy and solvency.
4. To lessen administrative burdens, the City Council has historically authorized the City Manager to increase service levels and later amend the budget, by council resolution, during quarterly budget reports. This allows multiple service level adjustments to be compiled into one resolution. Detailed recommended budget amendments are discussed in further detail later in this report.
5. CalPERS requires governing bodies of local agencies that contract with CalPERS for retirement benefits to approve and adopt a publicly available pay schedule in accordance with public meeting laws. The pay schedule (Exhibits C, D, and E of Attachment 1) must identify each position by title, the individual pay rate amount or range for the position, and the time base upon which the pay amounts are calculated, and must be posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s website (pursuant to California Code of Regulations, Title 2, Section 570.5).
Options
1. Take no action;
2. Receive and file the report, and approve the proposed appropriations, position reclassifications, and revised master pay schedule;
3. Provide alternative direction to staff.
City Council Agenda November 7, 2023
Analysis and Conclusions
For FY 2022-23, the City’s General Fund received $54.6 million in revenue, an increase of approximately $1.6 million, or 3%, when compared to the previous year. This increase was on top of the record-breaking double-digit percent increases the City has realized since 2020. Because of this, the City continues to be on solid financial footing, with General Fund reserves at $20.1 million on June 30, 2023, representing 38% of General Fund revenues. The City also has additional reserves in each of its enterprise funds, the Capital Improvement Program, the Fleet, and IT replacement funds, as well as approximately $8.8 million on the City’s Section 115 Pension Trust Fund. As such, the City is in a good position should the economy begin to recess; however, most economic indicators do not anticipate a decline in the near term.
The California Employment Development Department reported the unemployment rate in SLO County was 3.6% in September 2023, and ranks the 8th lowest rate in the State. Inflation has come down from its peak of a 9.1% increase in June 2022, down to about 3.7% in September 2023. That being said, inflation has not, and does not anticipate, going negative, so the higher costs have created a new baseline for tax purposes (as an example, sales tax is generated based on the value of goods sold, so if goods increase, so does the taxes collected). Additionally, inflation related to services continues to be elevated at 5.7% in September 2023. Taken together, the consumers have a strong labor market, but inflation is slowing some spending. For the City, it had estimated sales tax revenues (including the supplemental sales tax overrides) to be $33.8 million for FY 2023-24. With two months of the tax being collected to date, the City has received about 10% more than initially anticipated to date. But as just mentioned, staff does anticipate some slowdown in spending, but more of a continued flattening of revenues, rather than a reduction.
Tourism continues to be robust, despite FY 2022-23 revenues increasing by less than 1% when compared to the previous fiscal year. This is mainly because the growth that occurred coming out of the pandemic (40% and 25%, respectively) was not sustainable into the future. However, even though there were significant revenue increases in the past, this year’s revenue still did not decline when compared to prior year. In other words, even though the City didn’t realize the same growth as in the past two years, when you take a broader view, transient occupancy taxes to the City has doubled since 2015. Below is the transient occupancy tax history since 2015 and what it is projected to be:

Lastly, the City’s property taxes have seen higher-than-expected growth. As compared to 2022, properties within the City collectively saw a 7.6% increase in taxable assessed values compared to last year, totaling $6.6 billion citywide. The increase was chiefly attributed to changes in ownership of property, which typically results in the property being reassessed at market value. The assessed valuation is used to determine property tax revenues for local schools, governments, and special districts. As a result, the City now expects total property tax revenue to the General Fund to be $14.3 million, an increase of 7% compared to last year, and about 5% more than budgeted.
Labor Agreements
The City’s labor contracts with each of the unions and the unrepresented confidential, professional, and management group call for certain guaranteed wage increase, with additional increases dependent on City end of year revenues. Since the City’s original estimated General Fund revenue for FY 2022-23 was $52.9 million and actual revenues received were $54.7 million, both economic triggers have been met and the maximum percent increase negotiated (ranging from 4%-7%, depending on the labor group) will go into effect on January 7, 2024. As a result, part of City Council’s action tonight is to approve the updated wage tables for each of the groups accordingly. For further information, the labor agreements are posted on the City’s website at https://www.prcity.com/171/Memorandum-of-Understanding.
