RESOLUTION NO. 2022-80
A RESOLUTION OF THE PATTERSON CITY COUNCIL
TO APPROVE AND AUTHORIZE EXECUTION OF A PURCHASE AND SALE AGREEMENT FOR THE PROPERTY LOCATED AT 33 SOUTH DEL PUERTO
AVENUE, FOR A PERMANENT LOCATION FOR THE PATTERSON PUBLIC
SAFETY CENTER
WHEREAS, the City of Patterson (“City”) is authorized to lease and hold real property to carry out its powers and functions, pursuant to Government Code section 37350 et seq.; and WHEREAS, City has its own Police Department, which is consolidated with the Stanislaus County Sheriff’s Department; and
WHEREAS, the location of the Police Department is 33 South Del Puerto Avenue near the location of Patterson City Hall (the “Property”), pursuant to a lease agreement with the Property Owner; and
WHEREAS, City has determined that the Property is insufficient for current Police Department needs, and also insufficient for the future growth of Patterson law enforcement as City population increases; and
WHEREAS, City seeks to construct a new Public Safety Center at the Property, which would be the home of the Police Department, certain Fire Department personnel, and other municipal offices as the City may require; and
WHEREAS, City has expressed to the Property Owner that it would proceed to acquire the Property by condemnation, given that the Property would be for a public use by which City may exercise the power of eminent domain; and
WHEREAS, City and Property Owner have agreed to the Purchase and Sale Agreement for the Property attached hereto as Exhibit A (“Purchase Agreement”), based on the fair market value of the Property, to avoid the time and expense of condemnation proceedings; and WHEREAS, City has determined that use of the Property for a permanent Public Safety Center would be for the common benefit, and would advance the public health, safety, and welfare of the residents of Patterson.
NOW, THEREFORE, BE IT RESOLVED that the Patterson City Council hereby approves the attached Purchase Agreement for the Property, authorizes the City Manager to execute the Purchase Agreement subject to any minor revisions approved by the City Attorney, and authorizes the City Manager to perform all acts necessary and incidental to carry out the purposes of this Resolution.
