RECOMMENDATION
Motion to Approve Resolution No. 2022-37 Approving the Subdivision Improvement Agreement and to Accept Final Maps for the Baldwin Ranch North Subdivision Located in the West Patterson Business Park Master Development Plan.
BACKGROUND
The Baldwin Ranch North subdivision is located within the West Patterson Business Park Master Development Park. Baldwin Ranch North consists of approximately 90.4 gross acres subdivided into 451 lots. Baldwin Ranch Development, LLC is the developer of the Baldwin Ranch North subdivision, herein after referred as (“Developer”). Developer will develop Baldwin Ranch North in accordance with all City Standards, Specifications and Approved Plans. This Resolution would approve the Subdivision Improvement Agreement and accept the Final Maps for the Baldwin Ranch North - Units 1-4 subdivision.
ANALYSIS
Divisions of land are subject to the requirements and procedures of the Subdivision Map Act and the City’s subdivision ordinance relating to the filing, approval, and recordation of subdivision maps (the “Subdivision Laws”). The City approved the Tentative Map for Baldwin Ranch North in 2020. Pursuant to Developer’s conditions of approval, Developer is required to install certain public improvements to support the orderly development of the property, including but not limited to, streets, water mains, sanitary sewers, storm drain systems, storm basin, sidewalks, parks, bike paths, and other rights-of-way for public use (the “Improvements”).
Under the Subdivision Laws, Developer must either install the Improvements prior to the City’s acceptance and recording of the Final Map, or alternatively, execute a Subdivision Improvement Agreement. A Subdivision Improvement Agreement allows a developer to install public improvements after approval and recordation of a final map and also establishes the security device to guarantee completion of the Improvements. Developer is entering into the attached Subdivision Improvement Agreement with the City to guarantee completion of the necessary Improvements and to receive approval of the Baldwin Ranch North, Units 1-4 Final Maps.
The Subdivision Improvement Agreement establishes Developer’s Improvement obligations and ensures completion of the Improvements. Adoption of this Resolution approves the attached Subdivision Improvement Agreement, accepts the Final Maps for Baldwin Ranch North, Units 1- 4, and would allow Developer to proceed with construction of the Improvements.
FISCAL IMPACT
There is no budget impact to the City. This action will pave the way for construction of new residential units and related public improvements for the Baldwin Ranch North subdivision.
