2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON, 4 CALIFORNIA, CALLING A SPECIAL NOTICE PROCEEDING AND SETTING THE 5 TIME AND PLACE FOR A PUBLIC HEARING ON RATES, FEES AND CHARGES FOR 6 WATER SERVICE(S)
7 8 The City Council of the City of Patterson (hereafter referred to as the “City Council”) does resolve as 9 follows:
10 11 WHEREAS, the City of Patterson (“City”) owns and operates the City’s water utility 12 system, which provides water service(s) to the community; and, 13 14 WHEREAS, the City Council has by previous Resolution set rates, fees and charges for 15 water and service(s); and,
16 17 WHEREAS, the City Council has retained Bartle Wells Associates for the purpose of 18 assisting with the Water Rate Analysis and Prop 218 mailing of Notices to property owners and rate 19 payers pursuant to Article XIII D of the California Constitution; and, 20 21 NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE 22 CITY COUNCIL, PURSUANT TO SECTION 6 OF ARTICLE XIIID OF THE 23 CONSTITUTION OF THE STATE OF CALIFORNIA, AS FOLLOWS:
24 25 Section 1 Calling a special notice proceeding: Pursuant to Section 6 of Article XIID of the California 26 Constitution, a special notice proceeding is hereby called on the proposition of increasing rates, fees 27 and charges for water service(s).
28 29 Section 2 Description of special notice proceeding (Prop 218 Notice): The special notice proceeding 30 on the proposition of increasing rates, fees and charges for water service(s) pursuant to Section 6, of 31 Article XIII D of the California Constitution consists of a mailed notice, distributed to the property 32 owners and rate payers of record within the City as of the County’s last equalized roll and the City 33 latest rate payer database. Each property owner and/or rate payer has the right to submit written 34 protest against the proposed rates, fees and charges and may do so by mail or in person to the City 35 Clerk not later than the conclusion of the Public Hearing on Tuesday, June 21, 2022. At the Public 36 Hearing, pursuant to Section 6 of Article XIII D of the California Constitution, the City shall 37 consider all protests against the proposed rates, fees and charges. If written protests against the 38 proposed fee or charge are presented by a majority of owners of the identified parcels, the City shall 39 not impose the fee or charge.
40 41 Section 3 Rates, fees and charges for water service(s): The City Council adopted Resolution No. 42 2005-82 on October 18, 2005, which amended the City’s Municipal Code with rates, fees and 43 charges for water service(s). The Resolution is hereby included by reference. 44 45 Section 4 Notice: The City shall give notice of the time and place of the Public Hearing to all 46 property owners and rate payers within the City by causing the publishing of this Resolution once in 47 the local newspaper for two consecutive weeks not less than ten (10) days before the date of the 48 Public Hearing, and by posting a copy of this resolution on the official bulletin board customarily 49 used by the City Council for the posting of notices. Written protests must be received prior to the 2 1 conclusion of the Public Hearing, at which they will be considered. At the Public Hearing, all 2 interested persons shall be afforded the opportunity to hear and be heard. 3 4 Section 5 Notice of Public Hearing: Notice is hereby given that a Public Hearing on these matters 5 will be held by the City Council on Tuesday, June 21, 2022 at 7:00 p.m. or as soon thereafter as 6 feasible in the City Council Chambers, located at No. 1 Plaza, Patterson. 7 8 Section 6 The City Clerk is hereby authorized and directed to give notice of such hearing as provided 9 by law.
