ITEM NO: 5.5
SUBJECT: Adopt Resolution No. 2022-78 Approving the Subdivision Improvement Agreement and to Accept the Final Map for the Villages of Patterson Phase 1 Triplexes.
RECOMMENDATION
Motion to Adopt Resolution No. 2022-78 Approving the Subdivision Improvement Agreement and to Accept the Final Map for the Villages of Patterson Phase 1 Triplexes.
BACKGROUND
The Triplexes subdivision, consisting of three (3) phases and a total of forty-four (44) lots, is located within the Villages of Patterson Master Development Plan (“VOP Development Plan”).
The Triplexes subdivision will involve approximately 132 units (3 units per lot) in the southeastern quadrant of the VOP Development Plan. Phase 1 of the Triplexes consists of approximately 7.13 gross acres subdivided into 16 lots. Trivo LLC, one of the developers of the VOP Development Plan, is the developer of the Triplexes (“Developer”). Developer will develop the Triplexes in accordance with the VOP Development Plan. This Resolution would approve the Subdivision Improvement Agreement and accept the Final Map for Phase 1 of the Triplexes (i.e., 16 lots).
ANALYSIS
Divisions of land are subject to the requirements and procedures of the Subdivision Map Act and the City’s subdivision ordinance relating to the filing, approval, and recordation of subdivision maps (the “Subdivision Laws”). The City approved the Tentative Map for the Triplexes in 2006 in conjunction with other entitlements relating to the VOP Development Plan. Pursuant to Developer’s conditions of approval, Developer is required to install certain public improvements to support the orderly development of the property, including but not limited to, streets, alleys, water mains, sanitary sewers, storm drain systems, sidewalks, bike paths, and other rights-of-way for public use (the “Improvements”).
Under the Subdivision Laws, Developer must either install the Improvements prior to the City’s acceptance and recording of the Final Map, or alternatively, execute a Subdivision Improvement Agreement. A Subdivision Improvement Agreement allows a developer to install public improvements after approval and recordation of a final map and also establishes the security device to guarantee completion of the Improvements. Developer is entering into the attached Subdivision Improvement Agreement with the City to guarantee completion of the necessary Improvements and to record the Phase 1 Final Map for the Triplexes.
The Subdivision Improvement Agreement establishes Developer’s Improvement obligations and ensures completion of the Improvements. Adoption of this Resolution approves the attached Subdivision Improvement Agreement, accepts the Phase 1 Final Map for the Triplexes, and would allow Developer to proceed with construction of the Improvements.
FISCAL IMPACT
There is no budget impact to the City. This action will pave the way for construction of new residential units and related public improvements for Phase 1 of the Triplexes Subdivision.
