RECOMMENDATION

BACKGROUND
Motion to approve Second Reading of Ordinance No. 859, reading by title only, waiving further reading.
Motion to Adopt Ordinance No. 859, reading by title only, waiving further reading.
ANALYSIS
On December 21, 2021, the City Council approved the first reading and introduction of Ordinance No. 859 in regards to approving a Development Agreement with the Applicant for the Baldwin Ranch North Project with no changes requested. Staff is now requesting for the City Council to approve the second reading and adoption of Ordinance No. 859 as presented and hereto attached.
FISCAL IMPACT
Adoption of this Development Agreement functions in tandem with the amended the Cooperation Agreement, which has been approved by the County and the City. The Development Agreement contains terms where the Applicant would assume the City’s obligations under the Cooperation Agreement. Adoption of both the Development Agreement and an amendment to the Cooperation Agreement would allow the Project to proceed and would not result in new financial obligations for the City.
