RESOLUTION NO. 2022-30
A RESOLUTION OF THE PATTERSON CITY COUNCIL
APPROVING THE SUBDIVISION IMPROVEMENT AGREEMENT AND
ACCEPTING FINAL MAPS FOR THE CLAYTON SHIRE PHASE-2 SUBDIVISION
LOCATED IN THE VILLAGES OF PATTERSON MASTER DEVELOPMENT PLAN (APN: 047-035-003)
WHEREAS, VOP 2.1, LLC, (“Developer”) own tracts of land consisting of approximately
18.82 gross acres in the City of Patterson (“City”) known as the “Clayton Shire” subdivision.
Clayton Shire is located within the Villages of Patterson Master Development Plan (“VOP Development Plan”); and
WHEREAS, on December 12, 2006, the City adopted Resolution 2006-112, which approved a number of entitlements relating to the VOP Development Plan, including but not limited to, Vesting Tentative Subdivision Maps “A” and “B” (collectively, the “Tentative Map”); and
WHEREAS, on December 19, 2006, the City adopted Ordinance No. 681, which approved a Development Agreement that applies to properties within the VOP Development Plan. On October 15, 2018, the City approved an Operating Memorandum memorializing certain revisions to implement and update the 2006 Development Agreement (collectively, the “Development Agreement”); and
WHEREAS, Developer has submitted Final Map for Clayton Shire - Phase 2 to City for acceptance and recording; and
WHEREAS, in order for the City to accept and record the Final Map for Clayton Shire – Phase 2, the Developer must execute a Subdivision Improvement Agreement to guarantee completion of the Improvements; and
WHEREAS, under the attached Subdivision Improvement Agreement, Developer is required to post securities to guarantee construction of the Improvements, and to guarantee payment for materials, work, labor, and warranty of the work; and WHEREAS, City Staff has determined that the Subdivision Improvement Agreement and the Final Map conform to the Tentative Map, the Subdivision Map Act, the City’s subdivision ordinance, the Development Agreement, and the VOP Development Plan; and WHEREAS, the purpose of this Resolution is to authorize the execution of the Subdivision Improvement Agreement, attached hereto as Exhibit A, and also to authorize the acceptance and recording of the Final Map for Clayton Shire – Phase 2. {CW108191.4}
NOW, THEREFORE, BE IT RESOLVED that the Patterson City Council hereby approves the attached Subdivision Improvement Agreement with Developer, authorizes the City Manager to execute and perform all acts pursuant to the Subdivision Improvement Agreement, approves the acceptance and recording of the Final Map for Clayton Shire – Phase 2, and further authorizes the City Manager to perform all acts necessary and incidental to carry out the purposes of this Resolution.
