2 3 A RESOLUTION OF THE CITY OF PATTERSON, CITY COUNCIL, APPROVING 4 THE WATER, SEWER AND STORM DRAINAGE STUDY REPORT AND UPDATED 5 WATER, SEWER AND STORM DRAINAGE DEVELOPMENT IMPACT FEES, PER 6 CITY ORDINANCE NO. 608 (MUNICIPAL CODE SECTION 3.64)
7 8 WHEREAS, Government Code Section 66000 et seq., known as the Mitigation Fee Act 9 (AB 1600), authorizes local agencies to collect fees to mitigate the impacts of new development 10 for infrastructure improvements; and
11 12 WHEREAS, the City Council of the City of Patterson has adopted ordinance No. 608 13 and resolutions establishing and revising Development Impact Fees required to be paid at the 14 time a building permit is issued for new development based on the San Francisco Bay Area’s 15 Construction Cost Index (CCI); and
16 17 WHEREAS, all water, sewer, and storm drainage development impact fees within the 18 City of Patterson are scheduled to increase annually per the San Francisco Bay Area’s CCI, per 19 the adopted Resolution No. 2019-33; and
20 21 WHEREAS, all water, sewer, and storm drainage development fees within the City of 22 Patterson increases are effective January 1, 2022 and every January 1 thereafter; and 23 24 WHEREAS, the City Council of the City of Patterson desires to encourage the 25 construction of new development projects in the City and to promote economic development; 26 and
27 28 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 29 Patterson approves updated water, sewer and storm drainage impact fees effective 30 days after 30 the adoption of this resolution, per State Law, as described on Exhibit A attached hereto and 31 annual CCI annual increases based on the San Francisco Bay Area CCI effective every January 1 st 32 ; and
33 34 BE IT FURTHER RESOLVED that the City Manager, or his/her designee, is hereby 35 authorized as Signature Authority to execute all documents necessary to implement and secure 36 payment; and
37 38 I HEREBY CERTIFY that the foregoing resolution was passed by the City Council at a regular meeting held on the 18th 39 day of April, 2023 and the resolution adopted by the following 40 roll call vote:
