Surplus Land Act
• The California Department of
Housing and Community
Development (HCD) has
confirmed that the sale of the
Property is subject to the Surplus
Land Act
• The California Surplus Land Act
(SLA) is a state law that governs
how cities, counties, and other
public agencies must handle
government-owned land they no
longer need.
Surplus Land Act
•Before selling or leasing surplus public
land, agencies must first offer it to certain
priority groups—especially affordable
housing developers, as well as schools,
parks, and open-space agencies.
•Agencies must follow specific
procedures, timelines, and reporting
rules.
•If they skip the required steps, they can
face financial penalties and their land
deals may be invalidated.
• No exemptions apply if the prospective
buyer is the Pioneer Museum Foundation.
Recommendation:
Approve Resolution 25-XXX declaring pursuant
to Government Code Section 54221 that the
Property is non-exempt surplus land, approving
the notice of availability therefor, authorizing
the City Manager to comply with the Surplus
Land Act, and finding that such declaration is
exempt from environmental review under the
California Environmental Quality Act pursuant
to Sections 15060(c) and 15312 of the CEQA
Guidelines.
SLA Process
• Declare property as surplus in a public meeting-November 18, 2025 • Issue Notice of Availability (NOA) for 60 days
• If there is interest, must enter a 90-day period of good faith negotiations giving priority to affordable housing development
• After completing the required notice and negotiation steps, the agency can sell or lease the property to others.