Recommended Personnel Changes
There are three recommended personnel changes for City Council consideration:
1. Acting Battalion Chief: The City’s Fire and Emergency Services Department currently deploys an “Acting Program” where, if there is a staffing shortage in a particular day (e.g., out-of-county commitments, sick days), an already-scheduled firefighter or fire engineer can temporarily be assigned to a higher rank (i.e., fire engineer and fire captain, respectively), with additional compensation, but without the need to call in an off-duty employee to cover the shift at overtime rates. This not only saves the department on overtime costs, but prepares employees for future professional and organizational needs; it gains valuable experience and develop leadership skills; increases staff depth during times of disaster; and prepares the organization to fill critical roles when vacancies occur. This program is part of the organizational commitment to reduce employee turnover and transition staff into leadership roles in the event of retirement.
Currently, this program only includes Fire Engineer and Fire Captain positions. However, there is a benefit to include the Battalion Chief (BC) rank, as well since there are currently only three BC positions. City staff has met and conferred with the Fire unions to expand this program to the Battalion Chief ranks. This program would provide a 5% incentive to those individuals who temporarily act in the Battalion Chief role and would not be provided in instances where they are working their typical shift.
2. Water Distribution Chief Operator: The City has been unsuccessful in its attempts to recruit a Lead Maintenance Specialist (MS III) for the Water Division’s heavy repair crew for the past two years.
This position is critical for maintaining the City’s water infrastructure and responding to waterrelated emergencies. The MS III is required to possess advanced skills in underground water utility construction techniques, working in hazardous conditions, and crew management and coordination. To address the gap created by this vacancy, the City’s Water Distribution Supervisor has been temporarily filling this role to ensure the water system continues to operate safely and reliably. However, the additional workload resulting from this vacancy has necessitated extensive amounts of overtime and placed significant stress on the existing staff. Given that it has taken
City Council Agenda November 7, 2023
over two years to recruit for this position, staff recommends upgrading this position similar to that of neighboring agencies and be more indicative to the actual work being conducted.
In contrast to the MS III's primary focus on executing assigned work, the “Water Distribution Chief Operator” will assume a higher level of responsibility for both work and the crew. They will be responsible for planning, organizing, scheduling, overseeing, and executing fieldwork. An expectation of this position is that they will comprehend overall utility infrastructure objectives, master planning strategies, contribute to their ongoing development, and advance their execution. Additionally, they will familiarize themselves with our development and construction standards and ensure that these standards are adhered to by the development community. This reclassification aims to alleviate the burden on the existing Water Distribution Supervisor, ensuring a more equitable distribution of responsibilities, while also securing the long-term reliability and resilience of our vital water infrastructure.
The total cost of the new position will be approximately $141,500 per year (this includes all retirement, medical and payroll taxes), an increase of $21,500 from the current MS III wages, or about 18%. Given that this position has been vacant, budget savings will cover the cost of the position and be included in baseline calculations moving forward.
3. Airport Maintenance Specialist: In June 2023, an operational and business assessment was conducted on the Paso Robles Airport by Aviation Management Consulting Group. A part of the assessment was to analyze both current and future staffing needs in order to ensure adequate support for airport operations.
The assessment concluded that the Airport Division lacks sufficient staff to adequately operate and maintain the Airport in accordance with industry-recognized best practices for the scope and scale of City operations. The current airport staff consists of an Airport Manager, who reports to the Airport five days a week (and remains on call 24 hours a day, seven days a week), without sufficient relief of duties, and one Maintenance Specialist worker. Additional deficiencies include no depth to back fill position in the event of illness, vacation, etc.
Typically, requests for, or amendments to, division staffing and personnel structure would be part of the City’s budget process. However, the Airport operations has its own fund apart from the City’s General Fund. Furthermore, the current request is to add one maintenance specialist worker (total cost of $106,000 per year) in order to provide services seven days a week, and not necessarily to implement all of the personnel recommendations from the study. As such, it is the staff’s recommendation to move forward with this position now, and then conduct a further analysis on how to implement the remaining recommended positions in future budgets.
