SUBJECT: Approve Resolution No. 2022-72 Approving the Landscape and Stormwater Treatment Control Measures (SCMs) Maintenance & Access Agreement with Patterson Center LLC for the Grocery Outlet Bargain Market and Dutch Bros Projects; Authorizing the City Manager or his Designee to Execute the Agreement; and Authorizing the City Clerk to Record the Agreement.
RECOMMENDATION
Motion to Approve Resolution No. 2022-72 Approving the Landscape and Stormwater Treatment Control Measures (SCMs) Maintenance & Access Agreement with Patterson Center LLC for the Grocery Outlet Bargain Market and Dutch Bros. Projects; Authorizing the City Manager or his Designee to Execute the Agreement; and Authorizing the City Clerk to Record the Agreement.
BACKGROUND
The City Council approved the development of Grocery Outlet Bargain Market and Dutch Bros.
Projects located within the South Rogers development, at 2900 & 2930 Sperry Avenue, Patterson, CA (APN# 021-093-005). As part of the Conditions of Approval and the City’s Stormwater Ordinance No. 777, the developer was required to install onsite landscaping and stormwater treatment control measures that prevent the pollution of stormwater runoff from the project site to enter into an agreement for the operation and maintenance and preservation of the stormwater treatment control measures, see attached agreement, to comply with all stormwater regulations (State, Federal, and local).
ANALYSIS
The Landscape and Stormwater Control Measures Maintenance Agreement has been prepared and reviewed by all parties and is attached for Council’s approval. Additionally, a resolution is also attached for Council approval. The resolution is required for the city to record the agreement.
FISCAL IMPACT
There is no budget impact associated with this item. All costs associated with this item are paid for by the developer, including the on-going maintenance.
