RECOMMENDATION
Motion to Approve First Reading and Introduction of Ordinance No. 867 Reading by Title Only, Waiving Further Reading, an Ordinance of the City Council of the City of Patterson, Amending (a) Section 6.28.070, Time for Filing, of Chapter 28, Firework Sales and Discharge, of Title 6, Health and Safety, and (b) Section 6.28.110, Fireworks stand specifications-Requirements, of Chapter 28, Firework Sales and Discharge, of Title 6, Health and Safety, of the Patterson Municipal Code to Allow for Extra Time in Applying to Operate and Erecting Firework Stands.
BACKGROUND
Currently, the Patterson Municipal Code requires that applicants for temporary permits to operate firework stands submit their applications no later than March 31st, and then erect their stands no earlier than June 26th. Several vendors of fireworks that conduct business in the City of Patterson have expressed that these dates are too early and have requested more time for both submitting applications and erecting the stands.
Staff recommends the City Council introduce the proposed Ordinance to amend the Patterson Municipal Code to provide the additional flexibility requested by firework vendors in the City within the limitations set forth in the State Fireworks Law (Health & Safety Code §§ 12500, et. seq.)
FISCAL IMPACT
There is no impact to the General Fund by adopting the proposed Ordinance.
POLICY ALTERNATIVES
The City Council’s options are:
1. Waive first reading, read by title only, and introduce the proposed Ordinance No. 867 without any changes;
2. Waive first reading, read by title only, and introduce the proposed Ordinance No. 867 with direction to staff for changes; or
3. Reject the Ordinance No. 867 entirely.
