WOMEN’S HISTORY MONTH
“March 2023”
Whereas, Women, have paved the way through leadership, innovation, and have made significant contributions in science, medicine, technology, business, politics, entrepreneurship, and arts and culture; and
Whereas, Women have been leaders in securing their own rights of suffrage and equal opportunity; and in the civil rights, and peace movements, creating a more fair and just society for all; and Whereas, Whether serving in elected positions across the United States, leading groundbreaking civil rights movements, venturing into unknown frontiers, or programming revolutionary technologies, generations of women that knew their gender was no obstacle to what they could accomplish have long stirred new ideas and opened new doors, having a profound and positive impact on our community; and Whereas, We must recognize when telling the story of the United States history, that despite their many contributions, the role of women in history has been consistently overlooked and undervalued; and Whereas, History cannot be properly shared without sharing the extraordinary women that have made significant contributions to the growth, strength and evolution of the City of Patterson, the State of California, and the Unites States of America in countless ways; and Whereas, In the City of Patterson, we must recognize and celebrate that we have been better served by in our history by having women in various leadership roles including city council, city committees, and local school boards; and
Whereas, In the City of Patterson, we must recognize and celebrate the positive impact current women leaders have had on future women leaders in the City of Patterson; and Whereas, the City of Patterson encourages its citizens to recognize and celebrate the contributions and accomplishments of woman in our community not just one day or one month, but every day; and then Therefore: Be it resolved that the City of Patterson proclaims the month of March 2023 as Women’s History Month. We humbly thank and pay homage to all City of Patterson women past and present for their strength and courage as well as their empowerment of others.
IN WITNESS, HEREOF, I have hereunto set my hand and caused the official Seal of the City of Patterson to be affixed this 14th day of March 2023. ____________________________

SUBJECT: Approve Resolution No. 2023-05 Proclaiming Arbor Week during March 7-14, 2023 in the City of Patterson.
RECOMMENDATION
Motion To Approve Resolution No. 2023-05 Proclaiming Arbor Week during March 7-14, 2023 in the City of Patterson.
BACKGROUND
The City of Patterson and many other communities in California are working together to promote and support the importance of California Arbor Week. The City of Patterson understands the importance of trees and its goal to preserve as many trees as possible to obtain the benefits they supply such as reduced energy costs, increased property values, aesthetics, and clean air. The City of Patterson also obtained its Tree City USA status in 2016 through the Arbor Day Foundation with the assistance of the Cal-Fire Grant funds secured by the City. This is a nationwide movement that provides the framework necessary for communities to manage and expand their urban forest. This is achieved by meeting four (4) core standards of sound Urban Forestry Management; maintaining a tree department; having a community tree ordinance; and spending at least $2 per capita on Urban Forestry and celebrating Arbor Day.
Currently, the City has an Urban Forestry Division and Parks Division whose primary responsibility is to maintain and preserve over 13,066 street and park trees. However, it is important that the City expands its efforts to the community through education and public outreach.
ANALYSIS
6.2 Packet Pg. 6
Every year during March 7-14, Californians celebrate Arbor Week by planting and maintaining trees within their communities. California Arbor Week helps unite the community and help educate on the value trees provide to building successful, healthy cities, and neighborhoods.
Every year, the City holds various events for the students who attend the after school programs at the various elementary schools. Food, activity stations, prizes, free giveaways, and educational tree plantings are held.
This year, the City will be hosting Arbor Week at Creekside Middle School. The event will be held on March 8, 2023 from 1:30 pm to 3:00 p.m. The middle school students will get to learn about the importance of trees and will help plant a few trees at their school. The Urban Forestry team will also be able to teach them about their role in keeping the community’s trees healthy and maintained. They will bring some equipment so they can learn what they do.
FISCAL IMPACT
Funds for this event will be obtained from various budgets approved for public outreach and education, which include Water (610-790), Sewer (605-790), Stormwater Program (606), Parks (100-710), Garbage (600-790), and Urban Forestry (100-781).

SUBJECT: Approve the Department Heads and Unrepresented Salary Schedule Effective July 1, 2022
RECOMMENDATION
Motion to Approve the Department Heads and Unrepresented Salary Schedule effective July 1, 2022.
BACKGROUND
The City of Patterson unrepresented positions, consisting of administrative and technical staff, and department heads are not represented by any of the City’s recognized labor unions, are atwill, and therefore are not in a position to bargain for any changes in benefits and wages.
The City recently completed a city-wide compensation study conducted by Bryce Consulting.
The purpose of the study was to compare and analyze our current overall salary plan to that of our comparable market. To ensure we are competitive, especially in a time where vacancies are challenging to fill, the updated salary schedule adjusts classifications that lag behind the market in base salary and provides for a Cost of Living (COLA) increase
ANALYSIS
Staff has reviewed the budgetary impact, and at the attached salary schedule includes a base salary increase effective July 1, 2022 and an equity adjustment up to 5% for any classifications that are below the market median. For classifications that are more than 5% below market, any remaining equity will be divided over the next two fiscal years, along with a COLA of 3% - 5% based upon the consumer price index and availability of funds. These increases are equivalent to

those that have already been approved and implemented for the American Federation of State, County, and Municipal Employees Local 10 (AFSCME) and the Patterson Management and Mid-Management Employees Association (PMMEA) bargaining units.
6.3 Packet Pg. 11
FISCAL IMPACT
Over the three-year period (July 1, 2022 to June 30, 2025), these salary changes are projected to increase the labor costs for department heads and unrepresented employees as follows:
The increased cost for FY 2023 is not included in the currently approved budget. Staff will seek approval to include the cost of these increases in the FY2022-23 mid-year budget amendment and future annual fiscal year budgets.

