Council Agenda Report
From: Piper Smith, Assistant Planner
Subject: Food Truck Regulation Review – City Council Ad Hoc Committee Date: November 12, 2025
Facts

1. On October 1, 2024, City Council approved a variety of updates to the Paso Robles Zoning Code, Title 21 of the Paso Robles Municipal Code, including updates to Section 21.69.120, “Food Trucks and Food Truck Courts” (Attachment 1). This section of the municipal code establishes the permit requirements and operational standards for food trucks operating within the City limits. The rules codified staff policy on food trucks that had existed since 2019.

2. All food trucks operating are required to: comply with the operational requirements of Section

21.69.120; have a valid City business license; and have an active County of San Luis Obispo Environmental Heath Permit.

3. In addition to the above requirements, food trucks operating at one location for more than seven days in a calendar year, but less than one year, are required to obtain a Temporary Use Permit (TUP) and must meet the findings provided in Section 21.20.070, “Findings for Approval and Revocation” (Attachment 2).

4. At the May 6, 2025 City Council meeting, Councilmember Gregory requested staff bring back a discussion item regarding food truck regulations.

5. Community Development staff have been working with Community Service Officers, the Wastewater Pretreatment Coordinator, Fire Marshal, and the Finance Department to analyze the existing food truck requirements and permitting process to initiate a discussion with City Council to determine the most effective path forward for regulating food trucks.

6. On August 5, 2025, City Council discussed a ‘Legislative Update and Review Regarding Food Truck Regulations’. Staff presented the current permitting process as well as some of the challenges in enforcing the food truck standards and permitting requirements due to ambiguity in the municipal code. Members of the public were invited to participate in the discussion and provided feedback. The City Council voted to establish an Ad Hoc Committee of the City Council to be comprised of Councilmember Gregory and Councilmember Bausch to address food truck regulations and report back to City Council within 6 months with recommendations for future action based on the discussion.

7. The first Food Truck Regulation Review City Council Ad Hoc Committee meeting was held on September 22, 2025. The priority of the meeting was to gather more in-depth feedback from the public. The meeting had a high level of participation from the public. Ad Hoc committee members directed staff to collect additional information on the following topics:
a. Generators that can meet Noise Ordinance requirements

Page 2 of 33 ends

b. Comparison of the current food truck policies listed on the City’s website and the standards in the Zoning Ordinance.
c. Clarification on Fire inspection requirements
d. Additional information on complaints received by the City regarding food trucks e. Policies and options for food trucks utilizing tables, chairs, and shade structures f. Clarification of how the 7-day rule applies to food trucks hired to serve food at special events (not operated by the City).

Ad Hoc Meeting Process
The purpose of the Ad Hoc Committee is to facilitate a review of food truck regulations to be reported back to City Council within 6 months. This approach will allow in-depth dialogue with public engagement throughout the process. Any recommendations developed by the committee would be brought back to the full City Council for formal discussion and potential action at a future meeting. No changes to the existing regulations will be made during the ad hoc committee meetings.

The second ad hoc committee meeting will focus on staff’s findings and analysis in response to the concerns and questions posed at the first meeting. Time will be reserved for public comments.

Community Outreach
The following list details the outreach effort that has been taken to notify the public of the ad hoc committee meetings:
 Social Media Posts (Nextdoor, Facebook, and Instagram)  Press Release
 Information on the City’s webpage: www.prcity.com/foodtrucks  Postcards mailed to the Downtown Main Street Association, Paso Robles Chamber of Commerce, Hispanic Business Association, Temporary Use Permit holders (active, pending, and expired), and Mobile Food Truck/Vendor Business Licenses holders (active, pending, and expired)  Emails sent to subscribers of the “Food Truck Ad Hoc Committee” mailing list  Providing a Spanish translator at the Ad Hoc meetings Analysis
Complaints
From April 1. 2025 to June 30, 2025, the City Police Department received 36 calls for service about mobile vendors. The typical complaint questioned whether a food truck operator was permitted to operate in the manner observed by the complainant. Typical concerns were:
 proximity to the downtown City Park or downtown restaurants,  customers lining up on City sidewalk
 noise from generator
 unsightly appearance of shade structures, table and chairs, feather flags, and other miscellaneous apparatus
 number of consecutive days operating
 operation of food trucks in vacant lot
 Blocking emergency red curbs
Clear and Concise Rules:

A reoccurring request from the public at the first ad hoc meeting was to provide clear and concise rules about the current food truck permitting and operational standards. Staff have created a City webpage,

Page 3 of 33 ends

https://www.prcity.com/1255/Food-Trucks available in both English and Spanish, dedicated to information pertaining to food trucks operating within City limits. This website includesthe current permit requirements and operational standards (both municipal code regulations and City policies), as well as links to the webpages for the Public Works Department and Recreation Services Division where the public can obtain information on participating at City events or operating on City property. The website is continually being updated as new information becomes available.

