City Council Agenda Addendum December 19, 2023
Council Agenda Report
From: Melissa Boyer, City Clerk
Angelica Fortin, Community Services Director
Subject: Approval of Updates to Community Services Advisory Body Bylaws CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.

Date: December 19, 2023
Facts

1. The Community Services Department oversees four advisory bodies: the Library Board of Trustees, the Parks and Recreation Advisory Committee, the Senior Citizen Advisory Committee, and the Youth Commission.

2. Each advisory body has been established by the City Council with a specific purpose and operates with guidelines established from a Council approved set of bylaws.

3. In a recent review of all of the advisory body bylaws, it was discovered that the Parks and Recreation Advisory Body has never established formally approved City Council bylaws.

4. Community Services staff and each of the Community Services advisory bodies have reviewed existing bylaws and drafted proposed bylaws that address needed updates to align with the standardized structure provided by the City Clerk’s office.

5. Each advisory body has had an opportunity to review and approve proposed changes to the existing Council approved bylaws and each of the draft proposed bylaws are included as Attachments No.’s 1-

4. 6. In addition, existing Council approved bylaws for each of the advisory bodies have been included as Attachments No.’s 5-7, noting that there is no existing version of bylaws for the Parks and Recreation Advisory Committee.

Options

1. Take no action;

2. Approve the proposed bylaws for Parks and Recreation Advisory Committee, and the proposed bylaw updates for Library Board of Trustees, Senior Citizen Advisory Committee, and Youth Commission;

3. Provide alternative direction to staff.

Analysis and Conclusions
City staff seeks to align all the advisory body protocols to ensure standardized meeting function, agenda style, and processes in annual recruitment and annual reorganization of each committee/commission. As part of this review, it became evident that the advisory body bylaws also need to be updated to encompass a unified and standardized structure that can be tailored to each advisory body’s specific purpose.

Page 6 of 70 ends

City Council Agenda Addendum December 19, 2023
Taking no action will result in the Community Services Advisory Bodies continuing to operate within the existing bylaws and in the case of the Parks and Recreation Advisory to continue to operate without a Council approved set of bylaws. The best practice for each of the advisory bodies is to function within the guidelines of a Council approved set of bylaws. For consistency across all advisory bodies, it is also a best practice to update all bylaws to have a standardized structure that can be tailored to each advisory body’s specific purpose.

Approving the proposed bylaws for Parks and Recreation Advisory Committee and the proposed updated bylaws for Library Board of Trustees, Senior Citizen Advisory Committee, and the Youth Commission would bring all of Community Service Advisory Bodies into alignment with bylaws which in turn will aid in standardizing meeting function, agenda style, and processes in annual recruitment and annual reorganization of all City Advisory Bodies.

CEQA

Public Comments for the December 19, 2023 Council Meeting---Item H-4 H. Consent Calendar, Item 4: Approval of Updates to the Community Services Advisory Body Bylaws.

Though I have yet to review the details of the update changes---I'm happy to see the city reviewing advisory body and committee bylaws--adding them where missing--and updating them when necessary.

It does however, bring up the question of missing bylaws for the Housing Constraints & Opportunities Committee that has been operating for years without bylaws. I can't call this a city oversight, because the city is fully aware of this lack of bylaws for the HCOC. And I've been trying to bring it to the city's attention for years now without success.

Sadly, without bylaws--the HCOC has been operating in a questionable manner with respect to city and council policies regarding committee membership, council liaisons, meeting minutes, etc. In addition, the lack of HCOC bylaws is a disregard by city staff of city policies and council direction.

What seems to be the problem? Why no Council approved bylaws for the HCOC? Jeff Carr--Paso Robles, CA
