Why Are We Here?
Council approved the Cannabis Regulatory Permit program on August 18, 2026.
Council directed staff to return with fees under the approved Option A – hybrid service delivery model.
Tonight’s action is approval of the fee schedule needed to administer and sustain the regulatory program.

1. Provides an ongoing regulatory mechanism for non-storefront cannabis delivery businesses operating within the City.
2. Monitors ownership, operations, compliance, security, recordkeeping, vehicles and drivers.
3. Supports inspections, renewals, transfers and financial auditing.

Fees were developed using a full cost-recovery methodology.
Costs include City staff time, consultant services, inspections, compliance monitoring, and applicable administrative overhead.
Fees are intended to recover the reasonable costs of the specific regulatory services provided – not generate revenue.
This approach avoids having the General Fund subsidize specialized regulatory activities attributable to cannabis businesses.

The Cannabis Regulatory Permit fee does not replace other applicable City requirements.
Businesses remain responsible for applicable fees and taxes associated with (but not limited to):
▪ Conditional Use Permit
▪ Building Permit
▪ Business License Tax Certificate
▪ Cannabis Business Tax

These are regulatory fees, not development-related fees. The 60-day waiting period under Government Code Section 66017 does not apply.
Staff recommends the fees become effective immediately upon Council adoption.
Fees will be adjusted annually using the Consumer Price Index. –Annual adjustments become effective July 1.

been provided in accordance with Government Code
Sections 66016 and 66018.
A duly noticed public hearing is being held as part of
tonight’s regularly scheduled meeting.
The action is exempt from CEQA under Public Resources
Code Section 21080(b)(8), relating to charges established to meet operating expenses.