In addition, staff have created an application packet (Attachment 3) that outlines all required information for submittal, including a property owner authorization form and example site plan. This form would allow staff to provide clear information to food truck vendors wanting to operate within City limits. Once approved, the improved application materials will be accessible online, at City Hall, and Community Service officers would have access to the document to provide food truck operators in the field.

Community Development staff has begun issuing food truck temporary use permits using a standardized template (Attachment 4) that is recognizable to Community Service Officers. The permit ensures the food truck operator has a list of applicable operational requirements on site and the ability to provide the approved permit to law enforcement when asked.

Neither document influences the current permitting requirements or operational standards but is intended to streamline the permit process and assist in ensuring operators follow the requirements of their permit. At the second ad hoc committee meeting, the ad hoc committee members will be given the opportunity to authorize staff to proceed to utilizing them for all food truck permit submittals.

Generators
A topic brought to light at the ad hoc meeting was the conflict between the City of Paso Robles noise standards (Chapter 21.83.040 of the Paso Robles Zoning Code) and the Air Pollution Control board. Food truck operators reported they found it difficult to find generators that meet both air pollution control standards and noise requirements.

The City’s noise standards depend on time of day, receiving use, and zoning districts with night-time standards in residential areas having the most restrictive standards while daytime standards in commercial zones have the least restrictive standards. Noise is a function of the sound made, the distance between the source and the receiver, and the screening/buffering provided to shield the receiver from the noise source. Since August, 2025 staff has conditioned temporary use permits for food trucks so that generator noise cannot leave the site on which the food truck is located. The policy was adopted in an effort to simplify the enforcement process for Community Service officers. Feedback from the public indicates this standard may have been too restrictive.

Staff has compiled a list of generators that are likely to meet both the standards of the City’s Noise Ordinance (Paso Robles Municipal Code Chapter 21.83) and current air quality standards, depending on how far from sensitive receptors the generator is placed (Attachment 5). Sensitive receptors include schools, churches, and households. For generators that a food truck operator might already own that do not meet the City’s noise limitations, sound dampening containers are available to reduce the noise without the need to purchase a new machine.

Page 4 of 33 ends

The state intends to strengthen the air quality standards for generators within the next three to five years.

This action is likely to result in a larger reliance on batteries for portable power. Battery backup systems are becoming more viable and are generally less noisy than traditional gas generators.

The presence of sensitive receptors is a part of staff’s review of temporary use permit applications. If a food truck intends to use a generator and adjacent land uses are sensitive to the noise produced by a generator, a food truck may not be appropriate at the proposed location. In contrast, in a commercial parking lot far from any residence, a food truck using a generator may be acceptable.

Recommendation #1: Staff recommends the City require food trucks utilize acoustic panels to abide by noise standards listed in Paso Robles Municipal Code Table 21.83.060-1 to protect adjacent receiving land uses from nuisance.

Accessory Furniture (Tables, Chairs, and Shade Structures):

In response to complaints received about the extensive use of tables, chairs, and shade structures by some food truck operators, City staff began prohibiting their use in about May, 2025. During both the City Council discussion in August and the first ad hoc committee meeting, food truck operators expressed confusion and concern about the new policy. There was acknowledgement of the sprawl that can occur if accessory furniture is unregulated. However, many food truck operators and their customers discussed the benefit of allowing shade for guests waiting for their order in the heat or rain, as well as providing a place to sit and eat.

The municipal code is silent on the use of structures accessory to food trucks aside from requiring their removal when not in use (Section 21.69.120.D.6 of the Paso Robles Zoning Ordinance). The food truck operators and staff desire direction from the ad hoc committee on this issue.

Recommendation #2: Staff recommends accessory furniture is limited as follows:
 Accessory furniture is not permitted:
o in the public right-of-way (e.g., sidewalk or parkway), or o where it will obstruct circulation, ingress, or egress.  Where space allows, permit no more than:
o 1 shade structure no larger than 120 square feet in size (below the threshold for requiring a building permit), and
o 1 table no larger than 24 square feet in size (e.g., 8 feet long x 3 feet wide), and o 8 chairs.

Regardless of City policy, pursuant to County health requirements, accessory furniture outside of the food truck cannot be used for preparation of food or improper storage of food.

Page 5 of 33 ends

Fire Department Inspection:

Paso Robles Municipal Code Section 21.69.120.D.11 states, All food trucks shall be inspected and approved by the Paso Robles Fire and Emergency Services Department prior to issuance of its initial business license and from time to time thereafter in the discretion of the Paso Robles Fire and Emergency Services Department. At a minimum, all cooking equipment producing grease-laden vapors shall be protected by a UL 300 listed automatic fire extinguishing system. A Class K fire extinguisher shall be provided within each vending vehicle at an accessible location. All fire protection equipment shall be properly maintained and serviced at intervals required by the California Fire Code.

