City Council Agenda Report

MEETING DATE: October 4, 2022
ITEM NO: 5.6
SUBJECT: Adopt Resolution No. 2022-69, approving a Memorandum of Understanding between the Stanislaus Council of Governments (StanCOG) and the City of Patterson for Suballocation of Regional Early Action Planning (REAP) funds.

RECOMMENDATION
Motion to Adopt Resolution No. 2022-69, approving a Memorandum of Understanding between the Stanislaus Council of Governments (StanCOG) and the City of Patterson for Suballocation of Regional Early Action Planning (REAP) funds.

BACKGROUND
In 2021, the State approved the REAP program, a one-time grant funding program to help jurisdictions meet state housing goals, including accelerating infill housing and reduce per capita vehicle miles traveled. The City of Patterson’s portion of the allotted funding is $59,910.69, with an initial allotment of $16,807.80.

The City’s 6th Cycle Housing Element Update is due to the State by June 30, 2023. The Housing Element is a required element of the City’s General Plan, as required by State law. However, unlike other sections of the General Plan, the Housing Element must be updated every eight years and be reviewed and certified by the State Department of Housing and Community Development (HCD). The purpose of the Housing Element is to identify and analyze existing and projected housing needs and outline goals, policies, and programs for the preservation, improvement, and development of housing for households of all income levels.

ANALYSIS
REAP funds may be used for planning activities to meet the regional housing needs assessment and to spur affordable housing production. Activities eligible for REAP funding include the following:
- RHNA and Housing Element planning activities
- Technical assistance for planning documents to expedite application processing for affordable housing
- Establishing housing trust funds for affordable housing - Performing infrastructure planning for new housing
The Housing Element provides a blueprint for how the City will achieve housing goals, including:
- Providing an analysis of existing and projected housing needs for all income levels as well as special needs housing.
- Establishing an inventory of land suitable for residential development - Analyzing potential and actual constraints on the maintenance, improvement, and development of housing.

The goals of REAP funding, as established by HCD the goals of the Housing Element are closely aligned. The City has received preliminary approval from StanCOG, and by extension, HCD, to use this grant funding toward production of this State mandated document. Execution of this Memorandum of Understanding enables the City of Patterson to become eligible for $59,910.69 of REAP grant funding.

FISCAL IMPACT
The cost to prepare the 2023 Housing Element is preliminarily estimated to be $200,000 of General Fund monies. The $59,910.69 of REAP funding would offset a portion of that amount.
