2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON, 4 CALIFORNIA, DECLARING THE RESULTS OF A NOTICED PROTEST 5 PROCEEDINGS AND ADOPTING A FIVE-YEAR SCHEDULE OF WATER RATE 6 ADJUSTMENTS
7 8 The City Council of the City of Patterson (hereafter referred to as the “City Council”) does 9 resolve as follows:
10 11 WHEREAS, the City of Patterson (“City”) owns and operates the City’s water utility 12 system, which provides water service(s) to the community; and, 13 14 WHEREAS, the City Council has by previous Resolution set rates, fees and charges for 15 water and service(s); and,
16 17 WHEREAS, the City Council has retained Bartle Wells Associates for the purpose of 18 assisting with the Water Rate Analysis and Prop 218 mailing of Notices to property owners and 19 rate payers pursuant to Article XIII D of the California Constitution; and, 20 21 WHEREAS, a mailed Prop 218 notice was distributed to the property owners and rate 22 payers of record with in the City as the County’s last equalized roll and the City’s latest rate 23 payer database. The property owners and rate payers as of the close of the Public Hearing held 24 on June 21, 2022 consented to the increase of rates, fees and charges for water service; and 25 26 NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY 27 THE CITY COUNCIL OF THE CITY OF PATTERSON, AS FOLLOWS:
28 29 Section 1 The above recitals are true and correct. 30 31 Section 2 The canvass of the written protests cast at the noticed protest proceeding held 32 on June 21, 2022, is hereby approved and confirmed.
33 34 Section 3 The proposition, presented to qualified property owners and rate payers for 35 receipt by the City Clerk each has received a notice. Of the qualified property owners and rate 36 payers filing written protests at said noticed protest proceeding, the proposition has carried. The 37 City Council is hereby authorized to take the necessary steps to adopt the following five-year 38 schedule of increased rates, fees and charges for water services(s) as authorized by the 39 proposition.

3 Section 4 The City Clerk is hereby directed to enter this Resolution on the minutes of the 4 City Council which shall constitute the official declaration of the result of such noticed protest 5 proceeding.
6 7 Section 5 This Resolution shall become effective immediately upon its adoption. 8 9 Section 6 The City Clerk shall certify the adoption of this Resolution. 10 The foregoing resolution was passed by the City Council at a regular meeting held on the 21 st
11 12 day of June 2022, and the resolution adopted by the following roll call vote:
