ANALYSIS
Once Council approval is received on all the items listed above, staff will prepare all items for surplus. Vehicles are replaced using age and mileage criteria. Vehicles are categorized as end of

5.8 Packet Pg. 41
service life when they reach 15 years, or they have reached 100,000 miles. These vehicles have surpassed the 15 years and mileage criteria to be placed on the surplus and replacement list.

Once they reach these criteria, they are still evaluated annually to see if they can be left in service for another year. These vehicles have been evaluated and our fleet mechanics are recommending they be surplussed. At this time, these vehicles are subject to repairs and discontinued parts that would render the vehicle unusable while waiting for parts and repair.

These instances may adversely affect the Public Works Department divisions in their daily maintenance and response to submitted work orders from the residents.

FISCAL IMPACT
The revenue received from the surplus will be returned back to its designated budget.

MEETING DATE: June 6, 2023
ITEM NO: 5.9
SUBJECT: Approve Addendum No. 2 to the Street Sweeping Contract Services Agreement with Contract Sweeping Services for a Five-Year Extension for Continued City-Wide Street Sweeping Services, Beginning July 1, 2023, through June 30, 2028.

RECOMMENDATION
Motion to Approve Addendum No. 2 to the Street Sweeping Contract Services Agreement with Contract Sweeping Services for a five-year extension for continued City-wide street sweeping services, beginning July 1, 2023, through June 30, 2028.

BACKGROUND
Currently, the City contracts commercial and residential street sweeping services to Contract Sweeping Services from Milpitas, CA. Residential routes are swept weekly and downtown streets and schools are swept daily. The five-year contract Addendum No. 1 with Contract Sweeping Services is set to expire June 30, 2023. Given the current economic climate, with inflation and the increased cost of doing business, the City negotiated Addendum No. 2 to the street sweeping contract services agreement. The extension would continue city-wide street sweeping services for an additional five years.

ANALYSIS
The current contract is scheduled to expire on June 30, 2023. Staff met with the current service provider, Contract Sweeping Services, and they have committed to extending the existing contract for five more years and provide the City with the same level of weekly street service, with the terms of services unchanged.

5.9 Packet Pg. 43
The terms included in Addendum No.2 are as follows:

1. The maximum fees to be charged by the Contractor set forth in years 1 through 5 for Addendum No. 2 are listed below. Year-1, the Contractor shall charge no greater than the maximum rate as provided in item 2. In years 2 through 5, the City will adjust the maximum fee under this addendum to reflect annual changes in the Consumer Price Index (CPI) for the SF-Bay Area statistical area. Such adjustments shall not exceed five percent (5%) per year. The adjustment shall become effective on the anniversary of the Effective Date and be based on the previous twelve-month index analysis. Years 2-5 of the proposed fees below include a 5% maximum CPI increase. Should actual CPI increase in year 2-5 be lower, the lower CPI increase will be applied.

2. Year-1, increase the current service cost by 10%, effective July 1, 2023, from $175,316.28 per year ($14,609.69 per month) to $192,847.91($16,070.66 per month).

3. Year-2, increase the service cost by a maximum 5% CPI, effective July 1, 2024, from $192,847.91 per year ($16,070.66 per month) to $202,490.30 ($16,874.19 per month).

4. Year-3, increase the service cost by a maximum 5% CPI, effective July 1, 2025, from $202,490.30 per year ($16,874.19 per month) to $212,614.82 ($17,717.90 per month).

5. Year-4, increase the service cost by a maximum 5% CPI, effective July 1, 2026, from $212,614.82 per year ($17,717.90 per month) to $223,245.56 ($18,603.80 per month).

6. Year-5, increase the service cost by a maximum 5% CPI, effective July 1, 2027, from $223,245.56 per year ($18,603.80 per month) to $234,407.84 ($19,533.99 per month).

7. The City will continue to bear responsibility for disposal and costs associated with street sweeper waste. Currently, the responsibility is accounted for in Addendum No. 1 and will continue with Addendum No. 2.

The current agreement set to expire on June 30, 2023, included two increases over the life of the term, the first and second years only. The prior five-year term included just one CPI increase.