SUBJECT: Adopt Resolution No. 2023-06 to Authorize an Interfund Loan from the Water Enterprise Fund to the Storm Water Enterprise Fund for the Costs of Public Improvements.
RECOMMENDATION
Staff recommends the City Council adopt Resolution No. 2023-06 to Approve and Authorize an Interfund Loan from the Water Enterprise Fund to the Storm Water Enterprise Fund for the Costs of Public Improvements.
BACKGROUND
On December 12, 2006, the City Council (“City Council”) of the City of Patterson (“City”) adopted Resolution 2006-122, approving a Combined Preliminary and Final Development Plan and other entitlements for a development project known as The Villages of Patterson (“Villages Project”).
Following that approval, on December 19, 2006, the City Council adopted Ordinance No. 681 which approved a Development Agreement (“DA”) for the Villages Project. The DA divides the Villages Project into four (4) project areas, including VOP Area 1, located in the southeastern quadrant of the Villages Project area, south of Olive Avenue, west of Sycamore Avenue, east of Hartley Street, and north of Walnut Avenue. Patterson Ranch Development, LLC (“Developer”), has begun development of properties within VOP Area 1. As part of that development, the DA requires the installation of oversize public improvements to benefit other parcels within the area, subject to reimbursement with interest, for the costs associated with the public improvements that exceed Developer’s fair share allocation of the costs for the necessary improvements.
The Developer has installed the required public improvements, but a dispute has arisen with regard to the timing of the reimbursement obligation for those improvements. The City disputes any interpretation of the DA that requires payment of the reimbursement obligation for the public
6.4 Packet Pg. 14
improvements prior to the issuance of bond proceeds from Community Facilities District 2018-01.
Despite this, Developer has agreed to waive its claims as to timing of the full reimbursement obligation in exchange for reimbursement of some of their costs associated with the oversized public improvements.
With the exception of the City’s Storm Water Enterprise Fund, the City has funds sufficient in its other enterprise funds to provide the partial reimbursement amount to the Developer. The City’s Water Enterprise Fund has sufficient funds to address the discrepancy in the reimbursement amount from the City’s Storm Water Enterprise Fund. Therefore, the City is loaning funds from the Water Enterprise Fund to the Storm Water Enterprise Fund to proceed with reimbursing the Developer for some of their oversize improvement costs related to VOP Area 1 of the Villages Project.
ANALYSIS
Interfund loans are sometimes a necessary practice between City funds, and state law does not prohibit such loans between funds. Generally, interfund loans are used to: 1. Offset timing difference in cash flow, 2. Offset timing differences between expenditures and reimbursements, 3. Advance funds for capital improvement projects, or 4. Other needs deemed appropriate by the City Council.
To properly account for such a loan, the terms of an interfund loan should result in no permanent diversion of the source funds. Additionally, the terms of an interfund loan must identify the repayment source, specify the repayment schedule, impose interest at a rate at least equal to the investment earnings the source funds would have earned if the loan had not occurred, and be immediately due and payable if needed by the source fund.
Based on the inability of the Storm Water Enterprise Fund to meet the reimbursement obligation for the Developer and the Water Enterprise Fund’s ability to make up that difference, those funds were identified for the loan, in the amount of $1,600,000. The term of the loan is ten (10) years but may be repaid at any time. As the improvements completed in this request fall under the Villages of Patterson Community Facilities District (CFD), the loan will be paid back to the Water Enterprise Fund using proceeds from the CFD. As Such, the funds from the third bond tranche from the Villages of Patterson CFD is anticipated to pay the loan. The loan is subject to the Local Agency Investment Fund (“LAIF”) investment yield as an interest rate and the City is required to annually appropriate the monies necessary to repay the interfund loan. These requirements ensure that the interfund loan proposed under the Resolution comply with all requirements for interfund loans and that the loan will be repaid.
FISCAL IMPACT
The Resolution will not result in significant financial impact, except with respect to the interest charged for the loan. The interest paid will be at the same rate that the funds would have earned as the City’s enterprise funds are invested in the LAIF. The interfund loans ensures that the City avoids the costs of litigation of the Developer’s claims.
POLICY ALTERNATIVES
The City Council’s options are:
6.4 Packet Pg. 15
1. Adopt the Resolution No. 2023-06 without any changes;
2. Adopt the Resolution No. 2023-06 with changes and revisions;
3. Continue the item to a later meeting of the City Council and provide direction to staff for any changes; or
4. Reject the Resolution No. 2023-06 entirely.