Several comments received have requested clarification of this section of the code because the Fire Department has not been conducting food truck inspections since January 1, 2023, when the responsibility was delegated to the County of San Luis Obispo Environmental Health Department. However, the 2025 California Fire Code allows the City of Paso Robles Fire Department regain control to conduct necessary inspections to ensure fire safety on all food trucks. Effective January 1, 2026, the City of Paso Robles Fire Department will again be the agency responsible for inspecting food trucks annually and hood systems biannually. As the Fire Department works on developing a process, Community Development staff will work closely with them to ensure consistent requirements and language and the public will be updated as soon as possible.

Enforcement:

The Community Service Officers are tasked with enforcement of City food truck standards and permitting requirements. In early 2025, when the number of complaints about food trucks escalated, officers began making more frequent contact with food truck operators. At the time, there was confusion about permitting requirements for operating a food truck in Paso Robles. Officers requested additional resources and guidance from the Community Development Department to help them educate food truck operators about City food truck standards and permitting requirements. In an effort to assist the enforcement effort for food trucks operating out of compliance, Community Development staff has developed informational flyers with a QR code to the food truck webpage and increased interdepartmental coordination to track food truck permitting status.

Community Service Officers continue to struggle to enforce permitting requirements on food trucks who claim to operate on a single site for less than 7 days. It takes considerable staff time to return repeatedly to document actual time spent on a single site. Similarly, a process is needed to keep permitted food truck operators in compliance with the terms of their temporary use permit.

Recommendation #3: Staff recommends that Paso Robles Municipal Code Section 21.69.120 be amended so that a temporary use permit is required for ALL food trucks operating on a single site for between 1 day and 1 year unless the food truck is providing food for a special private event on private property lasting no more than 1 day where the food truck operator has been invited by the event organizer to participate (note, food trucks at City sponsored events are not subject to PRMC 21.69.120).

Recommendation #4: Staff recommend amending Paso Robles Municipal Code Section 21.69.120 to require businesses who have special events totaling 7 or more days in a year, where a food truck is invited to participate, to obtain a temporary use permit for operation of the food truck(s). This temporary use permit would cover all food trucks who operate as specified in the temporary use permit.

Page 6 of 33 ends

Setbacks
An additional factor to consider is proximity of food trucks to property lines, especially those adjacent to a public street. When placed too close to the public right-of-way, food trucks have the potential to interfere with public travel. Further, the closer a truck is to a property line, the louder any generator will sound off site.

Recommendation #6: Staff recommends the ad hoc committee consider requiring a minimum setback from public sidewalks.

Proximity to Downtown:

The majority of complaints received regarding food trucks in early 2025 were related to trucks operating downtown near the park and where there is a high concentration of brick-and-mortar food businesses and limited sites that can meet the criteria for locating a food truck.

Recommendation #7: Staff recommends the ad hoc committee consider options to restrict food trucks from the downtown core to reduce conflict.

Two maps are provided for the committee’s consideration. Food trucks might be required to stay outside the TC-1 zoning district, which is outlined in Map 1 below. Alternatively, food trucks might be required to locate a certain distance from City Park. Buffers of 100, 200, and 300 feet are shown in Map 2 below.

Map 1. TC-1 Zoning District Map 2. Buffers from City Park Fiscal Impact
There is no fiscal impact as a result of this ad hoc committee meeting. Fiscal impact will be analyzed prior to finalizing any decisions made by the City Council.

Best Management Practices for Commissary Kitchens
This letter serves as confirmation of our commitment to upholding the highest standards of sanitation and environmental responsibility within our commissary kitchen operations. We understand the importance of following best management practices regarding the handling of Fats, Oils, and Grease (FOG). As such, we will adhere to the guidelines outlined in the FOG booklet.

Our team will ensure that:
• No FOG will be deliberately dumped down any drain. All FOG will be properly collected and disposed of according to local regulations. • Regular maintenance of grease traps and other waste management systems will be conducted. This will help prevent clogs and spills that could negatively impact the city's infrastructure.
• All staff will be trained on proper FOG handling procedures to ensure that everyone understands the importance of these practices and their impact on the environment.

We are confident that by following these procedures, we can effectively manage FOG and help protect the city's sanitation system. We are dedicated to upholding these policies while operating within this facility.

By signing this form, we acknowledge that the Commissary Kitchen Owner has provided us with the City of Paso Robles Fats, Oils, and Grease Control Manual.

Formal Complaint: Food Truck Operations

• Child Safety: The operators bring a child to work but are often inattentive because they are busy
taking orders, leaving the child unsupervised.
• Fire Safety: A recent fire involved my son, an off-duty firefighter, who had to remove a propane tank
to prevent an explosion. An employee attempted to put out a grease fire with water, showing a lack
of fire safety knowledge.
• Noise Disturbance: The business routinely uses a leaf blower and impact drill around 1:30 AM,
disturbing the neighborhood.
• Schedule: The food truck operates three days per week, repeatedly exposing the community to
these risks.

Good morning. I have a question for the committee meeting tonight about the food trucks but I cannot attend. I know that canopies or tarps are not allowed. The rainy season is starting now and we have concerns about how the lack of any shelter will impact our business. I’m sure that other business owners will have the same concerns.

Is there any chance of bringing this up for discussion? La conchita feliz food truck.