Over the last 10 years of service the contractor has received three CPI increases, therefore staff concur that the request for an initial 10% increase in year one and CPI increases every year after with a maximum of 5% is reasonable. The proposed contract services agreement Addendum No. 2 would extend the term from July 1, 2023, through June 30, 2028. It is the opinion of staff that Contract Sweeping Services has been reliable under the current contract with minimal complaints received. All terms and conditions under the current agreement would remain in full force, except for the terms listed above, including maintaining the quality of service currently provided and as needed and emergency service calls.

If approved by the Council, the City Manager would execute Addendum No. 2 to the existing contract and include the proposed increases and maintain waste disposal responsibilities listed above. A copy of Addendum No. 2 to the contract services agreement is attached.

5.9 Packet Pg. 44

FISCAL IMPACT
The costs associated with street sweeping services are budgeted for within the Garbage Fund (600-790) and paid for through the Garbage Rates and is accounted for in the FY 2023/24 Adopted Preliminary Budget.

RECOMMENDATION
Staff recommends that the City Council adopt the following:

1. Resolution No. 2023-29 Approving Signatories for Banking Services with Bank of the West;

2. Resolution No. 2023-30 Approving Signatories for Investment of Monies in the Local Agency Investment Fund (LAIF)

BACKGROUND
Periodically, as the City undergoes staffing changes bank and investment signatures need to be updated with the financial institutions.

ANALYSIS
Financial and Investment Agencies require updated signature cards to be filed every time there is a change in key personnel. Due to the recent staffing changes, it is necessary to update the Authorized Signature Cards through the City's financial institutions.

Financial Institutions require these updates to go through Council approval before any changes are made. Having updated signature cards with the City's financial institutions, safeguards the City's assets and provides evidence that the account signatories are the authorized representatives of the City.

WHEREAS, Juneteenth, or Juneteenth Independence Day, commemorates the traditional observance of the end of slavery in the United States and is observed annually on June 19; and WHEREAS, Juneteenth embodies the indomitable human spirit of the past, the present, and all time; and WHEREAS, the celebration of Juneteenth gives us all the opportunity to rededicate ourselves to the true American spirit and to strive for a more perfect Union; and WHEREAS, President Abraham Lincoln issued the Emancipation Proclamation on January 1, 1863, and declared that all persons held as slaves "within the rebellious states are, and henceforward shall be free," paving the way for the passing of the thirteenth amendment which formally abolished slavery in the United States of America; and
WHEREAS, Juneteenth symbolizes freedom, celebrates the abolishment of slavery, reminds all Americans of the significant contributions of African Americans to our society, and is a time for reflection and rejoicing, assessment, self-improvement, and planning for the future; and WHEREAS, only through collectively striving may we close gaps of immeasurable distance between us and affirm the promise of the Declaration of Independence that all people have the right to life, liberty, and the pursuit of happiness; and
WHEREAS, Juneteenth celebrations are a tribute to those African Americans, then and now, who fought so long and worked so hard to make the dream of equality a reality; and WHEREAS, the collaboration of community-based organizations, faith-based organizations, local businesses, and local government demonstrates a shared commitment to being part of the solution and acknowledging the importance of strength through unity.

NOW, THEREFORE, BE IT RESOLVED that I Michael Clauzel, by virtue of authority vested in me as Mayor of the City of Patterson, and speaking on behalf of the entire City Council, do hereby officially proclaim June 19, 2023 as “Juneteenth Day” and call upon all citizens of the City of Patterson to join in recognizing the importance of this day.

IN WITNESS, HEREOF, I have hereunto set my hand and caused the official Seal of the City of Patterson to be affixed this 6

BY: Alysia Gomez,
MEETING DATE: June 6, 2023
ITEM NO: 7.1
SUBJECT: Authorize Staff to abate Public Nuisances at 128 Paramatta Dr., 606 Beck Creek Ln. and 576 Moray Way by securing buildings, removing weeds, dirt, rubbish, and other rank growth as required pursuant to the provisions of Ordinance No. 243 and Ordinance No. 704, as defined in Chapter 6.16 of the Patterson Municipal Code-Property Maintenance; Authorize Staff to begin bid process (Resolution No. 2023-31) Clean-Up Process.

RECOMMENDATION
Motion to Authorize Staff to abate Public Nuisances at 128 Paramatta Dr., 606 Beck Creek Ln. and 576 Moray Way by securing buildings, removing weeds, dirt, rubbish, and other rank growth as required pursuant to the provisions of Ordinance No. 243 and Ordinance No. 704, as defined in Chapter 6.16 of the Patterson Municipal Code-Property Maintenance; Authorize Staff to begin bid process (Resolution No. 2023-31) Clean-Up Process.