Recommended Budget Amendments
The recommended budget amendments are outlined below:
1. Sewer Fund – During the Mid-Cycle Budget Report, the Recycled Water Manager position was erroneously not included in the budget amounts; the position was included in the approved Position Listing, but not the dollars. This impact has been anticipated since the position was approved, so there are not any adverse impacts to the fund by this action but will increase appropriations by $260,300.
City Council Agenda November 7, 2023
2. Sewer Fund – The City’s street maintenance program calls for street rehabilitation on Capitol Hill.
Prior to street maintenance, the City’s sewer utilities also need to be upgraded. An increase of $460,000 is being recommended in order to complete that work prior to roadwork.
3. General Fund – The recreation services contracts with class instructors typically call for a fee of 70% of the revenues received for that particular class. As such, the line-item expense should be 70% of the estimated revenues. Class revenues are estimated to be $250,000, so the line-item expense should be $175,000. The current budgeted amount is $100,000, so the amendment reflects an increase of $75,000.
4. General Fund – Last New Years Eve, the City hosted a community concert and bonfire event to kick in the New Year. Staff is proposing a similar event this year in the amount of $42,000. This amendment will be added to the City’s community events program.
Fiscal Impact
Budget amendments are summarized below:
Requested
Budget
Amendment
Airport Maintenance Specialist 50,000
Recycled Water Manager 260,300
Sewer Line Replacement at Capitol Hill 460,000
Recreation Contractor Expense 75,000
New Years Eve Event 42,000
Total 887,300
Additional fiscal information can be found in the Analysis and Conclusions section above.

1 ‐ In 2019, the City purchased improvements located at 4301 Second Wind Way. A portion of the funding was paid by the City's Facility Replacement Fund. Since the lease revenues come to the General Fund, it was intended that a transfer to the Facility Replacement Fund would be made to replenish the fund. Fund transfers were not made in the past two years, but caught up in FY 2022‐23.
2 ‐ In 2023, the City Council approved impact fee deferral loans for two affordable housing projects being constructed by the Paso Robles Housing Authority. In these instances, the impact fee funds are paid in full (i.e., as a general fund expense), and the General Fund will receive future repayments. Formal appropriations were not made at time of loan deferral, so it is shown as such.

Subject: City Council Resolution Declaring Businesses within the City of Paso Robles as ‘Essential’ and Clarifying that Masking is a Matter of Personal Preference within the City of Paso Robles
CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Date: November 7, 2023
Facts
1. On October 3, 2023, Councilmember Chris Bausch requested a Council discussion regarding declaring all business within the City as ‘essential’ and clarifying that masking is matter of personal preference.
Options
1. Take no action;
2. Declare all businesses within the City of Paso Robles as ‘Essential’ businesses and clarifying that the use of masks by residents is a personal preference within the City of Paso Robles.
3. Provide alternative direction to staff.
Analysis and Conclusions
Council member Bausch requested at the October 3, 2023 meeting that the Council consider the adoption of two resolutions: 1) declaring all businesses in the City as “essential” businesses and 2) declaring that the use of masks is a matter of personal preference.
The City Council is authorized to make and enforce local regulations that are not in conflict with state or federal laws, to promote public convenience, health, morals, and safety, and to enhance general prosperity within the City. (See Cal. Const., art. XI, § 7.) Thus it is within the City’s authority to enact resolutions declaring local businesses to be “essential,” and declaring wearing medical masks to be a matter of personal preference.
Notwithstanding that authority, any resolution adopted by the City can be superseded or rendered invalid by contrary state or federal law, pursuant to the preemption principles set out in the state and federal Constitutions.
Consequently, the impact of these resolutions may be eliminated or diminished by future State or federal action including but not limited to subsequently enacted state or federal laws in the event of a resurgence of COVID-19 or other circumstance giving rise to a proclaimed state of emergency.
