RESOLUTION NO. 2023-23
A RESOLUTION OF THE PATTERSON CITY COUNCIL APPROVING A
MEMORANDUM OF UNDERSTANDING BETWEEN STANISLAUS COUNTY AND
THE CITY OF PATTERSON REGARDING THE REORGANIZATION
OF THE ZACHARIAS AND BALDWIN RANCH SOUTH MASTER PLAN AREA WHEREAS, on April 16, 2022, the City of Patterson (“City”) adopted the following resolutions and ordinances relating to the Zacharias and Baldwin Ranch South Master Plan (“Master Plan”), which establishes a comprehensive development and regulatory framework for the Master Plan area, including annexation of 1,297 gross acres into City limits:
1. Resolution No. 2022-62, certifying the Final Environmental Impact Report, adopting findings, adopting a Statement of Overriding Considerations, and adopting a Mitigation Monitoring and Reporting Program, in accordance with the California Environmental Quality Act (“CEQA”);
2. Resolution No. 2022-60, adopting the Master Plan, a General Plan Amendment, and Conditions of Approval for the buildout of the Master Plan;
3. Ordinance No. 862, prezoning the properties located within the Master Plan area;
4. Resolution No. 2022-61, authorizing the filing of a reorganization application with the Stanislaus Local Agency Formation Commission (“Stanislaus LAFCO”) to expand City’s Sphere of Influence (“SOI”) and annex the Master Plan area into City limits; and
WHEREAS, since adoption of the Master Plan, City staff has been preparing a reorganization application to submit to Stanislaus LAFCO, which would propose expanding City’s SOI and annexing the Master Plan area into City limits; and WHEREAS, Government Code section 56425(b) requires that, when a city submits an application to expand its SOI, representatives from the city and county meet to discuss the proposed boundaries and attempt to reach an agreement on development standards and planning and zoning requirements within the proposed SOI; and
WHEREAS, on January 18, 2023, representatives of City and Stanislaus County (“County”) met to discuss the proposed SOI and establish a framework for development standards and planning and zoning requirements that is agreeable to both parties; and WHEREAS, City and County representatives have agreed to the Memorandum of Understanding (“MOU”) attached and incorporated herein as Exhibit A, regarding development standards and planning and zoning requirements for the Master Plan area; and {CW126745.3}
WHEREAS, upon approval of the attached MOU from the County Board of Supervisors and the City Council, City staff will include the MOU in its reorganization application to Stanislaus LAFCO, as required by Government Code section 56425(b); and WHEREAS, Stanislaus LAFCO shall give great weight to the terms of the MOU when making its final determination on City’s proposal to expand its SOI (Government Code section 56425(b)); and
WHEREAS, the purpose of this Resolution is to approve and authorize execution of the attached MOU, and to facilitate the timely submittal and processing of City’s reorganization application to Stanislaus LAFCO.
NOW, THEREFORE, BE IT RESOLVED that the Patterson City Council hereby approves the MOU between Stanislaus County and City of Patterson attached hereto as Exhibit A, regarding the reorganization of the Zacharias and Baldwin Ranch South Master Plan area.
The City Manager is hereby authorized to execute the MOU, subject to any revisions approved by the City Attorney, and to perform all acts necessary and incidental to carry out the purposes of this Resolution.