BACKGROUND
The abatement of Public Nuisances, including Weeds, Dirt, Rubbish and/or Rank Growth is a process Code Enforcement conducts, as required, per Ordinance, in an effort to reduce the aforementioned, which may interfere with public health and safety, endanger or injure, or be detrimental to, or which cause substantial diminution in the value of neighboring property or endanger or injure the welfare of the residents in the vicinity of such property, or which may become a fire hazard or public nuisance.

This process is conducted year-round, with greater emphasis placed on abating such nuisances between May and October, where hotter, dryer conditions create a greater potential for ignition of combustible materials.

7.1 Packet Pg. 89
Recent unlawful residential property nuisance conditions and activity including substandard conditions including, unauthorized entry, and lack of property maintenance from persons owning, leasing, renting, occupying, or having charge or possession of residential properties has occurred with some properties. Therefore, Code Enforcement has caused notice to be given requiring the abatement of such nuisances and stating that unless such nuisances be abated without delay by the securing of buildings, destruction or removal of the weeds, rubbish, dirt and rank growth, the nuisances will be abated by city authorities and the expense thereof assessed upon the lot, parcel and land from or on which such nuisance was abated.

ANALYSIS
Notice has been issued to the addresses listed (see Exhibit “A” April 25, 2023, May 17, 2023) and May 24, 2023) in accordance with the City of Patterson Municipal Code, Chapter 6.16 Property Maintenance, Sections: 6.16.030 and 6.16.050 (A), (B) which states:

6.16.030 Notice to abate nuisance.

Whenever the director, or such other official as may be designated by the city council, finds that weeds, rubbish, dirt or rank growth are growing, located or existing upon any property within the city in violation of the provisions of this chapter which may endanger or injure, or be detrimental to, or which cause substantial diminution in the value of neighboring property or endanger or injure the welfare of the residents in the vicinity of such property, or which may become a fire hazard, the director, or such other official as may be designated by the city council, shall give, or cause to be given, notice in the manner and in the forms specified in this chapter requiring the abatement of such nuisance and stating that unless such nuisance be abated without delay by the destruction or removal of the weeds, rubbish, dirt and rank growth, the nuisance will be abated by city authorities and the expense thereof assessed upon the lot, parcel and land from or on which such nuisance was abated. (Ord. 704 § 1 (part), 2008: Ord. 243 § 3, 1974.)

6.16.050 Service of notice.

Such notices shall be given in the manner set forth in this section:

A. The director, or such other official as may be designated by the city council, shall cause a notice or notices to be mailed by United States mail, to the owner of the subject property as shown upon any city record, or upon the last equalized assessment roll or at his last known address, whichever he shall determine to be the best means of serving notice upon the actual owner. Additionally, if the subject property address and the subject property owner’s address are different, the director or other designated official shall cause a notice or notices to be mailed by United States mail to the property address. The failure of the owner to receive such notice shall not affect the power of the city or of its officers or employees to proceed as provided in this chapter.

B. Such notice shall be mailed not less than ten days prior to the date set for a hearing upon objections as provided in Section 6.16.060
<http://www.codepublishing.com/CA/Patterson/html/Patterson06/Patterson0616.htm l> of this chapter. (Ord. 704 § 1 (part), 2008: Ord. 243 § 5, 1974).

7.1 Packet Pg. 90
A revised and updated list will be provided at the City Council Meeting.

The property owner has not responded to the aforementioned notice within the time prescribed, and therefore staff is requesting approval from the City Council to authorize staff to address the nuisance, per Patterson Municipal Code, Chapter 6.16 Property Maintenance Section 6.16.190.

FISCAL IMPACT
The recommended action would not directly result in an impact to the City’s funds, with the exception of staff time spent on surveying the properties. All costs incurred will be recouped by the City as per the Patterson Municipal Code, Chapter 6.16 Property Maintenance Section

6.16.190:

6.16.190 Assessment of costs against property-Lien.

The cost of abatement upon, or in front or rear, of each lot or parcel of land shall constitute a special assessment against that lot or parcel. After such assessment has been made and confirmed, it shall constitute a lien upon such lot or parcel for the amount of such assessment, until paid. (Ord. 704 § 1 (part), 2008: Ord. 243 § 16, 1974.
