This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered.

State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2).

N. AGENDA ITEMS TO BE DEFERRED

ITEMS ON THE CONSENT CALENDAR ARE CONSIDERED ROUTINE, NOT REQUIRING SEPARATE DISCUSSION. However, if discussion is wanted by a member of the Council or public the item may be removed from the Consent Calendar and considered separately.

Councilmembers and members of the public may offer comments or ask questions of clarification without removing an item from the Calendar. Individual items are approved by the vote that approves the Consent Calendar unless an item is pulled for separate consideration. Items pulled from consent will be heard at the end of the meeting.

4. Reaffirmation of Resolution 23-018 Approving Remote and/or Hybrid Remote and In-Person Public Meetings Citywide as Needed Pursuant to Assembly Bill 361 17 - 18
Melissa Boyer, City Clerk
CEQA Determination: The City find that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15061, subd. (c)(2)-(3), 15378.

Recommendation:

Reaffirm Resolution 23-018 allowing for the continuation of hybrid remote (teleconference)/in-person public meetings citywide pursuant to the requirements of AB 361.

Recommendation: (Option 2)
Approve Resolution 23-XXX, authorizing the City Manager to award a construction contract to Cal Stripe, Inc. in the amount of $414,975, to rehabilitate runway 1-19, and allowing the City Manager and City Attorney to make minor technical, or nonsubstantive changes to the contract, as necessary, and finding the action exempt from CEQA.

7. Approval of Final Map Tract 3154-1 For Recordation, Vinedo Planning Area 15 (Olsen – South Chandler Specific Plan PA-15 – Phase 1b) 87 - 130
David Athey, City Engineer/Water Resources Manager
CEQA Determination: The City finds that a Final Environmental Impact Report (EIR) was previously prepared for the Olsen South Chandler Specific Plan. The proposed Vesting Tentative Tract Map does not require additional review under CEQA pursuant to Public Resources Code section 21166 and CEQA Guidelines section 15162 and 15182 (no subsequent or supplemental EIR is required, because no “substantial changes” to the project or to the circumstances under which the project was undertaken are proposed, and there are no “new significant environmental effects” or a “substantial increase in the severity of previously identified significant effects” under the existing EIR).

Recommendation (Option 1)

1. Approve Resolution 23-XXX which:
a. Approves Final Map Tract 3154-1 and directs the City Clerk to state the Council’s approval on the Final Map.

(b)(2)-(3), 15304, and 15378, as it can be seen with certainty that the action does not have the potential to cause a significant effect on the environment, and the action would result only in a minor private alteration in the condition of the land.

Recommendation: (Option 2) Deny OTR 23-04 based on the Arborist’s reports not expressly recommending removal and based on the tree’s fair health and require the Oak tree to remain and be protected.
