3 4 A RESOLUTION OF THE CITY OF PATTERSON, CITY COUNCIL, APPROVING 5 THE WATER, SEWER AND STORM DRAINAGE STUDY REPORT AND UPDATED 6 WATER, SEWER AND STORM DRAINAGE DEVELOPMENT IMPACT FEES, PER 7 CITY ORDINANCE NO. 608 (MUNICIPAL CODE SECTION 3.64)
8 9 WHEREAS, Government Code Section 66000 et seq., known as the Mitigation Fee Act 10 (AB 1600), authorizes local agencies to collect fees to mitigate the impacts of new development 11 for infrastructure improvements; and
12 13 WHEREAS, the City Council of the City of Patterson has adopted ordinance No. 608 14 and resolutions establishing and revising Development Impact Fees required to be paid at the 15 time a building permit is issued for new development based on the San Francisco Bay Area’s 16 Construction Cost Index (CCI); and
17 18 WHEREAS, all water, sewer, and storm drainage development impact fees within the 19 City of Patterson are scheduled to increase annually per the San Francisco Bay Area’s CCI, per 20 the adopted Resolution No. 2019-33; and
21 22 WHEREAS, all water, sewer, and storm drainage development fees within the City of 23 Patterson increases are effective January 1, 2022 and every January 1 thereafter; and 24 25 WHEREAS, the City Council of the City of Patterson desires to encourage the 26 construction of new development projects in the City and to promote economic development; 27 and
28 29 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 30 Patterson approves updated water, sewer and storm drainage impact fees effective 30 days after 31 the adoption of this resolution, per State Law, as described on Exhibit A attached hereto and 32 annual CCI annual increases based on the San Francisco Bay Area CCI effective every January 1 st 33 ; and
34 35 BE IT FURTHER RESOLVED that the City Manager, or his/her designee, is hereby 36 authorized as Signature Authority to execute all documents necessary to implement and secure 37 payment; and
38 39 I HEREBY CERTIFY that the foregoing resolution was passed by the City Council at a regular meeting held on the 21st 40 day of March, 2023 and the resolution adopted by the following 41 roll call vote:
