City Council Agenda Report
TO: Mayor Clauzel and Members of the City Council
FROM: Ken Irwin, City Manager
BY: Mike Willett, Public Works Director
MEETING DATE: April 18, 2023
ITEM NO: 6.7
SUBJECT: Approve Resolution No. 2023-14 Approving a Deferred Improvement Agreement with Cynthia Bizzanelli and Andrew Ramirez of the Maria Ramirez Trust; Authorizing the City Manager to Execute the Agreement; and Authorizing the City Clerk to Record the Deferred Improvement Agreement.

RECOMMENDATION
Motion to Approve Resolution No.

BACKGROUND
The Public Works Department is responsible for making sure that all public improvements are installed per City standards and for the maintenance of the improvements once they are completed and accepted by the city.

Additionally, as part of the City’s Ordinances (Municipal Code Section 13.02.130), properties within the City limits are required to be connected to the City’s sewer system at the property owner’s expense and properly abandon the existing private septic system.

The City has identified several properties that have annexed into the City limits and/or are currently on private system for both water and sewer services. Properties who have been identified were notified of this requirement and Notice of Correction were recorded against the properties to trigger the requirement upon the sale/transfer of the property. This APN has been identified and the City has been working with the property owners to have them connect to both water and sewer since there is currently a water main available within 200’ of the property line.

The property owner(s) have submitted plans and secured a contractor to install the water connection within the next couple of months. However, due to the financial hardship of doing both connections at this time, the property owners are seeking a deferment for the sewer system.

ANALYSIS
Attached for review and approval is the “Deferred Improvement Agreement” for the sewer connection. The property owners are requesting two years to connect and/or sooner if the area develops. Once the agreement is executed and recorded it will remain in effect even if the property is sold. Attached for your review and approval is the Agreement that was prepared for this location.

FISCAL IMPACT
All costs associated with this item are paid by the property owners.
