SUBJECT: Adoption of Resolution Nos. 2022-40 and 2022-41 Authorizing the City Manager to Execute a One-Year and a Three-Year Consortium Agreement with Stanislaus County for Participation in the HOME Investment Partnership Program administered by the U.S. Department of Housing and Urban Development (H.U.D.)
RECOMMENDATION
Staff recommends that the City Council adopt Resolution Nos. 2022-40 and 2022-41 authorizing the following:
1. The City Council hereby approves and authorizes the City Manager to execute the One-Year HOME Investment Partnership Consortium Agreements with the County and participating Cities to enable joint participation in HUD's HOME program.
2. The City Council hereby approves and authorizes the City Manager to execute the Three-Year HOME Investment Partnership Consortium Agreement with the County and participating Cities to enable joint participation in HUD's HOME Program.
3. The City Manager is authorized and to act on behalf of the City in connection with the implementation of the Consortium Agreement, ongoing operation of the HOME Program and other activities necessary to carry out the intent of the Consortium Agreements.
BACKGROUND
Stanislaus County ("County") and the City of Patterson ("City") desire to participate in the HOME Investment Partnership Program administered by the U.S. Department of Housing and Urban Development. The program will promote the public health, safety, and welfare by providing grant funds to be used by the City and County to improve housing opportunities for low and moderate-income households.
ANALYSIS
HUD requires that the parties enter into a Consortium Agreement for participation in the HOME Investment Partnership Program for the periods of time from October 1, 2022 to September 30, 2023 and from October 1, 2023 to September 30, 2026, to define their rights and obligations as a participant in the Program.
The proposed Consortium Agreement is consistent with the General Plan and with City and County policies encouraging cooperation between agencies on issues of regional significance such as affordable housing.
The proposed Consortium Agreement will promote the public health, safety, and welfare by enabling the City and County to participate in the U.S. Department of Housing and Urban Development's HOME Investment Partnership Program; thus, making available funds for a variety of housing, economic development, and public services programs not otherwise available.
The City and County enter into yearly subrecipient agreements which establish administrative policies and procedures, performance standards, and guidelines for funding specific programs and projects.
The proposed Consortium Agreement is not a "project" for purposes of compliance with the provisions of the California Environmental Quality Act ("CEQA").
FISCAL IMPACT
There is no impact to the City General Fund as all program delivery and administrative costs will be funded through the HOME Program allocation.
